31. Violence and Security Concerns in Post-Conflict Northern Ireland

Abstract:
Eighteen years after the Good Friday Agreement, Northern Ireland struggles with a lingering sense of insecurity. This article discusses the underlying reasons for a sense of insecurity and vulnerability in this post-conflict context. First, ongoing sporadic communal violence reactivates communal divisions and the psychological burden of “the Troubles.” The activities of spoiler paramilitary groups and sporadic communal troubles still fuel people’s anxiety about the possibility of renewed violence, as the history of political violence proves how these influences can be a destabilizing factor in inter-communal relations. Second, the unchanging patterns of political mobilization, based on the historical division of unionism and nationalism, reinforce the previous cleavages and continue to inform the boundaries of the communal divide. The political arena is still plagued by ethnic outbidding and intransigent party politicking, both of which pit communities against each other and keep the zero-sum bias between the groups alive. Third, the working-class communities that constituted the backbone of the political violence carry on the legacy of war with their continued paramilitary presence and legacy of sectarianism. The social vulnerabilities of working-class areas, such as continuing paramilitary presence, the legacy of sectarianism in segregated neighborhoods, persistent mistrust toward the police, and growing youth unemployment, need to be addressed in order to generate a long-term social infrastructure for peace.

Abstract:
This article provides a critical analysis of the literature and reports on peace education programmes in countries emerging from violent conflicts. First, it begins with an overview of peace education’s history. Next, it examines how peace education has been conceptualised, and highlights why it remains poorly defined. The article then proceeds by looking at the development of the international community’s use of peace education as a tool to contribute to their peacebuilding efforts in countries emerging from protracted contexts. After that, it reviews the research and evaluation work that has been done on peace education programmes. The article concludes with a survey of peace education programmes in ethnically/religiously linked post-conflict environments that have made mainstreaming their goal, and identifies areas of future research.

Abstract:
Post-conflict Kosovo offers a complex and interesting context to examine the role women play in post-conflict development. Though women were not heavily involved in the formal peace negotiations that ended the hostilities in Kosovo, they played key roles in civil society before the war and actively sought ways to participate in the reconstruction efforts. At the grassroots level, and in unofficial channels, women worked towards peace and stability in their communities. Post-conflict Kosovo presents a useful case to examine the theory that women’s empowerment – in economic, political, and social spheres – leads to a more sustainable and prosperous peace. The international community affirmed this belief by providing security, financing, and expertise to build institutions that advanced women’s rights after the war, while Kosovar women demonstrated the ability and willingness to contribute meaningfully to their country’s reconstruction.

34. The International Criminal Court and conflict transformation in Uganda: Views from the field

Abstract:
The International Criminal Court (ICC) commenced investigation of the armed conflict in Uganda in 2004. In 2005 it issued arrest warrants for five leaders of the Lord’s Resistance Army (LRA). This article examines how the court’s involvement in the situation has impacted on conflict transformation in Uganda after ten years of judicial work. It also addresses the problem of assessing the impact of law on conflict through the use of an analytical framework that is based on four variables: deterrence, victims’ rights, reconciliation, and accountability to the law. Relying on this framework, and on a report of a field research project in Uganda, it argues that the ICC’s intervention has had multiple impacts on the situation in Uganda, and that despite some arguments to the contrary, the ICC does promote conflict transformation through deterrence, promotion of accountability to the law and promotion of victims’ rights.

Abstract:
This article interrogates the practicability and efficacy of arts-based methods for peacebuilding as opposed to the formal negotiating table within African grassroots communities. It problematises the application of western liberal peace models at grassroots level. The article reviews and locates itself within the broader discourse of alternative or informal peacebuilding. Using the case study of Rwandan post-genocide dramatic reconstructions, the article illustrates specific participatory theatre techniques extracted from the applied theatre field and how these can be employed for peacebuilding at grassroots level. The article argues for a safe, aesthetic space, created by theatre as critical to peacebuilding activities. To give a rounded overview, the article finally reflects on potential disadvantages and controversies of using participatory theatre for peacebuilding and concludes that creative arts-based methods offer practical, inclusive, inexpensive space conducive for organic peacebuilding at grassroots level.

Abstract:
Almost two decades ago, the Democratic Republic of the Congo (DRC) was confronted with a vicious cycle of internationalised armed conflicts in which between six and ten million people are estimated to have been killed. Those conflicts were resolved through peace agreements between the leaders of the warring parties, leaving affected populations to their predicaments. From among the mechanisms during peace talks aimed at dealing with the past, the Congolese opted for an international ad hoc tribunal and a truth and reconciliation commission (TRC). Unfortunately, the United Nations was unwilling to establish such a tribunal in the DRC and the TRC put in place did not investigate a single case. Therefore, the DRC lost opportunities to hold accountable alleged perpetrators, establish the truth of the past, promote reconciliation, and prevent further violence. The subsequent resumption of conflict is the result of failing to address the past. After the stabilisation of the country, a combination of judicial and non-judicial mechanisms of transitional justice could respond to past abuses and contribute to the peacebuilding process in the DRC. Hence, this paper endorses as a judicial mechanism, in addition to the International Criminal Court (ICC), the establishment of a hybrid international tribunal to hold accountable those who bear the greatest responsibility for events since 1996. This paper also endorses the promotion of the non-judicial indigenous mechanism Barza intercommunautaire to help resolve low-level disputes and pave the way for a new TRC that could promote reconciliation, formulate recommendations on institutional reform, identify criteria for the lustration and vetting process, identify victims and recommend reparations.

Abstract:
During 1983-2005 Sudan hosted one of Africa’s longest insurgencies. Throughout the conflict a number of competing peace initiatives coincided, but a process under the mediation authority of the Inter-Governmental Authority for Development (IGAD) prevailed. However, although initiated in 1993, the IGAD process only accelerated after the September 2001 attacks on the United States (US) and was consequently finalised through the signing of the Comprehensive Peace Agreement (CPA) in less than four years’ time. Although it was presented as IGAD’s success as a conflict resolution body, in reality the organisation’s role in the making of peace in Sudan was to a large extent conditioned by the involvement of a narrow selection of Western stakeholders. This article examines the IGAD peace process in Sudan, highlighting the dynamics and relative roles of the principal actors involved. It argues that although the negotiations were portrayed as inherently sub-regional, and adhering to the idea of ‘African solutions for African problems’, a closer analysis reveals that the peace process was dominated by external protagonists. This resulted in the interests of Western actors, particularly the US, playing a prominent role in the negotiated agreement, consequences of which are currently experienced both in Sudan and South Sudan.

Abstract:
This paper will outline past examples of successful cooperation in relevant operations (that is, in meeting security issues on the continent) in the western Balkans, and show the implications this has in moving forward. In doing so, the initial international response to the breakup of Yugoslavia will briefly be reviewed, and the subsequent involvement of NATO and Europe to these conflicts in the 1990s. This leads to US/NATO efforts that finally brought the warring parties to the table, and Europe’s increasing involvement as NATO phased out its operations. The evolution of institutional and operational dynamics of cooperation between the EU and NATO will then be examined before focusing on this relationship in regards to the western Balkans, and the impact it has had on the region —both positive and negative —to date. The paper will conclude with the lessons drawn and the implications for EU and NATO relations’ moving forward, as conflict once again has emerged on the European continent.

39. Security Sector Reconstruction in a Post-Conflict Country: Lessons from Timor-Leste

Abstract:
Post-conflict missions by the United Nations are increasingly mandated to reform the secu- rity sector and to establish viable security governance organs in, often, collapsed states. UN missions in Timor-Leste, tasked with the build-up of local security institutions and forces from 1999 to 2005, were regarded by some as successful examples of externally-led security sector transformation in so far as they managed to establish a local police force and local security governance institutions. Yet, the breakdown of the Timorese security sector during violent clashes between newly created security forces in 2006 hinted at weaknesses in the ex- ternally driven implementation of SSR. The UN mission subsequently mandated to assist in rebuilding the dysfunctional security sector, was however openly challenged by growing local resistance towards external meddling into the highly sensitive domain of security, and simul- taneously, by assertive local approaches to security governance. By tracing the UN mission’s steps in performing SSR before and after the security breakdown of 2006, the paper explains inherent flaws in the UN’s approach and expounds the Timorese’ alternative approach. It will be argued that the UN failed to enforce its security governance model in Timor-Leste creating the way for an evolving local approach to security governance.

40. Justice and peacebuilding in post-conflict situations

Abstract:
After the 1991-2001 civil war, Sierra Leone employed a new model of transitional justice, concurrently utilising a Truth and Reconciliation Commission (TRC) and a Special Court. Encouragingly, this process incorporated special gender considerations, by expanding the mandate of both the TRC and Special Court to address sexual violence and encourage women to come forward and testify without fear of retribution. Both these institutions have been praised for successfully fulfilling their specific mandates and for aiding the country’s transition to peace. However, some parts of Sierra Leone’s society were left largely untouched by the process, as evidenced by widespread discrimination and gender inequalities which still occur today. It is proposed that this is not just a fault of Sierra Leone’s approach, but that it is an inherent flaw of the transitional justice process as a whole as the process is not suitable for use in addressing the root causes of conflict. For this reason, it is argued that a new mechanism of transitional justice, one which incorporates a peacebuilding process, would better address the needs of a post-conflict society. This would be done by focusing on transformation and promoting a long-term sustainable peace.
