Abstract:
The following article tries to analyze the transformation of the Salvadoran police from the implications of the 1992 Chapultepec Peace Agreements. In this way, the 25 years between 1992 and 2017 are taken as the period of study, in order to observe the level of transformation experienced by the new National Civil Police. Making use of an in-depth legislative review and different in-depth interviews, the article analyses in particular the scope and meaning of three dimensions in this transformation: police selection and training, the degree of delimitation of the police function and the foundations of the police career. Thus, while it is true that important progress has been made, it is possible to find shortcomings and weaknesses that persit, after more than two decades, in a way that is so worrying that it must be resolved./El siguiente trabajo tiene como objetivo analizar la transformación de la policía salvadoreña a partir de las implicaciones que tuvieron los Acuerdos de Paz de Chapultepec de 1992. De este modo, se toma como tiempo de estudio los 25 años que transcurren entre 1992 y 2017, para así observar el nivel de transformación experimentado por la nueva Policía Nacional Civil. Haciendo uso de una profunda revisión legislativa y de diferentes entrevistas en profundidad, se analiza en concreto el alcance y significado de tres dimensiones en particular: la selección y formación policial, el grado de delimitación de la función policial y los fundamentos de la carrera policial. Así, si bien es cierto que se han conseguido importantes avances, es posible encontrar carencias y debilidades que, tras más de dos décadas, persisten de manera tan preocupante como irresoluta.

Abstract:
The use of police force, either in the context of management of public assemblies and demonstrations or in the context of more routine police functions such as searches, seizures or arrests, has come under increased scrutiny around the world. Latin America, in particular, has become the epicentre of a wave of police reforms triggered by incidents involving the use of force. This publication aims to provide guidance on the key pillars that shape governance of police use of force. The paper focuses on the three main dimensions of the use of force: rule of law, human resources, and accountability. The document was built upon the work that DCAF has undertaken with police organisations in different regions and is informed by DCAF’s decades of experience supporting police reform processes across a range of countries. It offers specific examples to illustrate the context-dependent nature of each countries’ practices. While some of the examples come from countries with relatively low levels of crime and violence, the rationale behind their use of force practices is still worth considering as the underlying principles can often be adapted even to contexts that are more fragile or complex.

Increased calls for evidence-based policing, together with technological advancements in recent years, have led to a rise in the use of surveillance tools such as Closed-Circuit Television, dash-cams, and body-worn cameras in policing, both for accountability purposes and for crime prevention and responses. However, the effectiveness of such tools has often been questioned and concerns have been raised repeatedly about privacy, wrongful criminalization, the laterality of police officers’ access to footage, erratic and selective use of camera technology, and the erosion of civil rights.

In many countries, the police, as a part of public administration, have witnessed many changes during the last few years. This article explores the process of the reform of the Polish police force, which took place between 2015 and 2017. Doing so examines in detail the process of implementing an IT tool – The National Security Threat Map – by paying particular attention to the mechanism of engaging external stakeholders. This study is conceptual but empirically focused. The paper posits that, despite the hierarchical nature of the police administration structure, it is possible to build an engagement of external stakeholders.

Experts suggest that a police force should closely reflect its state’s constitution and its societal fabric.1 It follows, therefore, that the design of a new policing system or the reform of an old one will be affected by the ideas and the realities of power within the state and by the nature of its society. Nowhere are these principles more visible than in the reconstruction of a post–conflict country. The underlying assumption in such situations is that police reform is a fundamental element of conflict management because a police force, supported by society, can mitigate insecurity and play a significant part in the economic and political development of a country.2 This assumption has one fundamental flaw. For a police force to help deliver security and development in a post–conflict situation, there should exist at least a modicum of security and economic and political development. This “chicken and egg” situation is most starkly evident in the attempts to reform the police service following the U.S.-led invasion of Iraq in 2003. The security sector reform programs in Iraq, of which police reform is a component, not only challenge some assumptions upon which international development is based, but also provide potential insights into the relationship between the police, power, economic security, and society in general. These relationships could also apply to developed countries as their political and eco- nomic systems are challenged or changed by global events.

In January 2021, Prime Minister Benjamin Netanyahu paid a visit to Umm al-Fahm, an Arab city in the north of Israel. The visit, officially celebrating the country’s millionth COVID-19 vaccine recipient, also had a political purpose: winning the forthcoming elections in March 2021. For the first time, Netanyahu and the Likud party hoped to gain support from Israel’s Arab citizens. Among Netanyahu’s promises of economic betterment was a commitment to fight ris- ing crime and violence in Arab cities. He pledged “a comprehensive plan” with the primary goal of constructing more police stations “because a dense network of police stations creates more security.” Going further, he added that he “also want[ed] more intelligence, more officers, and more means [of enforcement].” Netanyahu declared himself “first and foremost committed to the rule of law and safety for citizens.”1

In October 2020, a viral video showed an officer from the Special Anti- Robbery Squad (SARS), a notoriously brutal Nigerian police unit, killing an unarmed civilian. Following credible reports by human rights organizations about a string of extrajudicial killings by police, this video sparked spontaneous demonstrations in Lagos. The video was widely circulated and the demonstrations spread to other cities. These protests reached a nadir when the police killed at least 12 unarmed demonstrators at the Lekki Toll Gate in Lagos on 20 October; human rights groups maintain that the number killed was far greater.1

Abstract:
In recent years, pervasive physical violence perpetrated by police forces across the world has come to light. From São Paulo to Cape Town, from Hong Kong to every major U.S. city, the public has witnessed—mostly through media images—policing through the use of excessive force, such as beatings, assaults, false arrests, verbal abuse, and terrorization. These acts shock us and may even make us feel unsafe. However, they are not directed toward all groups equally. The experiences of Black people fighting for justice in the United States; poor residents protesting extreme social inequality in Ecuador and Chile; Muslims in India facing violence for their religious beliefs; women in Mexico City and Santiago protesting gender-based violence; and anti-government protesters in Hong Kong demonstrate a clear pattern: vulnerable groups who oppose the state or its policies, or who seek to redress past state violence, are the primary targets of police violence.

70. Qualified Immunity: A Legal, Practical, and Moral Failure

Abstract:
Qualified immunity is a judicial doctrine that protects public officials from liability, even when they break the law. The doctrine has no valid legal basis, it regularly denies justice to victims whose rights have been violated, and it severely undermines official accountability, especially for members of law enforcement. Accountability is an absolute necessity for meaningful criminal justice reform, and any attempt to provide greater accountability must confront the doctrine of qualified immunity. This judicial doctrine, invented by the Supreme Court in the 1960s, protects state and local officials from liability, even when they act unlawfully, so long as their actions do not violate “clearly established law.” In practice, this legal standard is a huge hurdle for civil rights plaintiffs because it generally requires them to identify not just a clear legal rule but a prior case with functionally identical facts.
