Abstract:
George Floyd’s murder by the police in Minneapolis provoked widespread political agitation across the country. It once again highlighted the problematic racial dimension of policing and eggregious violation of human rights commitments on the part of the government. In this article we explore how the human rights law and racism in the United States interact with each other? We employ qualitative research based on descriptive-analytical method and divide the article in four parts: a brief introduction, ahistorical background of racism, a conceptual comprehension of racial discrimination and a brief survey of the international human rights instruments against racism, and the onground situation of racial discrimination in the country. We conclude that the process of negotiation between human rights law and racism in the United States is far from settled yet.

Abstract:
To what extent do slanted media influence police perceptions and thereby their use of violent forces? We know that media bias affects many aspects of American life, such as perceptions of facts and views of politicians and policies. In this paper, we show that there is little evidence that slanted media influences police violence. To assess this relationship, we employ instrument variable estimation using the quasirandom positioning of FNC in the cable lineup as a source of exogenous variation in viewership. The evidence shows that increased exposure to FNC does not lead to more frequent police killings of Black people or people of other races. Our results suggest that slanted media coverage of crimes does not necessarily lead to fatal racial discrimination by police officers.

54. Follow the Money: Few Federal Grants are Used to Fight Cybercrime

Like traditional crime, not all cybercrime rises to the level that requires a federal response. And like other crimes, victims will call upon state and local law enforcement to respond.1 They are unprepared. The 18,000 law enforcement agencies in the United States lack the tools, personnel, and resources to respond to cybercrime effectively. State and locals have turned to federal funding to fill these gaps, but federal government grants do not prioritize combatting cybercrime. The Justice Department (DOJ) has never identified cybercrime as an “Area of Emphasis” for their main criminal justice grant that awards state and local criminal justice agencies $400-$550 million annually.2 And while DOJ and the Department of Homeland Security (DHS) provided nearly $2 billion that state and local officials could use for cyber enforcement purposes in Fiscal Year (FY) 2019, data from DHS implies that very little is used for cybercrime. Only 2% of all DHS preparedness grant programs were used for all cybersecurity needs in FY 2019.3 Moreover, just three grants in FY 2019 were solely dedicated to cybercrime with a total budget of $12.7 million.4 As a result, only 45% of local law enforcement agencies have access to adequate digital evidence resources, according to one survey. This leads to a backlog of un-analyzed evidence needed to investigate cybercrime and a sense of futility about law enforcement’s ability to close cases.5 While Members of Congress have introduced several bills to create dedicated cybersecurity grant programs for state and local entities, these proposals tend to not include cyber enforcement needs as an eligible expense.6 Moving forward, Congress should: Call on DOJ and DHS to prioritize combatting cybercrime as a main law enforcement issue within their grants. Require prioritization of cyber enforcement needs in grant programs administered by DOJ and DHS in annual appropriations bills; and List cyber enforcement spending as an eligible expense in any bills creating new cybersecurity grant programs for state and local governments.

Abstract:
Recommendations to the Zimbabwean government Commit to a new, inclusive pathway for a mediated, citizen-centred national dialogue to align with and enact the principles set out in the Zimbabwe Constitution of 2013, to resolve the current constitutional crisis and legitimacy question. Comprehensive legal, political, and economic reform is critical. Commit to the drafting and passing of a comprehensive electoral law consistent with the 2013 Constitution that guarantees the independence of the Zimbabwe Electoral Commission (ZEC), allows for the appointment of an independent ZEC chair from outside of Zimbabwe, and prevents government from interfering with the work of the commission. Ensure a comprehensive delimitation exercise, extend the voter registration process, and ensure there is a transparent and comprehensive verification process to develop a credible voters’ roll. This would include allowing independent interested stakeholders from civil society, the media, and opposition parties access to inspect the voters’ roll prior to elections. Promote a free and fair election campaign environment for all players, and actively guard against voter intimidation by establishing a special body to investigate complaints of political violence and allow external independent observers early access to all voting stations prior to election day. Restore independence and citizen trust in the county’s public institutions through, for example, the institution of an independent and impartial judicial committee tasked with restoring judicial independence and making recommendations for complete judicial reform, to eradicate judicial corruption, ensure the independence of judges and improve the functioning of the courts. End partisanship in the police force, starting with undertaking investigations into allegations of human rights violations against the Zimbabwe Republic Police (ZRP) and other security sector agencies, and ensuring those responsible for such abuses are held accountable under the law.

Abstract:
The first section introduces the level of trust expressed by respondents on the relevant institutions (justice, security and municipal institutions), as well as the direct contact of the surveyed respondents with these institutions during 2018. Similar to previous years, security institutions are leading when it comes to public trust when compared to other institutions analysed in this special edition. The second section of the report interprets key security threats and risks in Kosovo. Given that corruption has been ranked as the highest problem to Kosovo’s national security, this section is focused on views of respondents towards corruption in the relevant institutions. Apart from general interpretation of data on corruption in Courts, Prosecution, Kosovo Police and Municipalities, the report offers cross-tabulated data analysis based on regions, rural/urban areas, gender balance, and ethnic composition of respondents for all targeted institutions. While, the third or final section of the report provides a detailed interpretation of open-ended and closed-ended questions of the 2018 survey of Kosovo Security Barometer on main issues harming police integrity in Kosovo. Accordingly, results presenting opinions of respondents on corruption within sectors of the Kosovo Police mirror a better understanding on what are the most and the least corrupted police sectors in Kosovo. Furthermore, data analysis through cross-tabulated results (based on regions, areas, gender balance, and ethnic background) provides an exhaustive elaboration of respondents’ attitudes towards police corruption in Kosovo. Given that the Kosovo Security Barometer’s survey was conducted in the second half of 2018 (September-October 2018), thus it does not reflect some of the developments that have occurred from November 2018 to March 2019.

Abstract:
This paper explores the potential of abolishing school resource officers (SROs), their history in education, and their role in exacerbating the effects of the school-to-prison pipeline and racial injustice. In the midst of calls to defund the police, policies to abolish police in schools are a vital first step. This paper argues that there is an interconnected history between SROs and surveilling youth-led civil rights movements. Today, we see the results—SROs have negatively impacted Black and brown youth subjugating them to higher rates of school-related arrests. Using historical case studies of Oakland and Los Angeles, this research draws on the potential to enact policies that end police in schools. Additionally, this paper places organizers as key actors in policy change. The analysis situates the movement to eliminate SROs as an extension of the civil rights struggle and as a microcosm of the modern-day struggle for abolition.

Over the past decade, the UN has undertaken several initiatives to increase the number of women police officers deployed to peace operations. Collectively, these initiatives have increased the proportion of women police officers deployed to UN missions. However, women police still face challenges deploying to missions and effectively contributing to mission mandates. This paper interrogates the experiences, concerns, and needs of women police officers deployed to UN peace operations. First, it analyzes progress on including more women in UN police forces. Second, it provides arguments for including more women police officers. Third, it describes the multifaceted challenges that women police officers face both before and during deployment. Finally, it provides recommendations for how police-contributing countries (PCCs) and the UN can move toward a shared, sustainable approach to the full, equal, and meaningful participation of women police officers in peacekeeping. While the UN often argues for deploying more women peacekeepers because they will increase missions’ operational performance, this rationale risks reinforcing some of these challenges by perpetuating stereotypes about the role of women in missions. Missions should instead focus on women police officers’ right to deploy. To ensure women have this right, both PCCs and missions need to foster an enabling working environment and address structural barriers to women’s participation.

Abstract:
How the narrative of the fight against organised crime is used to capture the state? Find out in the latest BCSP analysis. The objective of this report is to analyze the narrative of the fight against organised crime, i.e., the story the authorities are offering the public concerning this topic, for the purpose of establishing how it is used to capture the state. More precisely, the analysis attempts to explain how the polygraph was abused during the declared war on mafia to suspend judicial institutions, ‘cleanse’ some in the eyes of the public or criminalise others outside the statutory criminal procedure, and to identify the consequences of this approach to fighting organised crime. The so-called war on mafia officially began on 19 October 2020, when the President of Serbia used his Instagram profile to announce the final showdown between the state and organised crime. Set forth after a series of unsolved murders that had taken place on the streets of Serbian cities – characterised by experts mostly as mafia-style terminations – it initially looked like a marketing move that preceded the constitution of a new Government. Such understanding was supported by the fact that this was not the first time that government officials declared war on organised criminal groups. Former Minister of the Interior [MoI] declared a similar war almost four years earlier, under similar circumstances. One hero particularly stood out in this war. It was the lie detector, the omnipotent polygraph, used extensively in the previous months as the supreme arbiter of truth. Instead of lengthy court proceedings, complex investigations and obtaining evidence acceptable to the court, the polygraph was used by the highest state officials as a simple tool to directly prove to the citizens whether someone was telling the truth or lying, and to unmistakably determine guilt or innocence. Trials were replaced by media performances involving debates on who passed the lie detector test and who refused to take it, while politicians kept offering to be subjected to it or calling each other out for not doing the same thing, all in the name of the alleged fight against organised crime.

“A series of extreme far-right cases among members of Germany’s military and police highlight the threat of the enemy within: radicalized extremists within security services, with access to weapons, training, and confidential information,” Florian Flade writes in this month’s feature article. According to Flade, “The specter of armed underground cells being trained by former or current members of the security services has been a wake-up call for authorities. New measures have already been implemented within Germany’s domestic and military intelligence agencies to more effectively root out enemies of the state wearing uniforms. Nevertheless, the threat will most likely persist in the coming years.” He adds that “with the United States and other countries also grappling with this problem set, it is vital to share lessons learned and best practices at the international level.” This month’s interview is with Idriss Mounir Lallali, the Deputy Director and Acting (Interim) Director of the African Centre for the Study and Research on Terrorism (ACSRT), a structure of the African Union Commission (the secretariat of the African Union). Alex Newhouse examines “the multi-node structure” of a global network of violent neo-fascist accelerationists seeking system collapse. He writes that “evidence from Atomwaffen’s development and collapse reveals that it was not the apex of a hierarchy of groups, but rather one node in a larger network of violent accelerationists. This network is built on membership fluidity, frequent communications, and a shared goal of social destruction. This framework is vital to understanding how and why action against individual groups is not sufficient, and why the threat from Atomwaffen has not faded in spite of its reported ‘collapse.’ The lesson to be drawn from the history of the Atomwaffen Division is that the current threat of neo-fascist accelerationism exists more in the evolution of the network as a whole, rather than in any one individual group.” Peter Kirechu examines “Iran’s Currency Laundromats in the Emirates.” He writes that “Since 2014, the United States has sanctioned dozens of Iranian nationals and commercial entities for the illicit acquisition of U.S. and other foreign currencies. A close review of these designations reveals the organized character of Iran’s illicit currency laundering operations and the role of the Islamic Revolutionary Guard Corps (IRGC) in their orchestration. It also shows that Iran relies on a diverse network of illicit commercial entrepreneurs to covertly access foreign currencies abroad. These actors operate under the cover of legitimate commerce and exploit the vulnerabilities of regional economic centers—such as the United Arab Emirates—to provide covert financial resources to the Revolutionary Guards.”
