61. Regional Powers and Leadership in Regional Institutions: Nigeria in ECOWAS and South Africa in SADC

Abstract:
Regional powers are not always benevolent leaders when it comes to the building of regional institutions. While powerful states – particularly the “new” rising powers – may have a vested interest in regionalism as a means of projecting influence, regional powers may behave as coercive or benevolent leaders, or alternatively display an absence of leadership altogether. The drivers of varying regional power behavior can be attributed to their competing concerns regarding (economic) power, functional efficiency, international legitimacy, and neopatrimonial networks. This paper explores the varying behavior of Nigeria and South Africa in relation to the institutionalization of free trade areas and regional courts within their respective regions. Nigeria has displayed little leadership in ECOWAS trade integration due to domestic opposition; however, a newly-democratic Nigeria’s search for international legitimacy drove the establishment of the ECOWAS Court of Justice. Likewise, South Africa’s search for legitimacy drove its support for the SADC Tribunal, but the competing demands of different audiences led it to abandon this support. South Africa has also displayed leadership in relation to the SADC Free Trade Area; however, its neighbors perceive it as a self-interested, almost coercive actor. The findings suggest that the motivations for regional powers’ behavior vary across time and policy sectors, and that inconsistent behavior is driven by a change in the priority granted to different drivers.

Abstract:
This article argues that the unraveling of the post–Cold War liberal order is manifested by the West’s declining influence in international politics; the waning attraction of liberal democracy; and the maturing tensions within liberal democratic regimes. This unraveling renders problematic the European project of trying to extend democracy beyond the nation-state—a project that has enhanced the appeal of illiberal democracy, defined by majoritarian regimes in which the majority transforms the state into its own private possession. These regimes have become an answer to the pressures of a world where popular will is the only source of political legitimacy, and global markets are the only source of economic growth. Their rise portends devastating and far-reaching consequences throughout Europe.

63. Assessing Haiti’s Electoral Legitimacy Crisis – Results of a 2016 Survey

This Strategic Note presents the results of a national survey of 1,766 Haitian adults conducted between January 17 and 22, 2016. Respondents were asked about their participation in voting, barriers to participating in the voting process, their choice for president, and their opinions about a variety of possible solutions to Haiti’s electoral impasse. It finds that there is widespread pessimism about the direction the country. It also detects that voter turn-out in October 2015 was likely considerably less than officially reported. However, the survey shows that most Haitians would vote if they were confident that elections were free and fair. The most important issues that Haitians believe the next president should tackle are jobs and the economy, followed by corruption, regaining trust, and education.

64. How Sustainable is Democratic Innovation? Tracking Neighborhood Councils in Montevideo

Abstract:
Focusing on the relatively longstanding experience of neigh- borhood councils in the Uruguayan capital of Montevideo (1993–), this research note seeks to analyze how sustainable democratic innovation is and to explain subsequent results. Sustainability is assessed through the evolution of citizens’ participation in elections and through the number of candidates who apply to become neighborhood councilors. For both indicators, a consistent decline in the levels of participation over time is found. This is deemed to be a consequence of an institutional design that seriously limits the performance of neighborhood councils in terms of their influence in the decision-making process and their acquisition of legitimacy and political capital.

Abstract:
For 25 years, the Journal of Democracy has been “taking the temperature” of democracy around the globe. Here in our twenty-fifth anniversary issue, we feel compelled to confront head-on the question of whether democracy is in decline. Why? There are two aspects to the answer, which although intertwined are in some measure separable. The first deals with what is actually taking place on the ground: How many countries are democratic? Is their number rising or shrinking? What is the situation with respect to such liberal-democratic features as freedom of the press, rule of law, free and fair elections, and the like? The second, more subjective, aspect concerns the standing of democracy in the world: How is it viewed in terms of legitimacy and attractiveness? It is in this latter dimension that the evidence, or at least the widespread perception, of decline is most striking. Democracy’s supporters must undertake a clear-eyed appraisal of democracy’s current decline and summon the resolve and seriousness of purpose needed to reverse it.

While the security challenge posed by Russia stood at the center of discussions then, Europe’s crisis has broadened in the intervening months: The euro crisis has not been solved. The loss of legitimacy of European institutions has accelerated. A migrant crisis of unforeseen dimensions has shaken the continent. These four challenges make up the crisis that would stand at the center of this year’s Summit.

Research on Public Trust in the Police in Turkey, is based on survey data collected on a large-scale sample representative of Turkey. The report provides insights on perceptions of the public with regard to effectiveness/performance, legitimacy of the police and thereby lays bare the level of trust different segments in Turkey attribute to the police. The report utilizes sophisticated statistical methods and, for the first time in Turkey comprehensive scientific models on police trust are being applied giving the opportunity to comparatively analyze the results. Thus the following questions are examined in the report: What is the level of public trust towards police? What are the main components of police trust in Turkey? In how far do police legitimacy and police effectiveness/performance affect police trust in Turkey? What are the factors influencing public’s perception of police legitimacy and effectiveness? How does public’s perception of police legitimacy and effectiveness affect cooperation with and compliance to the police? How does this perception affect public’s toleration of police misconduct? How does public perception of police legitimacy, effectiveness and trust change with regard to different demographic factors in Turkey (political affiliation, ethnic background, religious affinity etc.)?

Abstract:
The year 2013 saw the beginning of a unique period in the history of an independent Ukraine. The victory of the Euromaidan, which seemed to be a successful completion of the Revolution of Dignity, in reality was merely the first step on the path of revolutionary transformation of all aspects in the life of Ukrainian society and state. Security issues are of high priority in the ambitious plans of reforms initiated by the Ukrainian government: “The security vector is our certainty about our tomorrow, being peaceful and happy. It is our certainty of justice and inevitable punishment for each crime. Our certainty that no person is unfairly convicted. The certainty of guaranteed security of investments and property”.1 Guaranteeing the required level of domestic security, primarily the security of a person and a citizen, largely depends on the capability of the law enforcement agencies to perform the functions entrusted to them by national law, and their ability to serve the society and not the government or their own selfish interests. In the system of functions delegated by the state to law enforcement agencies, the policing function has a special role, since the police, in addition to being the most numerous structure, is on the “frontier”, where a citizen may receive protection from, or be persecuted by, the state. For this reason, police reform is receiving considerable attention from the Ukrainian government, society and Ukraine’s international partners. The overwhelming majority of police officers also acknowledge the need for radical change, being dissatisfied with working conditions, level of social security and the negative view of their work on the part of society. Analysis of the current reform efforts leads to the conclusion that, despite the presence of many extraordinary aspects and significant positive differences, they still have many features typical of the prior unsuccessful reform attempts. The most important reasons impeding the implementation of the generally positive declarations and concept documents include the lack of political will as well as the pursuit of political and private ends that have nothing in common with the national interests or international standards. Taking into account our own errors is as important for success as studying the diverse international experience. The lack of coordination of reforms from a single centre, despite the formal presence of the respective structure, inefficient use of the tightly limited resources and attempts to substitute minor changes (restructuring, personnel rotations, name changes, etc.) for a true transformation – all of this has been seen on multiple occasions before. The lack of political will is most often mentioned by experts and community activists looking for answers to the questions why the reforms are advancing so slowly or why the results claimed by the politicians remain hardly noticeable for civilians. Society and the entities being reformed may become more optimistic about the success of the reforms if the Government sincerely demonstrates its interest in developing a European model of the police service, and, most importantly, proves it by real actions. The active participation by community activists, non-governmental organisations, and international partners in the reform processes are important but merely auxiliary factors. The duration and resources of a powerful international support are limited and directly depend on the demonstration of practical results. The analytical report is intended to make an intellectual contribution to the joint effort of developing the Ukrainian law enforcement agencies, whose performance is evaluated not by statistics or the opinion of the government, but by the satisfaction of society with the quality of the respective services, the citizens’ feeling of safety and justice and their level of trust in and respect for those who protect them.

69. Factors Undermining Legitimacy in Libya

Abstract:
The security situation in Libya continues to deteriorate despite a steady growth in state security forces. Ongoing bombings, assassinations, kidnappings and smuggling are seen as a failure of the state authority and have prompted retired General Khalifa Haftar to call for the toppling of the General National Congress (GNC) and Libyan government. There was limited popular or military and armed factions support for this call; however, there has been some public sentiment calling for a strong military figure to contain disorder. They are opposed by Libyans who hold reservations about change by force. Haftar’s call, then, serves to extend regional trends and complicate the containment of federalism. It is also further consolidation of competition between figureheads occurring undemocratically and external to electoral processes.

70. Sisi as President: Questionable Legitimacy, Unclear Future

Abstract:
On 8 June 2014, Abdel Fattah al-Sisi, Egypt’s former Minister of Defence, was sworn in before the Supreme Constitutional Court as President of the Egyptian Republic. On 3 July 2013, Marshal Sisi, a general at the time, led the Egyptian army to overthrow President Mohamed Morsi after only one year in office. The lavish formalities of the inauguration swept through some circles with euphoria. For others, it only intensified feelings of calamity dating back to the 30 June 2013 demonstrations, when the military command overthrew the first popularly-elected civilian president in the history of Egypt. It is important to note that the current euphoria of victory is not related to Sisi winning the majority in the recent Egyptian presidential election because his victory was clear even before the election. Rather, it is a function of the Egyptian deep state’s victory against the challenges and risks that have threatened it since the overthrow of the Mubarak regime on 11 February 2011.
