1301. Kosovo: Orders of Magnitude

Abstract:
The issue of the number of civilian causalities in the Kosovo war of 1999, especially of "battle-age" men, attracted considerable controversy both during the war and in its aftermath. This article considers the pattern of Serb atrocities in the province, and the pace and character of the forensic investigations conducted since the war by the International Criminal Tribunal for the Former Yugoslavia (ICTY). It argues that the lowest casualty estimates are highly unlikely, given the evidence of widespread mass executions gleaned from refugee testimony and forensic investigations. The article concludes with some thoughts on the implications of the casualty figures in the policy of human-rights arenas.

1302. Asylum Policy in the West: Past Trends, Future Possibilities

Abstract:
This article examines the policy responses of Western countries in the realm of asylum. We begin by explaining the reasons why the asylum issue has made its way up the political agendas of liberal democratic countries in recent years. While applications for asylum have risen in the last two decades, we also highlight the way rights-based constraints and financial costs have contributed to controversy around the issue. We then examine in detail the major policy responses of states to asylum, grouping them into four main categories: measures aiming to prevent access to state territory, measures to deter arrivals, measures to limit stay, and measures to manage arrival. Moving then to explore the efficacy of these measures, we consider the utility of policy making from the viewpoints of states, asylum seekers and refugees, and international society. The article concludes with the presentation of four new directions in which policies could move in order better to square the professed interests of Western states with the needs of refugees for protection.

This paper describes and analyses the case of Iraqis who, in the 1990s, have arrived in Jordan as forced migrants, and have continued to Western Europe or Australia as asylum migrants. The argument put forth is that trends of asylum migration cannot be fully understood without looking at a set of interrelated issues in the countries of first reception of the forced migrants: reception standards, the migrants' poor socioeconomic conditions, further violations of their human rights, but also the functioning of the migrants' social networks and of human smuggling rings.

Abstract:
Many of the Chechens who have disappeared in “zachistki” security sweeps are still alive in Russian captivity, in the view of human rights activist Kheda Saratova. The head of the Vozvrashchenie (“Return”) foundation told correspondent Aleksandr Kolesnichenko of Novye izvestia that the organization has assembled more than a thousand individual case files. Vozvrashchenie was created only a month ago in Grozny, for the purpose of finding as many of the kidnapped as possible.

The success or failure of Iraq's post-war transition will chiefly depend on whether domestic realities and dynamics are accurately understood and can be translated into a form of governance that is accepted as legitimate by core Iraqi constituencies. Ultimately, the international community's task will be to navigate competing claims to power and influence, ensuring a level playing field and not anointing any pretender until a process can be constructed to give voice to the mass of Iraqis who have been disenfranchised by three decades of authoritarian Baathist rule.

Abstract:
Georgia's political crisis, which climaxed in the forced resignation of President Eduard Shevardnadze on 23 November 2003, is not over yet and could still lead to violence and the country's disintegration. Georgia, in other words, is still pre-conflict, not post- conflict, and exceptional international action is required to contain the potential for chaos. Washington, which quietly supported what U.S. media called the “Rose Revolution”, has promised aid for organisation of the presidential election on 4 January 2004, as has the European Union; other donors should follow suit, and the international community should maintain this support through the equally important and potentially more contentious legislative elections in the spring.

In Peru, a country with an astonishing variety of different ecological areas, with 84 different climate zones and landscapes, with rainforests, high mountain ranges and dry deserts, the geographical context may not be all that matters, but it could be very significant in explaining regional variations in income and poverty. The major question this paper tries to answer is: what role do geographic variables, both natural and man-made, play in explaining per capita expenditure differentials across regions within Peru? How have these influences changed over time, through what channels have they been transmitted, and has access to private and public assets compensated for the effects of an adverse geography?

Abstract:
One of the most daunting tasks faced by a society left in ruin after a period of mass atrocity is the rebuilding of that society. In transitional societies, the outward signs of poverty and destitution often mask the importance of rebuilding those structural social institutions that form the basis of any stable society. Often, scarce resources are allocated to the repair of the physical infrastructure in its many forms, rather than to the repair of the social infrastructure of that same community. Roads and schools, for example, are given priority over issues of justice and security. Reckoning with past injustices, however, is an important step in the process of acknowledgement and forgiveness, leading to the rebuilding of a viable democracy, a restructured judicial system, and strengthened networks of civic engagement, all of which may lead, ultimately, to increased levels of social trust. And these are particularly important in overcoming the causes of conflict within divided transitional societies.

1309. Making EU Trade Agreements Work: The Role of Rules of Origin

Abstract:
A key element of the EU's free trade and preferential trade agreements is the extent to which they deliver improved market access and so contribute to the EUs foreign policy objectives towards developing countries and neighbouring countries in Europe, including the countries of the Balkans. Previous preferential trade schemes have been ineffective in delivering improved access to the EU market. The main reason for this is probably the very restrictive rules of origin that the EU imposes, coupled with the costs of proving consistency with these rules. If the EU wants the 'Everything but Arms' agreement and free trade agreements with countries in the Balkans to generate substantial improvements in access to the EU market for products from these countries then it will have to reconsider the current rules of origin and implement less restrictive rules backed upon by a careful safeguards policy.

Abstract:
Achieving an integrated Europe involves political and social unity as much as economic integration. Thus, the issue of European citizenship is central to the debate about European integration. Union citizenship needs to be distinguished from national citizen ship. Every citizen of the Union enjoys a first circle of nationality rights within a member state and a second circle of new rights enjoyed in any member state of the EU. The presence of immigrants in Europe also raises wider questions for government policy in the field of citizenship. There are various issues that arise in the European context with respect to the boundaries of citizenship. One of the main questions in this regard is the extent to which the division between European Union citizens and third country nationals will continue to prevail.
