31. Controlling Agency Choke Points: Presidents and Turnover in the Senior Executive Service

Abstract:
If presidents wish to see their policy priorities implemented, they need control over career executives occupying key decision-making positions. This paper examines the extent to which new presidential administrations marginalize high level career executives and whether political conflict with a new administration drives executives from their positions. Once in office, presidents are more likely to target individuals with whom they conflict and those in important policymaking positions. Turnover is also affected by the choices of career executives. Some anticipate conflict and strategically exit before a new president takes office. To assess our theory, we use unique new data that combines individual survey responses with personnel records to analyze the probability that an agency executive departs her position from March 2015 to July 2017. Given our findings that turnover is driven both by presidential marginalization and strategic exit by bureaucrats, we conclude with implications for presidential efforts to control the bureaucracy.

Abstract:
The United Kingdom and Spain have many things in common. Both countries are former empires, constitutional monarchies and parliamentarydemocracies;of�iciallytheyare unitary states, however, devolution in the UK and the model of autonomous communities in Spain make them “federations without federalism”. Furthermore, they are both plurinational, in the sense that Britishness and Spanishness serve as overarching identities for the stateless nations of the English, Scots and Welsh within the UK, and the Castilians, Catalans, Basques and others within Spain (although, one could argue that the English and the Castilians are the real “owners” of the two countries). In the past, London as well as Madrid fought minority nationalisms with violence, triggering terrorist attacks by armed separatist and secessionist groups like the IRA and ETA. More recently, the central governments of the UK and Spain have been faced with peaceful and democratic independence movements in Scotland and Catalonia, to which they responded quite differently. While London allowed the Scottish independence referendum of September 2014, and promised to honor its result, Madrid remains adamantly opposed to a similar plebiscite in Catalonia, and vows to disrupt it with all legal means at its disposal (which, ultimately, includes the use of force). The differing approaches of British and Spanish governments to secessionism within their borders are mirrored in their foreign policies: the UK recognized the Serbian breakaway province of Kosovo as a sovereign and independent state, while Spain (along with four other EU members) refuses to do so.

Abstract:
Since the current U.S. administration announced its intention to withdraw from the Paris Agreement, state, local, and private-sector leaders across the United States have created a landscape of climate initiatives and alliances to demonstrate that the country remains largely committed to the global fight against climate change. To date, the U.S. nonfederal climate movement has focused on pledges to reduce domestic greenhouse gas emissions in an effort to support the Paris Agreement. Given that the movement represents a significant percentage of the U.S. economy and population, these pledges have provided international assurance that the second-largest emitter will continue its pivot toward clean energy—even as the White House pursues an anti-climate agenda. Political leaders in the five countries of the East African Community (EAC) – Kenya, Tanzania, Uganda, Rwanda, and Burundi – have made concerted efforts to promote the benefits of an East African Federation (EAF). The signing of regional integration treaties is covered extensively in national and regional media. Yet many citizens in the two largest member states are not convinced that integration will lead to promised benefits for their countries. In Afrobarometer public-opinion surveys in 2011-2012, citizens of Kenya and Tanzania were asked about the likely impact of an integrated EAF on the availability of jobs, managing conflict, controlling corruption, strengthening democracy, and controlling prices. On none of these five issues did a majority of Tanzanians say that an EAF would have a positive impact, and on only two issues – availability of jobs and controlling prices – did a majority of Kenyans expect improvement through an EAF.

National integration has remained an evolving pursue in all the post-colonial divided societies. Although various approaches and strategies of national integration have been opted , but the situation remained complex. The state of Pakistan is also facing problems in the creation of national integration. These problems are due to conflicting socio-political fibre of Pakistani Society which was not handled properly. The diverse fibre of Pakistani Society was based on its ethnic composition. The state adopted an authoritarian policy to expand and consolidate its power and position. While responding authoritarian policy, ethnic groups provoked ethnic politics and started movements for the preservation of their identity. With due course of time, these ethnic movements become a challenge to the national integration. The study has its focus on various approaches to national integration. The research has also highlighted that although federalism is the best suited system for plural societies but effective working of federal institutions is required. For the creation of national integration, assimilationist strategy should be avoided and a pluralistic approach must be incorporated. Central government’s role as facilitator can diffuse the tension and brighten the process of national integration.

37. TACIT AMENDMENTS

Abstract:
As a general rule, the President is “‘without authority, except by and with the advice and consent of the Senate, to modify a treaty provision.’”2 Thus, in amending a treaty, parties effectively sign and ratify a new treaty, to which the standard treaty processes apply. However, numerous treaties have established procedures for modifications to the regime that do not rise to the level of formal amendments to the treaty. This report focuses on such “unratified treaty amendments”—which include what are called “tacit amendments.” Unratified amendments are amendments to treaties that are made without formal Senate ratification.3 They have proven a useful tool in creating robust treaty regimes in a changing world. Just as the use of executive agreements in general has expanded rapidly in the past century,4 treaty regimes increasingly have adopted amendment processes that do not require a full ratification process. And just as executive agreements have raised questions about Senate prerogatives, so too have unratified amendments. There are two primary ways that the U.S. government modifies underlying treaties through an unratified amendment5 —first, through the use of executive agreements; and, second, through the use of tacit amendments. Part I describes how each process works. It argues that both pass constitutional muster so long as the Senate has provided its clear advice and consent to the use of such processes (although not necessarily to the substance of the modifications) in the first instance. Part II outlines and evaluates the various ways in which the Senate has responded to attempts to modify treaties by executive agreement or by tacit amendment in the past. It concludes that the Senate’s requirements of prior notice and its focus on technical provisions, while not always easy to achieve in practice, are sensible ways to maintain Senate prerogatives.
