Blockchain technology can autonomously perform transactions across various industries and sectors without human involvement, revolutionizing how people do business. These transactions are performed through smart contracts, which consist of coded commands on the blockchain. This paper looks at how to enforce these autonomous agreements using blockchain online terms of use, focusing on common law jurisdictions, specifically Canada. Some of the advantages of buying and selling on the blockchain include reduced business-to-business transaction costs, automated business-to-consumer transactions and the ability to perform traditional services in new ways.

The People’s Republic of China (PRC) presents the United States with its most comprehensive economic and security rival since Great Britain during the nineteenth century. Starting in 2018, US defense strategies have highlighted the threat that the PRC poses to US allies, and successive presidential administrations and Congresses responded by increasing defense budgets to expand US military capability and capacity. Despite these efforts, numerous assessments now show that modernization of the People’s Liberation Army (PLA) has eroded—and in some missions overcome—US military superiority. Absent large and politically fraught increases in defense spending, continued expansion and improvement of today’s US force are unlikely to regain broad overmatch against the PLA in the Western Pacific. Instead, the United States will need new strategies and operational concepts to deter PRC aggression. Recognizing this imperative, the 2022 US National Defense Strategy (NDS) attempted to move in a different direction from its predecessors through two new lines of effort called “campaigning” and “integrated deterrence.” However, in unclassified documents and speeches by defense officials, both the essence of integrated deterrence and the mechanism of campaigning remain unclear. 1 Emerging technologies offer the US military a way to put these new concepts into action, sustaining its ability to prevent conflict and gaining an upper hand in the strategic competition with China despite the PLA’s “home team” advantages. The United States remains the world leader in operational and technological innovation, as evidenced by decades of advancements in networking and computing—marked recently by the rapid commercialization of artificial intelligence (AI). Building on the 2022 NDS, this report proposes a strategy for campaigning that would exploit information technologies to dissuade China from pursuing acts of aggression against allies such as Taiwan. The primary objective of the proposed campaigning model is to shape PRC government decision-making, especially that of the PRC military, in ways that are conducive to long-term regional stability and prosperity. A whole-of-government effort like that implied by the 2022 NDS would be the most effective form of campaigning because it could exploit the PRC government’s numerous vulnerabilities, from its appalling record on human rights to its loss of economic momentum and its growing demographic challenges. However, this report focuses on actions the US military can take by itself or with allied militaries to dissuade future PRC aggression. In the proposed approach, campaigning is an ongoing sequence of probing, signaling, adapting, and acting by the US military and intelligence community, coupled with and informed by instrumentation of the information environment. In addition to demonstrating US resolve, campaigning should enable the US to estimate competitor habits, preferences, and fears. These estimates would guide future campaigning activities and inform US force planners regarding a competitor’s uncertainty and areas of concern. Armed with increasing insight about adversary beliefs, campaigning actions would aim to shape an opponent’s preferences and priorities away from violent paths to their goals and toward scenarios that are more aligned with US interests. In offering an approach to dissuasion, this report diverges from the strategy of deterring war primarily through threats of denial or punishment. This construct has dominated US defense strategy since the Soviet Union collapsed because conventional dominance enabled the US military to credibly stop or reverse an act of aggression and nuclear weapons provided the capability to impose existential punishment. Today, the PRC’s status as a peer competitor makes denial and punishment less credible. The US government will instead need to prevent conflict before it becomes imminent.

13. Unalone and Unafraid: A Plan for Integrating Uncrewed and Other Emerging Technologies into US Military Forces

During the Cold War, the United States Department of Defense (DoD) led global research and development (R&D) and in the process created what are now commonplace technologies, including the internet, precision weapons, and the global positioning system. However, since then the DoD has struggled to incorporate new advancements as initiatives to transform the force or implement a new offset strategy have failed to substantially change the US military’s design or capability development processes. In large part, the DoD’s adoption difficulties result from the center of technological innovation shifting from governments to the private sector, increasingly making the military a technology customer rather than a creator. This is the case with artificial intelligence (AI) and uncrewed systems, which are already upending long-standing approaches to modern warfare. The challenge of integrating these new technologies, many of which are commercially derived, therefore provides a good case study for how the DoD could reform its processes and organizations for innovation. To that end, this study evaluates how the US military could realize more timely development, deployment, and integration of relevant uncrewed systems, and illustrates its proposed methods using examples from the US Navy. The Navy and DoD will need the operational advantages that AI-enabled uncrewed vehicles could offer. Against a resident major power like the People’s Republic of China (PRC), the US military cannot continue to rely on its historical dominance to deter and defeat aggression. Instead, the DoD will need to attack the People’s Liberation Army (PLA) strategy of system destruction warfare by fielding a force that is less predictable, more adaptable, and increasingly resilient. Uncrewed systems could enable such an approach by unlocking the operational innovation of US servicemembers, who could—like their counterparts in Ukraine today—use uncrewed systems to grow the variety of tactics and effects chains that they can employ, which could undermine PLA planning and concepts and afford US forces the capacity to sustain a protracted conflict. The ability of uncrewed systems to provide resilience and adaptability depends on scale. A small fleet of vehicles cannot be simultaneously applied against multiple mission threads or effects chains and will lack the capacity to support extended operations. Uncrewed systems can enable scale by foregoing robust self-defense and focusing on a narrow set of functions to lower their cost and complexity. These limitations will require that uncrewed systems be combined with other uncrewed systems and crewed platforms in systems of systems (SoS), which could exacerbate the US military’s long-standing struggles to integrate forces between and within each service branch. Realizing the benefits of uncrewed systems will therefore demand that the DoD establish routinized processes for integrating new mission threads and SoS. Otherwise, the US military services will only be able to field individual uncrewed systems that replace crewed platforms in existing use cases. US military services are already attempting to improve their ability to integrate SoS through initiatives in experimentation, rapid acquisition, digital interoperability, and Joint All-Domain Command and Control (JADC2). However, as this report describes for the US Navy, these efforts tend to focus on long-term service objectives rather than near-term operational problems and use a top-down process of systems engineering to guide requirements for future capabilities. This traditional approach assumes that the US military has the time to develop new systems and retains a substantial technological edge over its rivals, but neither condition is likely to endure in the context of the US-PRC competition. To bring uncrewed systems into the force more quickly and gain the resulting operational advantages, the DoD will need to flip its traditional acquisition approach and adapt US military tactics or mission threads so they can integrate uncrewed systems that are available today. This bottom-up method of “mission integration” contrasts with the DoD’s predominant approach of systems engineering and reflects best practices emerging in commercial manufacturing or distribution, where the fastest and most effective way to assimilate robotics is to adjust the organization’s workflow as opposed to developing robots that replace humans in existing workflows.

14. Canada Needs Its “New Approach” to Streamline Digital Rulemaking

Abstract:
Canada’s current approach to rulemaking is not keeping pace with the deployment of new digital technologies. This paper proposes to modernize the Statutory Instruments Act to bridge that gap, suggesting that mandatory standards, technical specifications and conformity assessment programs should be recognized as statutory instruments alongside regulations. This borrows from the European Union’s “New Approach” established in 1985, whereby regulators can request that EU standards bodies develop mandatory standards as a compliance mechanism to laws, even while legislation is being drafted. Streamlining rulemaking is essential to help manage the harms associated with digital technologies as soon as possible after they are commercialized.

When a device controlled by artificial intelligence (AI) is involved in an accident causing bodily harm, who is at fault? The manufacturer, software developer or the user? With so many people involved in the design and production of AI-controlled technology (known as the “problem of many hands”), liability can be difficult to attribute, leaving victims and their families without recourse. As AI becomes increasingly entrenched in our daily lives, mishaps will become more common. This policy brief looks at the challenges in determining who is at fault when AI goes awry and how to address the liability gap.

Abstract:
Artificial intelligence (AI) technology has been found to generate value for many firms; however, it also has unintended and undesirable consequences. The reality of AI-related risk has led to the development of AI governance frameworks and calls for greater oversight of the use of AI. The merits of an ESG (environmental, social, governance)-based approach to oversight of AI-related risk are considered in this paper, with a focus on the current trajectory of international sustainability standards development. Despite their differences, AI governance and ESG reporting both seek to address risk in the broadest sense, with proactive and transparent approaches to its management and mitigation. A preliminary set of recommendations for incorporating material AI-related risk into ESG reporting, covering both general or context-setting disclosures and industry-specific disclosures, is provided.

Abstract:
As the world grapples with rapid technological change that has the capacity to affect every aspect of human life, “responsible innovation” is key to ensuring that this transformation is shaped in a way that benefits society as a whole while minimizing risks. A joint effort by the Centre for International Governance Innovation and Project Liberty, this policy brief explores seven “verticals” that will guide this technological evolution (artificial intelligence, quantum technologies, neurotechnology, Web3, digital public infrastructure, extended reality and biocomputing) and four “horizontals” (macroeconomics, geopolitics, climate change and regulation) that will shape the medium-term impact of these verticals. Using responsible innovation in the development and application of these technologies can help mitigate their disruptive potential. This approach involves looking at how to reduce the possible negative consequences of an innovation while maximizing its benefits for everyone, and focusing attention on innovation aimed at our greatest shared challenges.

18. Australia’s north and space

Abstract:
This report examines opportunities for the development of sovereign space capability in the Northern Territory, Queensland, and Western Australia. Given that those northern jurisdictions are closer to the equator, there’s a natural focus in the report on the potential opportunities offered by sovereign space launch, particularly in the Northern Territory and Queensland. However, I also consider the potential for other aspects of space besides launch, including space domain awareness, the establishment of satellite ground stations, and space industry. I explore the potential for the co-location of space industry—domestic and international—within or close to launch sites, which would result in the development of ‘space hubs’ in strategic locations in Australia. Benefits are gained by situating space-launch sites as close to the equator as possible, and two sites—Nhulunbuy near Gove in the Northern Territory and Abbot Point near Bowen in Queensland—are now under development. The closer a launch site is to the equator, the greater the benefit in terms of reduced cost per kilogram of payload to orbit, due to velocity gained by a rocket from the Earth’s rotation. The report then explores the transformation of Australia’s space sector that’s occurred within the past decade, from one solely dependent on foreign-provided satellite services and locally developed ground-segment capabilities, including for space domain awareness, to the growth of sovereign space industry and the establishment of the Australian Space Agency in 2018. I note that, since the establishment of the agency, Australia’s commercial space sector has expanded rapidly, but now faces headwinds, with the recent cancellation of the National Space Mission for Earth Observation being a serious blow to Australia’s space industry. The Australian space industry sector must now fight to sustain funding. In this report, I argue that the best way to achieve success is to emphasise sovereign launch as a focus for Australian space activities and to reinforce the potential opportunities offered by the north, including for defence and national-security requirements in space.

19. Developing Australia’s critical minerals and rare earths: implementing the outcomes from the 2023 Darwin Dialogue

Critical minerals and rare earths are the building blocks for emerging and future technologies, inseparable from the supply chains of manufacturing, clean energy production, medical technology, semiconductors, and the defence and aerospace industries. Despite their criticality, their supply chains are exposed to numerous vulnerabilities – threatening the production and development of vital technologies. This report—based on closed-door, invitation-only discussions at ASPI’s new Darwin Dialogue, a track 1.5 meeting between Australia, Japan and the US—makes 24 recommendations for government and the private sector to support the development of viable, competitive alternative markets that offer products through supply chains secure from domestic policy disruptions and economic coercion. These recommendations are derived from analysis of the challenges embedded in critical minerals supply chains, including the inability for global production to meet projected demand, and dependency upon China and politically unstable nations as at times near singular sources of production. Australia’s natural endowments of critical minerals and rare earths provide a unique opportunity to achieve intersecting economic, environmental, and strategic objectives. But, as detailed in this report, effective coordination between Australia’s state, territory and federal governments, mining and industry, and international partners will be pivotal to developing this opportunity. Further still, achieving our critical minerals objectives will require a bold new policy approach from all stakeholders.

20. Australia's semiconductor manufacturing moonshot: securing semiconductor talent

Abstract:
Semiconductors are a critical component in all modern technologies, from personal communication devices and medical devices to weapons systems. Crucial to producing semiconductors is the availability of a highly skilled workforce, managing clean-room facilities and highly specialised equipment to execute the hundreds of unique steps needed to manufacture a single wafer, depending on the complexity of the chip. ASPI’s 2022 report, Australia’s semiconductor national moonshot, laid out the strategic reasons why Australia must embark on a capacity-building initiative to create a homegrown semiconductor manufacturing ecosystem. Every item on the Australian federal government’s List of Critical Technologies in the National Interest is dependent on semiconductors. By committing to growing a semiconductor-manufacturing industry from a mature-process-scale baseline, policymakers would position Australia to manufacture chips relevant to the energy, transport, health, IT and defence sectors. Such an industry would enable Australia to execute long-term critical technology strategies in areas such as quantum computing and artificial intelligence, to mitigate supply-chain risk against disruption from conflict or natural disaster, and provide highly skilled jobs in affordable locations, enriching the Australian economy. It’s important to note that both AUKUS Pillar 2 and the Albanese government’s April 2023 publication of the Defence Strategic Review reflect a shift in Australia’s strategic thinking on defence and national security, and the important correlation and greater cooperation between industry, education and defence priorities, particularly when it comes to technology. Delivering on that shift will be difficult and often costly, but this report provides a series of recommendations of what that correlation and cooperation could look like. For Canberra, such an endeavour is of the same magnitude as America’s historic ‘moonshots’ during the 1960s and 1970s. It’s a once-in-a-generation challenge that will determine Australia’s place in the world, and human capital is central to ensuring success. Opting out of semiconductor manufacturing for the long term would severely constrain Australia’s growth as a technological nation and consign it to second-tier status. This report expands on the recommendations made in the 2022 ASPI report for establishing a semiconductor-manufacturing capability in Australia and focuses on the importance of creating a talent pipeline that can support a scaled industry. Achieving a semiconductor moonshot requires stepping up Australia’s very respectable semiconductor device fabrication R&D to industry-compatible prototyping via a dedicated facility, together with attracting (through that capability and by government incentives) a semiconductor manufacturer to locate a mature-process-scale foundry in Australia—which will require support from an upskilled Australian talent pipeline. This is an ambitious move but is an essential step in growing such a capability. The ability to grow and maintain a high-skilled workforce is a foundational challenge for Australia that can be addressed through close examination of trailblazing public–private partnerships (PPPs) that aim to provide talent-pipeline security in the US, Taiwan and Japan. Australian governments, industry and academia can emulate and engage with the examples highlighted through case studies in this report to attract semiconductor industry investment, boost talent-pipeline development and strengthen industry R&D. Australia’s states and territories all have varied capacity to o›er support to a semiconductor-manufacturing capability.
