121. Canadian Dilemma: Is There a Path from Systemic Racism Toward Employment Equity for Indigenous People in the Canadian Forces?

Abstract:
Indigenous peoples continue to be oppressed by racial discrimination enacted through legislation, policies and practices of the Canadian state, including the Canadian Armed Forces (CAF). Systemic racism, practiced through institutionalized policies and customary behaviour affecting people working in organizations, results in inequality for some groups and privileges for others. Since 2002 the CAF has been covered by the federal Employment Equity Act whose purpose is to address systemic discrimination by requiring employers to remove and prevent systemic barriers to equality for Indigenous people, women and “visible minorities” and to maintain a workforce that reflects the diversity of the Canadian population. Aside from its legal obligation, it is in the interest of the CAF to recruit and retain Indigenous People because they are an essential part of Canada’s labour supply. However Indigenous members of the CAF comprise a small and marginalized minority within a rigid, bureaucratic and culturally foreign organization. Implementing the Employment Equity Act could assist the CAF to address the Canadian state’s promise of reconciliation, fairness and equality for Indigenous people. This chapter reviews available evidence bearing on the CAF’s employment equity record, which presents a pattern of resistance to the Act’s requirements and failure to progress toward a representative workforce. In the absence of effective action to implement change, the CAF has yet to find a path from systemic racism toward employment equity for Indigenous People.

Abstract:
This report is called Under Wraps because it shows that Malawi has a comparatively high LGBTI population that is known by a significant number of ordinary Malawians to be socially vulnerable – but this reality remains hidden in Malawi’s social consciousness. Despite strong social values and aspirations of equality, non-violence, and belonging in a community, the majority of Malawians restrict LGBTI people from being openly recognized and safely included in families, communities, workplaces, cultural practices, and public policies. However, a large number of Malawians are thinking differently about discrimination, even the majority in relation to recognition of intersex people and violence towards LGBTI people.

But 25 years after this resounding document was passed by the Constitutional Assembly, the lived realities of most LGBTI South Africans lag well behind the constitution’s ringing promises.

Abstract:
Although Native American Chicagoans play a central role in the social fabric of the city, relatively little attention has been directed to documenting the experiences of racial discrimination and inequities for Native American Chicagoans. In this report, we examine the state of racial justice for Native Americans in Chicago. Our report is organized across five substantive areas, Population, Housing, (Mis)Representations of American Indians in Popular Culture, Education, Economics, and Justice, each focusing on a different aspect of racial equity. In each section, we draw on available data to describe the current conditions and experiences of Native American Chicagoans, including areas where they are thriving and areas where they are negatively affected by the legacy of racial exclusion as well as ongoing discrimination.

Abstract:
Europe is experiencing at present intense dilemmas in regulating hate speech and online harassment. Free speech exercise can be offensive and even contribute to a climate of prejudice and discrimination against minorities. Often, the media exacerbate the tendency by reporting negatively about minorities. The first working paper on this topic engages with the normative dimensions of the balance between the need to control and limit incitement to violence in reconciliation with the fundamental right to freedom of expression. Three distinct aspects of hate speech are covered: the first relates to the role of freedom of expression as a tool of inclusiveness. With the limits of liberal tolerance being unclear, just like the definition of hate speech itself, legal actors and systems are torn between criminalising the speaker’s motive alone or in conjunction with the effects of the speech. A survey of recent related European Court of Human Rights case-law demonstrates these ambiguities. The second aspect covered looks at the challenges of the regulation of the freedom of expression in the digital age, with emphasis of the online dimensions of the phenomenon from a legal perspective. The final aspect of the paper proposes an actor-based analysis of hate speech, as it emerges from the current regulatory frameworks applied. This section deals not only with the role of the State but also with that of equality bodies, political parties and private businesses in providing more efficient networks of protection of minorities from such violent expressions of hatred.

Abstract:
Faced with a piecemeal approach to hate speech in Europe, leading to the reduced visibility of the phenomenon with often serious consequences, a variety of regional and international organisations have contributed legal documents and interpretative recommendations that attempt to guide states in their practice of combating hate speech. The present paper, following up on a previous one, will engage first with the international legal and regulatory framework of hate speech, placing emphasis on the European elements of the system in place. At a second stage, the paper will briefly survey twenty European national systems exposing the variety of regulatory patterns on the issue. Finally, the study will conclude with a list of common observations pertaining to the regulation of hate speech in the European continent, as they have emerged from the comparative analysis of the case-studies.

This study examines shifts in governmental religion policy and societal discrimination against religious minorities in Muslim-majority states after the Arab Uprisings by using the Religion and State round 3 (RAS3) dataset for the years 2009-2014 and by focusing on 49 Muslim-majority countries and territories. We build on threads of literature on religious pluralism in transitional societies to explain the changes in governmental religion policy and societal discrimination against religious minorities after the Arab Uprisings. This literature predicts a rise in all forms of discrimination in Arab Uprising states as compared to other Muslim-majority states, and an even more significant rise in societal religious discrimination since societal behavior can change more quickly than government policy, especially at times of transition. The results partially conform to these predictions. There was no significant difference in the shifts in governmental religion policy between Arab Uprising and other Muslim-majority states, but societal religious discrimination increased substantially in Arab Uprising states as compared to non-Arab Uprising states. Understanding the nature of religion policies and religious discrimination provides further opportunities to unveil the dynamics of regional politics as well as conflict prevention in the region.

128. The Citizenship Policies of the Baltic States within the EU Framework on Minority Rights

Abstract:
The ethnic landscape in the Baltic States is dominated by one large ethnic minority: Russians. Lithuania is an exception as here the first biggest ethnic minority are Poles, followed by Russians. The Baltic States have also significant Slavic minorities, such as Belarusians and Ukrainians. There are many barriers for people from different ethnic groups to overcome because the Baltic societies are segregated according to ethnicity across a number of dimensions: language, work and geography. During the Soviet period there were separate language schools, a system that reinforced ethnic separation. Labor market was also split along ethnic lines and a large proportion of ethnic minorities lived spatially segregated from the majority group and was concentrated mostly in urban centers. The impact of communist heritage and the construction of the post-communist state order had a negative impact on the integration process of the Russian minorities in those countries. The ethnic Russians had been heavily marginalized as many of them had no citizenship at all. As a result, they had limited access to labor-market and less social protection. However, the accession of the Baltic States to the European Union (EU) has succeeded in significantly changing policies with respect for and protection of minorities in the three Baltic countries. In the last years the ethnic Russians have in fact been partially accommodated through the consistency of the citizenship laws with the European Union norms, which precisely require the protection of minorities and respect for them. The aim of the study described herein is to investigate the historic roots of ethnic segregation between the native Baltic population and the Russian minority and show how the entry of the Baltic States into the EU has facilitated the process of promoting minority rights, especially from the perspective of granting citizenship right to Russian (and Polish) ethnic persons living in those countries.

The recent leak of secret Chinese Communist Party (CCP) documents in Xinjiang provides irrefutable evidence of the CCP’s radical plan to fundamentally remake Xinjiang society and transform the thoughts and behaviour of its Muslim minorities (ICIJ, 24 November). Less well known, however, is the role that Xi and his supporters have played in reorienting People’s Republic of China (PRC) policy away from a previous tolerance of ethnocultural heterogeneity, and towards a virulent form of cultural nationalism that pathologizes dissent and diversity as an existential threat to the Party and the nation. The self-described “New Era” (新时代, Xin Shidai) of Xi Jinping Thought marks a decisive departure from previous attempts to propitiate ethnic minorities through special preferences and a “loose reins” (羁縻, jimi) system of ethnic autonomy. This new orientation is most clearly articulated in a public speech Xi Jinping gave in September, suggesting a new level of confidence in the Party’s attempt to build a “spiritual homeland” (精神家园, jingshen jiayuan) for China’s fragile political unity in the face of deep internal resistance in the peripheries of Xinjiang, Tibet, and Hong Kong.
