Abstract:
The UK constitution and system of governance have recently been subjected to unprecedented strain. Brexit and Covid-19, in conjunction with the governing style adopted by the Johnson administration, have raised profound questions as to whether the norms and conventions that form the basis of the UK’s uncodified constitution are still fit for purpose. These are the issues that are brought together in this report, in which 41 leading scholars assess the impacts of Brexit, Covid-19 and the Johnson government on our constitution and system of governance. They discuss whether these arrangements, that have evolved over decades if not centuries, are sufficiently robust and fit for the purpose of governing a diverse and complex UK.

Abstract:
The UK government introduced a piece of primary legislation, the Northern Ireland Protocol Bill, in response to concerns over the Protocol on Ireland/Northern Ireland. This report explains some of the context to the Bill, the conditions in which it has emerged and its potential ramifications for Northern Ireland, the UK, the EU, and UK-EU relations. It also considers a number of ways in which the stand-off over the Protocol might be resolved. The report brings together the insights of several experts: Catherine Barnard (University of Cambridge, and UKICE), Joelle Grogan (UKICE), Katy Hayward (Queen’s University Belfast), Andrew McCormick (formerly lead official on Brexit for the Northern Ireland Executive) and Jill Rutter (UKICE).

Bölünmüş toplumlarda anayasa yapım süreçleri, demokratik anayasa bakımından çok daha büyük önem taşır. Anayasal düzenlemeler ve tercihler kadar anayasa yapım yöntemleri de demokratik anayasa açısından belirleyicidirler. Demokratik anayasa yapımı süreçleri, toplumun bütün kesimlerinin katılımına açık olarak yürütülür. Katılımcı anayasa yapım örneklerinden en orijinal ve en çarpıcı olanı, Güney Afrika Anayasası inşa sürecidir. Bu süreç, ayrımcı Apartheid rejiminden demokrasiye geçişi sağladı. Kurucu Meclis, Anayasa inşa sürecini güvenilir kılmak amacıyla, şeffaflık ve katılımcılık ilkelerini sürece hâkim kılmaya çalıştı. Güney Afrika anayasa yapım süreci, başarılı bir demokratikleşme örneğidir. Güney Afrika deneyimi, çatışma çözümünde anayasa yapım yönteminin ne denli belirleyici olduğunu göstermesi bakımından da önemlidir.

Tunisian President Kais Saied, on June 20, received a new draft constitution written by Sadok Belaid, Coordinator of the High National Advisory Committee for New Republic. The draft was not final as some chapters were reviewed and amended before it was published in the official gazette on June 30. The draft new constitution will be put to a referendum on July 25.

Abstract:
National dialogues bring all major political stakeholders, decision-makers, and interest groups together following serious conflicts. In response to political differences that emerged from the 2016 general elections, Zambia enacted a National Dialogue (Constitution, Electoral Process, Public Order and Political parties) Act, 2019, which provided for holding a national dialogue forum (NDF). However, this trajectory has been turbulent and the outcome fiercely contested. This article is an appraisal shedding light on Zambia’s strides in hosting a post-2016 general elections national political dialogue process and an attempt to answer three critical questions. First, how can national political dialogue be best organised to build social cohesion? Second, what has been the Zambian experience with national dialogue, with particular reference to the 2019 NDF? Last, what lessons can be learned for future national dialogues in the country? The article offers some perspectives on how national dialogue can support the broader society to cohere. It also advances descriptive lessons for the future to vouch for an all-inclusive national dialogue process.

The footage is grainy. The cacophony of noise pours from the idling helicopters and the columns of police cars, motorcycles, and armored personnel carriers with their engines and blaring sirens. But the scenes are remarkable all the same. They show the city of Banja Luka, the second largest metropolitan area in Bosnia and Herzegovina (BiH), on May 12, 1992. They depict a city under occupation by a regime in the process of orchestrating the first genocide in Europe since the Holocaust.

Abstract:
Although the country currently lacks the unity and rule of law needed to safely pursue a process as fraught as amending the constitution, there are several alternatives that could get it on the path to systemic reform. Spurred by dysfunctional governance and political gridlock, Iraqis have increasingly been calling to amend the country’s constitution, with many arguing that the post-Saddam sectarian system failed to engender stability or prosperity and has therefore run its course. Even among more-hopeful observers, the democratic norms and minority rights put forth in the constitution remain aspirational at best. Accordingly, some political leaders are publicly signaling that they will heed such calls. Yet attempting to amend the constitution in the current political circumstances is not viable. Apart from the existing charter’s problematic technical deficiencies, Iraq remains mired in a profound lack of constitutionalism and respect for rule of law.
