Let’s take stock of the American experience within the global history of colonialism – specifically by examining the intertwined relationship in U.S. constitutional practice between internal accounts of freedom and external projects of power and expansion. This episode reinterprets American political traditions from the colonial period to modern times by placing race, immigration, and national security in the context of shifting notions of empire and citizenship. Abstract:
The article notes that the motion of no confidence in the Prime Minister (PM) in Lesotho is provided for in the Constitution, but different political leaders have abused it on several occasions for various party political and subjective reasons. This article, therefore, explores the abuse of this provision, its triggers, and how they have impacted the political stability and socioeconomic situation in the country. Lesotho is a constitutional democracy governed by a constitution adopted in 1993. One of the provisions of this Constitution is Section 87,1 which deals with a ‘motion of no confidence’. Constitutionally, the government must, at all times, enjoy the confidence of the National Assembly, and Section 87(2) of the Constitution embodies the principle that: The King shall appoint as Prime Minister the member of the National Assembly who appears to the Council of State to be the leader of the political party or coalition of political parties that will command the support of a majority of the members of the National Assembly.2 Similarly, the Constitution gives Parliament the power to withdraw confidence from the government of the day. The passing of the motion of no confidence requires a simple majority, and any member of Parliament can propose it.3 The only precondition for a motion of no confidence in government is the name of a member of the National Assembly for the King to appoint in place of the PM.4

Abstract:
The rule of law is one of the most important, if not the most important, constitutional principles. It has been a philosophical concept since the time of the Greek philosophers or even before. For the English jurists, the rule of law encompasses two central principles, which are the supremacy of law and equality before law. However, the British showed no concern for upholding it during the era of colonization. In Pakistan, the principles of supremacy of law and equality before law were incorporated into the Constitution. The Pakistani Superior Courts have widened the scope of these two principles in their decisions. However, in reality, such principles as enunciated by the Judiciary are not actually implemented in true letter and spirit.

As the Election Commission of Pakistan (ECP) delayed a key provincial election due to financial and security-related issues, a potential constitutional crisis looms over the country. In light of the deepening political turmoil in Pakistan, Ahmed Bilal Mehboob explores how this crisis has developed and offers a grim outlook of holding a free and fair election this year. Mehboob argues that the former Prime Minister Imran Khan’s audacious move to seek fresh elections to both the National and Provincial Assemblies have exacerbated party polarization, and Supreme Court decisions for the court cases are unlikely to be fully enforced due to such divide. Mehboob warns that prolonged political crisis may induce military intervention to restore order so that the elections could be pushed ahead.

Abstract:
Last week, CIC released a major new joint report with Chatham House on aid to “politically-estranged” settings – countries where donor relations with national authorities are frayed or broken because of unconstitutional changes in government, internationally contested elections, and major sanctions. Development aid to these countries has been suspended or severely curtailed, often because of domestic pressures to disengage, leaving the problem to traditional humanitarian approaches. In this report, CIC and Chatham House argue that development engagement is needed, and outline the ways to do so without legitimizing unconstitutional regimes, in concertation with regional actors. This piece focuses on two major areas: Why should donors care in this current moment? What has been new in our thinking about the major challenges and solutions for how to work in these contexts?

The European Parliament, for the first time, has used its powers to trigger a revision of the EU treaties. Its central demand is to change the decision-making procedure behind the passerelle clause from unanimity to qualified majority voting. However, the EU Council has so far refused to submit Parliament’s request to the European Council — in breach of its treaty obligations. At the same time, MEPs continue to develop wider reform proposals to make the government of the EU more robust, decisive, and democratic. With the European Parliamentary elections taking place next year, now is a good time for parliamentarians to take stock of their own performance, review their place in the governing system of the Union, and, other things being equal, prepare for future reform. In this Discussion Paper, Andrew Duff explains that, in an ideal world, more could be achieved under the existing treaties, and the EU could avoid the always complex, often unpopular, and usually protracted task of revising them. With another treaty change on the cards, the Paper analyses the current state of affairs and suggests that the heads of government need the assistance of a reflection group to prepare for a new Convention.
