Abstract:
The analysis reflects the current state from the viewpoint of legal solutions, but also from the viewpoint of real problems seen in practice, which come in part as the result of inconsistent and insufficiently precise legal provisions. Thus, a special emphasis was put on the provisions that do not fully serve the reform priorities and the segments that do not correspond to international documents and the practice of European courts. The analysis offers alternative solutions and concrete recommendations to overcome the evident weaknesses in some of the existing legal provisions. This is especially true for several segments underlined in the text (provisions on interception of communications without the mediation of OTA; provisions on metadata; certain aspect in the interception of communications in the interest of security and defense; security of data; as well as the provisions on oversight and control over the interception of communications). The structure of the document is comprised of an introduction, approach to the reforms, analysis of the legal framework, opportunities and challenges, and conclusions.

Abstract:
Tertiary prevention of (violent) Islamist extremism includes measures designed to encourage and support (violent) extremists in prison and in liberty in their efforts to leave their milieus, deradicalize, decriminalize, and reintegrate into society. Actors in tertiary prevention thus intervene in a multitude of contexts and work with various stakeholders. The growing understanding of the complexity of radicalization and deradicalization processes as well as practical experiences leave no doubt that multi-agency cooperation and communication is crucial to be able to reach most potential clients. However, one of the main challenges of professionals working in tertiary prevention is to identify potential points of contact, set up effective frameworks for sharing information, and establish long term relationships.

Abstract:
The competitiveness of industries and countries is shaped more and more by technological advancement in the production and use of information and communications technology (ICT). This report considers the supply side of ICT goods and services. It studies the drivers of ICT production location and trade across countries with a focus on the relative position of the EU. The analyses clearly indicate that the EU must step up its efforts to accelerate the shift towards digital production and strengthening the ICT sector that produces the required technologies and services. In addition, from a trade policy perspective, a harmonised set of standards and regulatory framework is to be aimed at to minimise mismatches in technical specifications and requirements. This will lead to the diffusion of positive externalities and should allow for a smooth operation of the global value chains in these products.

64. Impact of Technical Barriers to Trade on the Trade in Goods in the Information and Communications Technology Sector: Differentiating by Aim of the Regulatory Measure

Abstract:
In this modern digital world, goods from the information and communications technology (ICT) sector are the engine of the global economy. While tariffs levied on ICT goods have been eliminated or significantly reduced since the conclusion in December 1996 of the Information Technology Agreement of the World Trade Organization (WTO), non-tariff measure (NTMs) have come to be used more frequently with regard to imports of these goods. Technical barriers to trade (TBTs), as the most important trade policy measure imposed on imports of ICT goods, form the focus of this study. This paper analyses how different types of TBTs imposed on imports of ICT goods globally affected the values and volumes of imported goods at the six-digit level of the Harmonised System (HS) during the period 1996-2018. Keywords cited in the TBTs notified to the WTO give an indication of the aims behind the imposition of TBTs. Therefore, this study digs deeper into the impact of 30 types of TBT, using the keywords cited. The methodology used in this paper controls for zero trade flows using the Pseudo Poisson Maximum Likelihood (PPML) technique; and it controls for endogeneity bias using the exogenous instrumental variable approach. Furthermore, the paper provides more detailed analysis of the impact of TBTs across five ICT product categories that are defined by the United Nations Conference on Trade and Development (UNCTAD). The results indicate that TBTs have a generally strong positive impact on the value of imports of ICT goods. While many keywords cited in TBTs notified to the WTO affect the values and volumes of imports in a positive way, certain other TBTs function as trade barriers that reduce their values and volumes.

Abstract:
China established Sansha City in 2012 to administer the bulk of its territorial and maritime claims in the South China Sea. Sansha is headquartered on Woody Island. The city’s jurisdiction includes the Paracel Islands, Zhongsha Islands, and Spratly Islands and most of the waters within China’s “ninedash line.” Sansha is responsible for exercising administrative control, implementing military-civil fusion, and carrying out the day-to-day work of rights defense, stability maintenance, environmental protection, and resource development. Since 2012, each level of the Chinese party-state system has worked to develop Sansha, improving the city’s physical infrastructure and transportation, communications, corporate ecosystem, party-state institutions, and rights defense system. In effect, the city’s development has produced a system of normalized administrative control. This system ultimately allows China to govern contested areas of the South China Sea as if they were Chinese territory.

66. Digital Entanglement; Lessons Learned from China’s Growing Digital Footprint in South Korea

Abstract:
The South Korean experience is an illustrative case study of digital entanglement with China. This paper focuses on South Korea’s 5G networks for the purposes of scoping, but the spotlight on telecommunications networks offers just one window into a broader trend of technology and economic interdependencies between Seoul and Beijing. In particular, the paper’s focus on 5G illuminates four central observations that could also apply to other technology areas: (1) the U.S.-China strategic competition has wedged South Korea between its most important ally and its largest trading partner; (2) geopolitical risk assessments are not top of mind in South Korea’s technology policymaking calculations; (3) the country’s political leadership largely defers to private industry on the use of Chinese equipment; and (4) South Korean privacy regulations remain relatively fluid and are evolving both to meet domestic pressures and to generate new market opportunities. These trends are evident in the history of South Korea’s economic entanglement with China and the risk of coercion carried with it. Ongoing entanglement with digital infrastructure—and 5G networks in particular—increases the potential for and reach of adverse economic statecraft by Beijing and will make it more difficult and costly to unravel.

Communication networks are the central nervous system of the 21st century economy. The fifth generation of wireless—5G—will be essential to and inseparable from all we do. In many ways, we are already there. What for most was an abstract concept became all too real during the COVID-19 crisis. The coronavirus pandemic has underscored the critical importance of communication networks: They are integral to our daily lives and our ability to function economically and as a society. Shutdowns of offices, schools, and stores have meant turning to apps to work, learn, and buy. Frontline medical workers and vaccine researchers have consulted colleagues via teleconference to get the latest insight and advice on combating the virus. Being connected means resilience, coping, surviving. Getting 5G right is all the more urgent. Next-generation 5G networks will enable telemedicine, self-driving cars, and a proliferation of Internet of Things devices to fuel the future digital economy. Secure, reliable 5G networks will be essential elements of national infrastructure. Policymakers in Australia, Japan, and Vietnam understood this early on and took decisive action to secure their 5G networks. U.S. officials, slower out of the gates, are now the loudest voice on the risks of having equipment from untrusted vendors in 5G networks. The spotlight is brightest on the risks that Huawei poses to national security, including the threat of espionage or disruption. Given the Chinese Communist Party’s ability to exercise control over Huawei, there is justifiable concern over data integrity on networks that deploy Huawei equipment. More serious is the potential to use 5G equipment as a vector to cripple critical infrastructure. Such risk is not only about communications—5G will be the backbone of controls needed for power grids, water supplies, and transportation infrastructure. Despite this, the United States has had only limited success convincing its allies to join it in banning Huawei. The United States has the opportunity to regain momentum by taking a fresh approach to 5G in the aftermath of the pandemic. In addition to the broader appreciation for the criticality of reliable communication networks, Beijing’s coronavirus cover-up and clunky attempts at soft power have hardened public opinion toward China around the world. The economic fallout of the pandemic will likely slow 5G deployments globally, curtailing the urgency with which many operators approached the issue. At the same time, the first commercial projects centered on technological alternatives to the predominant 5G approach are being deployed. This confluence of events presents the United States and like-minded countries an opening to promote an alternative approach that could lead to a paradigm shift in the industry: wireless infrastructure built on a modular architecture with open interfaces. A modular architecture allows an operator to choose multiple vendors for a range of offerings, rather than being locked in with a single large integrated vendor. Open interfaces—the ability of equipment from any vendor to work with that of another—make that possible. Such a shift means upending the industry status quo that is dominated by four telecommunications equipment providers: China’s Huawei, Finland’s Nokia, Sweden’s Ericsson, and South Korea’s Samsung. Whereas other proposed responses to the Huawei dilemma and the problematic current state of competition in the telecommunications industry fiddle at the margins, switching to an industry centered on open interfaces would change the game altogether. A restructured industry based on open interfaces would directly address the prevailing concerns over untrusted vendors such as Huawei and the broader inefficiencies of the industry. There are distinct advantages to be gained in security and interoperability, supply chain resiliency, probable cost savings, and the opportunity to stimulate much-needed competition in the sector. Taken together, these advantages do much to blunt Beijing’s industrial policies that have enabled Huawei’s predatory anti-competitive practices.

COVID-19 is arguably the biggest crisis the planet has faced since the Second World War and will likely have significant impacts on international security in ways which can and cannot be anticipated. For this special issue on COVID-19 and counterterrorism, we convened five of the best and brightest thinkers in our field for a virtual roundtable on the challenges ahead. In the words of Magnus Ranstorp, “COVID-19 and extremism are the perfect storm.” According to another of the panelists, Lieutenant General (Ret) Michael Nagata, “the time has come to acknowledge the stark fact that despite enormous expenditures of blood/treasure to ‘kill, capture, arrest’ our way to strategic counterterrorism success, there are more terrorists globally today than on 9/11, and COVID-19 will probably lead to the creation of more.” Audrey Kurth Cronin put it this way: “COVID-19 is a boost to non-status quo actors of every type. Reactions to the pandemic—or more specifically, reactions to governments’ inability to respond to it effectively—are setting off many types of political violence, including riots, hate crimes, intercommunal tensions, and the rise of criminal governance. Terrorism is just one element of the growing political instability as people find themselves suffering economically, unable to recreate their pre-COVID lives.” The roundtable identified bioterrorism as a particular concern moving forward, with Juan Zarate noting that “the severity and extreme disruption of a novel coronavirus will likely spur the imagination of the most creative and dangerous groups and individuals to reconsider bioterrorist attacks.” Ali Soufan warned that “although the barriers to entry for terrorists to get their hands on bio weapons remain high, they are gradually being lowered due to technological advances and the democratization of science.” The special issue also features five articles. Audrey Alexander examines the security threat COVID-19 poses to the northern Syria detention camps holding Islamic State members, drawing on a wide range of source materials, including recent interviews she conducted with General Mazloum Abdi, the top commander of the SDF, and former U.S. CENTCOM Commander Joseph Votel. Chelsea Daymon and Meili Criezis untangle the pandemic narratives spun by Islamic State supporters online. Christopher Hockey and Michael Jones assess al-Shabaab’s response to the spread of COVID-19 in Somalia. Mark Dubowitz and Saeed Ghasseminejad document how the Iranian regime has spread disinformation relating to the pandemic. Finally, Nikita Malik discusses the overlaps between pandemic preparedness and countering terrorism from a U.K. perspective.

Abstract:
Misuse of personal information, manipulation of platforms to influence elections, and failure to extend broadband to underserved areas are a few of the problems facing governments at all levels. Increasingly, policymakers are taking up the challenge of shaping legal solutions to these problems, only to find they lack both the tools and technical expertise to regulate wisely, meaningfully and efficiently. Given the current technological environment, what goals are appropriate to assure that emerging technologies are used to benefit the populace and do not harm society? Participants of the 34th Aspen Institute Conference on Communications Policy, which took place in Aspen, Colorado in August 2019, examined regulatory frameworks that can provide a successful model for future problems as they inevitably appear. The report of the Conference explores approaches to impede harms from digital and network technologies that address user protection, promote consumer choice and competition, and foster access to essential services.

Abstract:
In the context of modern information and communication systems, present study was designed to examine the information and communication imbalances among the developed and under developed countries in tweets of international news agencies during 2010-16. Theoretically, the study takes roots from world system theory and structural imperialism theory. Methodologically, the triangulation of method is used. Firstly, the content analysis was performed on purposively selected tweets of four international news agencies; AFP, AP, Reuters and Xinhua about the 15 sample countries for the period of 7 year from 2010-2016. Further, the social network analysis technique was used to examine the network structures of international news determinants and world countries. This study revealed that core and semi-periphery countries are shared more and framed positively, while periphery countries are shared less and portrayal negatively not only by the international news agencies but also by their followers. Further, it was also found that Reuters’ tweets agenda about core, periphery and semi-periphery countries is different from other news agencies specifically from Xinhua. Moreover, study also found that in the tweets of international news agencies the core and semi-periphery countries are covered and shared in context of foreign relations, trade, economy, entertainment, and human interest, while periphery countries are covered and shared with reference to conflicts, disasters, and human rights violations.
