171. Negotiating Sudan's North-South Future

Abstract:
Sudan's fragile Comprehensive Peace Agreement (CPA) is entering its final phase, and a critical vote on Southern self-determination looms, but foundations for a constructive post-referendum relationship are yet to be laid. In addition to a handful of outstanding CPA items, future arrangements on citizenship and nationality, natural resource management (oil and water), currency, assets and liabilities, security and international treaties must be negotiated, regardless of the referendum's outcome. Many in Sudan and abroad are focused on ensuring the referendum exercise takes place on 9 January as planned. But simultaneously pursuing agreement on the broader postreferendum agenda is not only critical for a peaceful transition and long-term regional stability, but may also serve the more immediate objective of clearing the path for a mutually accepted referendum.

Abstract:
Yemen's leaders consider their sporadic war against the Houthi rebels a conflict they can win and, in so doing, discourage southern secessionists—a more immediate threat to their hold on power and the nation's territorial integrity. Instead, this war in the North has exposed greater vulnerabilities for the regime, weakened the central government, and emboldened other threats to Yemeni and global stability such as al-Qaeda.

Abstract:
Seven years after large-scale militia attacks signalled a change in the long- running but generally low-level conflict in Darfur, an unprecedented array of international instruments has been deployed, often chaotically, to address the conflict, including peacekeepers, peacemakers, special envoys, mediators, sanctions, embargoes, and criminal prosecution. Yet peace remains as elusive as ever. In the three and a half years since the Darfur Peace Agreement was precipitously concluded in Abuja and, rejected by most Darfurians, left to wither, the paradigm of government–rebel talks has persisted, despite stalemate. Time is not on Darfur's side: the longer the conflict continues, the more actors become involved and the harder it is to resolve. With national elections scheduled for April 2010 and a referendum on self-determination for Southern Sudan in 2011, the focus has moved away from Darfur. This Working Paper examines mediation efforts since Abuja and suggests why they have failed.

A unified state for just 20 years, Yemen has endured decades of social and political turmoil. It is also afflicted by a number of interlocking armed conflicts. These range from separatist political clashes between state security forces and protesters to all-out civil war—drawing in Saudi Arabia— and terrorism, which has seen the United States, the United Kingdom, and others become involved. Meanwhile, under the international radar, simmering social conflicts—primarily over land and water—reportedly account for some 4,000 violent deaths every year.

Conflict prevention is getting harder. In an increasingly complex international order, tensions between major powers complicate efforts to avert or mitigate civil wars. There has been a proliferation of potential mediators including regional organizations, individual governments and non-governmental organizations—often bringing specific expertise and political leverage to emerging crises, but risking duplication and turf wars. But while the United Nations is constrained by tensions among member states and challenged by the array of alternative institutions, it still has an important role in prevention. The UN has a unique “reach” into many unstable countries through its aid and development networks. Whatever the internal and external limitations on the UN, there is a widespread expectation that the Secretary-General and his officials can and should intervene in escalating crises, either to halt violence or at least to limit the suffering that it causes.

Darfur, an arid region in western Sudan, has become synonymous with genocide, though many have been reluctant to describe the situation there in such terms, not least the African Union (AU). As the conflict between Government of Sudan and the Sudan People's Liberation Army/Movement (SPLA/M) raged on for over two decades, long-standing tensions in Darfur were neglected. Meanwhile, negotiations led by the Inter-Governmental Authority on Development (IGAD) culminated in the Comprehensive Peace Agreement (CPA) in January 2005, marking the end of Africa's longest running civil war; a conflict that had claimed the lives of approximately two million people and displaced millions more. However, the marginalisation of Darfur meant that the celebrations marking the end of the north-south conflict were short-lived, as news of mass murder involving government soldiers and their infamous militia allies, the Janjaweed, eclipsed the much celebrated deal. In Darfur, the Government and Janjaweed were pitted against the Sudan Liberation Army (SLA) and the Justice and Equality Movement (JEM), the two groups that had taken up arms against the Islamist government in early 2003.

The Council decided to reduce the number of peacekeepers by 2,000, and to transform Monuc into a stabilisation force, renamed Monusco.

178. Sudanese Perspectives on the 2010 Referendum

Abstract:
The people of Southern Sudan are a little more than one month away from casting their votes in a referendum on whether to remain part of Sudan or become an independent state. The referendum is the most significant milestone in a six-year interim period that began with the signing of the Comprehensive Peace Agreement (CPA) in 2005. The CPA was the outcome of a U.S.-backed process that successfully brought an end to almost 40 years of civil war between the North and South. Two votes are scheduled to take place on January 9, 2011. In the first, Southern Sudanese will vote on whether they wish to secede from the North and form an independent country in the South. At the same time, voters in the border enclave of Abyei will decide whether to remain in the North or join the South. CSIS Africa Program staff, Richard Downie and Brian Kennedy, traveled to Khartoum and the southern capital, Juba, in October to gauge views about the forthcoming referenda and assess how preparations are proceeding ahead of the polls.

179. India and the Civil War in Sri Lanka: On the Failures of Regional Conflict Management in South Asia

The paper provides an assessment of India's role in the final years of the civil war in Sri Lanka (2003-2009). In particular, it looks for explanations for India's inability to act as a conflict manager in its own region, which is in contrast to predominant assumptions about the role of powerful regional states. It also seeks to explain the surprising turn in India's approach to the conflict, when in 2007 New Delhi began to rather explicitly support the Sri Lankan government—in disregard of its traditional preference for a peaceful solution and its sensitivity for the fate of Sri Lankan Tamils. While historical and domestic pressures led to India's indecisive approach during the years 2003-2007, starting from 2007 regional and international factors—most notably the skillful diplomacy of the Sri Lankan government and the growing Chinese presence there—induced New Delhi to support the government side in order to keep some leverage on Sri Lankan affairs. The analysis of the Sri Lankan case opens several avenues for further research in the fields of regional conflict management and foreign policy analysis.

180. Sudan Debt Dynamics: Status Quo, Southern Secession, Debt Division, and Oil–A Financial Framework for the Future

The people of Southern Sudan are scheduled to vote in a referendum on whether to remain unified with the central government in Khartoum or break away to form a new, fully independent country. While the Khartoum government remains committed to a unified Sudan, all indications suggest that the Southern Sudanese will vote for secession by an overwhelming majority. Khartoum's willingness to accept the potential losses remains unclear. Many suspect that its ultimate actions will depend, at least in part, upon the resolution of key outstanding issues, such as oil and debt. This paper contributes to ongoing discussions about the role of Sudan's $35 billion in external debt obligations – both for a unified Sudan and a possible Southern secession. First, it examines Sudan's existing debt dynamics and the potential eligibility for traditional debt relief and multilateral debt relief initiatives. Second, it outlines potential options for dividing Sudan's external debt obligations in the event of a Southern secession. Third, it estimates external indebtedness ratios under each debt division scenario and the potential relevance of traditional debt relief treatments. Lastly, the paper provides an indicative roadmap for clearing Sudan's loan arrears of $30 billion and potentially securing comprehensive debt relief in the future.
