Abstract:
The 40th regular session of the Human Rights Council (HRC) was held in Geneva between 25 February and 22 March 2019. As the primary international human rights body, the Human Rights Council has the capacity to prevent and respond to mass atrocity crimes, as systematic violations and abuses of human rights can be potential indicators of genocide, war crimes, crimes against humanity or ethnic cleansing. The summary below highlights major outcomes and relevant dialogues from the 40th session as they relate to the Responsibility to Protect (R2P) populations from such crimes. As part of the session, the Netherlands delivered a statement on behalf of members of the Group of Friends of R2P.

Today, 15 March, marks eight years of deadly conflict in Syria. Since 2011 half a million people have been killed, 11.9 million have been displaced from their homes and 13 million remain in dire need of humanitarian assistance. As the conflict enters its ninth year and the prevailing media narrative is that the civil war is coming to an end, civilians in Syria still face the threat of war crimes and crimes against humanity.

Abstract:
In this occasional paper from the Global Centre for the Responsibility to Protect, Dr. Simon Adams tests the resilience of the international community’s commitment to defending human rights and upholding its Responsibility to Protect populations from genocide, ethnic cleansing, crimes against humanity and war crimes. The paper highlights the failure to respond to patterns of discrimination that eventually led to a genocide in Myanmar (Burma) during 2017. But it also draws attention to other recent situations, such as in the Gambia, when the international community seized the moment to respond in a timely and decisive manner to an emerging threat of devastating conflict. In doing so, Adams emphasizes that even when bodies such as the UN Security Council appear paralyzed and inert, a mobilized international community can still act to prevent atrocities, protect vulnerable populations, and hold the perpetrators accountable.

76. Casualties of War: The Legacy of South Korean Participation in the Vietnam Conflict

Abstract:
After the United States, the Republic of Korea sent more troops to Vietnam than any other nation. Approximately 325,000 South Korean soldiers served in Vietnam between 1964 and 1973. Although the Korean military and economy benefited substantially from the conflict, the war also left some deep scars on the national psyche. While the government did not permit public criticism of the war in the 1960s and 1970s, South Koreans have now finally begun to confront their troubled Vietnam legacy. Often referred to as Korea’s “forgotten war,” the Vietnam Conflict has recently made its way into Korean popular culture through movies, novels and songs about the war. Increased freedom and democracy has created an environment where both the Korean government and the people have begun to openly discuss issues such as Post-traumatic Stress Disorder and alleged wartime atrocities committed by South Korean servicemen. This paper will analyze some of the more controversial aspects of Korea’s involvement in the Vietnam War and examine how South Koreans themselves have addressed these issues both officially and within their popular culture during the last few decades.

77. US Government Statements on Genocide: A report exploring how, when, and why determinations of genocide are made

Abstract:
This report reviews the experience of the US government across recent decades in making decisions to say—or not to say—that genocide has occurred in a country. It reviews the political, policy, and legal difficulties that the US government has encountered in considering whether or not to do so. The report goes on to describe the circumstances in which the US government has considered and made such statements, the objectives to which supporters of such statements have pointed as reasons for making such statements, including to show solidarity with victims and to help mobilize a response to prevent further atrocities, and concerns and criticisms that have been offered of pursuing such statements. It then offers a series of recommendations aimed at helping US officials and congressional, civil society, and other advocates address future atrocity situations. To address these issues, the authors reviewed the public record concerning US policy regarding large-scale mass atrocities in recent decades, focusing on situations where available documents (including public remarks, internal US government documents that have been publicly released, and other studies) provided insight into whether and how the US government considered the applicability of the term “genocide.” The authors also reviewed a handful of recent situations where statements about genocide appear not to have been considered but arguably could have been. This research was supplemented by consultations with more than 60 individuals who were personally involved in the relevant situations, focusing primarily, but not exclusively, on former and current US government officials, as well as by reflections upon the authors’ experiences while working in the government on efforts to prevent and respond to genocide and other mass atrocity crimes.

Today the UN General Assembly elected Argentina, Austria, Bahamas, Bahrain, Bangladesh, Bulgaria, Burkina Faso, Cameroon, Czech Republic, Denmark, Eritrea, Fiji, India, Italy, Philippines, Somalia, Togo and Uruguay to the Human Rights Council (HRC) for the 2019-2021 term. With the elections of Argentina, Bangladesh, Czech Republic, Denmark, Italy and Uruguay, 20 of the 47 Council members during 2019 are also members of the Group of Friends of the Responsibility to Protect in Geneva.
