31. Risk of Mass Atrocities against the Rohingya Post-coup

Abstract:
The Rohingya—who experienced genocide prior to Burma’s 2021 military coup—are now at heightened risk of genocide and mass atrocities by the Burmese military, known as the Tatmadaw, and the Arakan Army, an ethnic armed organization in Rakhine State. Other vulnerable groups include the broader Muslim community and ethnic and religious minorities in areas where ethnic armed organizations and/or People’s Defense Forces are fighting the Tatmadaw. To prevent mass atrocities, the Tatmadaw should cease attacks on civilians and cede power so Burma can move toward a more diverse, representative, and credible democracy. The US and other governments should conduct a full mass atrocity risk assessment, provide rapid and flexible funding to civil society organizations responding to the crisis, and constrain and condemn the Tatmadaw.

Abstract:
The United States Holocaust Memorial Museum’s Simon-Skjodt Center for the Prevention of Genocide released a report in November 2021, “To Make Us Slowly Disappear”: The Chinese Government’s Assault on the Uyghurs. The Chinese government’s attacks on the Uyghur community are alarming in scale and severity. The report expresses the Museum’s grave concern that the Chinese government may be committing genocide against the Uyghurs, a Muslim community in the Xinjiang Uyghur Autonomous Region of northwest China. The report also details multiple crimes against humanity that the Chinese government is committing against the Uyghur population. These crimes include forced sterilization, sexual violence, enslavement, torture, forcible transfer, persecution, and imprisonment or other severe deprivation of physical liberty. The Museum’s findings, based on publicly available information, demonstrate that China is failing to uphold its responsibility to protect its citizens from genocide and crimes against humanity. The Chinese government must halt its attacks on the Uyghur people and allow independent international monitors to investigate and ensure that the crimes have stopped. The seriousness of the assault on the Uyghur population demands the immediate response of the international community to protect the victims.

Abstract:
The Responsibility to Protect is a political commitment made by heads of state and government at the 2005 UN World Summit aimed at preventing and halting four mass atrocity crimes, namely genocide, war crimes, crimes against humanity and ethnic cleansing. In doing so, states agreed that governments have the primary responsibility to protect populations within their borders from atrocity crimes, that the international community should help states in building the capacity to uphold this responsibility, and that when a state is unwilling or manifestly failing to do so, the international community must be prepared to take timely and decisive collective action in accordance with the UN Charter. Atrocity crimes do not occur in a vacuum, nor are they isolated or random incidents. Rather, they are typically the consequence of a broader process. In order to adequately prevent and respond to the threat of atrocity crimes, there is a need to understand the early warning signs, risk factors and aggravating conditions that may culminate in the perpetration of such grave crimes. Systematic or widespread human rights violations and abuses often serve as one of the key early warning signs of possible atrocity crimes. This briefing paper aims to examine the relationship between mass atrocity crimes and human rights violations and abuses, highlighting that such violations and abuses may precede and significantly elevate atrocity risks and may also constitute atrocity crimes themselves if certain thresholds or conditions are met.

Abstract:
The terms “primary”, “mid-level” and “lower level” are employed to qualify perpetrators of mass atrocities, based on the magnitude of guilt and criminal responsibility. Could this classification be a misnomer? Could the relationship among perpetrators, or the roles they assume be more intricate, warranting a reassessment of the existing hierarchy? This paper explores the need to be more circumspect in penning perpetrators in categories, especially in complex scenarios of mass atrocity. To do so, the Non-Solitarist View of Human Identity and Framing Theory are used to explore the matter, with a focus on perpetrators of the Khmer Rouge era.
