231. The Impact of the Human Rights Movement in Tunisia: Between Legislation and Practice (2010-2016)

Abstract:
This paper addresses the role of the human rights movement in Tunisia in influencing state legislations and practices. It also attempts to tackle a shift from largely monitoring and denouncing rights violations prior to the January 2011 revolution to participating in drafting bills and lobbying for policy reforms that could reduce these violations. The human rights movement was not isolated from what Tunisia experienced in the years following the 2011 revolution, which resulted in massive realignments of social and political structures and practices with a heightened awareness of the importance of human rights and the need to continue the struggle to demand and enjoy them. This new climate witnessed a change not only in terms of the scope of the demands put forth by the human rights movement but also regarding the means and mechanisms it used to achieve these demands, which at times succeeded but ended in failure some other times.

Abstract:
The United Nations has declared a priority this year to unify and strengthen its work in building peace—and U.N. bodies will meet in the next two months to advance that change. U.N. leaders have acknowledged that a vital element in peacebuilding is nonviolent, grassroots movements that can prevent violent conflict by providing ways for people to constructively address grievances, seek rights and advance justice. But as the United Nations aims to more efficiently promote peace, how prepared is it to actually work with the nonviolent grassroots movements that have proven to be peacebuilding’s most effective tool? The answer to that is unclear, but the U.N. system could take a few steps during and after its high-level meetings this spring to strengthen this neglected part of its peacebuilding strategy.

233. When Should Children Be Allowed to Work?

Abstract:
When we think about child labor, what often comes to mind are images of dirty, poorly dressed children—digging in mountains of trash, carrying heavy loads of bricks or crops, or disappearing in dark mine tunnels. Yet working children are a heterogeneous group that also includes children helping out in domestic labor, family shops, or subsistence agriculture, and adolescents undertaking their first steps into the labor market. While child labor is generally perceived as bad for children and efforts toward its elimination are pursued by the international communities, in certain contexts—and particularly in countries of the Global South—this is a culturally accepted and sometimes prized practice, considered fundamental for basic household production. In certain countries, working children themselves have created unions and mobilized to ask for fairer labor conditions and greater protections rather than child labor elimination. These gaps between international and domestic views on child labor have made the task of regulating the issue under human rights law particularly challenging for international organizations. International human rights agreements have proliferated since the 1990s. They seek to encourage states to behave in ways that respect human rights and they play a major role in shaping ideas about how to conduct world politics. But despite their proliferation, we still have an incomplete understanding of how states respond to internationally agreed-upon charters of rights, why they respond the way they do, the circumstances under which rights treaties make a difference, and what that difference might be. Compliance tends to be understood in this debate in an either/or fashion: states either come into line with international human rights law or not. Legal anthropology and constructivist approaches to international relations sought to document the ‘translation’ or ‘socialization’ of human rights that shapes domestic compliance—by which they mean how international norms become attached to local issues that allow communities to ‘make sense’ of the norm—but they have not challenged the assumption that ‘compliance’ implies an alignment between domestic practices and international agreements.

234. When Life Is in Limbo, Education Can't Wait

Abstract:
Of the sixty-five million people currently displaced worldwide, about half of them are children. On average, a refugee may spend between ten to twenty-five years in exile. This means that for many children, their entire formal education will take place while awaiting a durable solution to their displacement. However, the United Nations Refugee Agency (UNHCR) estimates that only 50 percent of refugee children have access to primary education, and only 22 percent have access to secondary school. The critical task of educating refugee children has been the focus of scholarship for Weatherhead Center Faculty Associate Sarah Dryden-Peterson and her research team who are investigating processes of refugee education in Kenya, Lebanon, and Uganda, among others. Documenting the experiences of students, families, and teachers over time, the group has gained insight on education delivery, quality of instruction, and resource allocation. The struggle to meet the educational needs of refugee children, according to Dryden-Peterson, has called into question the very purpose of education and what kinds of futures it prepares young people for. The Weatherhead Center asked Dryden-Peterson and doctoral students Vidur Chopra and Elizabeth Adelman to describe some of the realities facing Syrian refugees, who rely on education as a critical pathway to establishing a secure life. What follows is an abridged version of that conversation.

235. The UN Security Council: From a 20th Century Relic to Effective Security Governance

Abstract:
The United Nations Security Council lies at the heart of the global security architecture. It was established in 1945 to maintain international peace and security, but reform has been stuck for decades. Beyond a nuclear conflagration and the enduring challenge of interstate conflict, future global security challenges include the impact of climate change, the threat of pandemics, dirty bombs, nuclear terrorism and cybercrime. These risks are exacerbated by the rise of new nationalism in the West with countries such as the USA turning away from multilateralism, eschewing collaboration and accelerating change away from a global system hitherto dominated by the West. At a time of great power transitions, mul- tipolarity without sufficient multilateralism is a dan- gerous trend. Without comprehensive change that includes the end of permanent seats and the veto, the Council is fading into irrelevance. Such reform is possible, but requires a very different approach compared to efforts to find a compromise between different negotiating blocks in New York. Instead, detailed proposals should be agreed upon amongst like-minded states outside of the intergovernmental negotiating process and tabled in the General Assembly as a non-negotiable amendment to the Charter of the United Nations (UN). Even then only the threat from key countries to withdraw coopera- tion from the UN is likely to change things.

236. The Global Refugee Crisis: Towards a Just Response

Abstract:
More than two-thirds (68 %) of the 24 million refugees worldwide come from just five countries: Syria (6.3 mil- lion), Afghanistan (2.6 million), South Sudan (2.4 million), Myanmar (1.2 million) and Somalia (almost 1 million) (UNHCR 2018b, p. 3). At least in three of these, there has been overt Western intervention and in four cases there is a failed developmental state. In keeping out asylum seek- ers and refugees from their territories, Western nations also forget the migration of millions of people in the 19th century from Europe to the rest of the world. Furthermore, the limits of contemporary movement of forced migrants to the West cannot be discussed without talking about slave trade, the movement of indentured labour, and the occupation of territories declared terra nullius. Contem- porary economic and political policies of Western nations and the institutions they control also need to be factored in. These historical episodes lend perspective to current numbers with refugees constituting less than 0.3 % of the world’s population (Amnesty International 2016, p. 6). Moreover, according to United Nations High Commis- sioner for Refugees (UNHCR), 85 % of the world’s refu- gees under its mandate are hosted in the Global South (UNHCR 2018b, p. 2). Against this backdrop, the author seeks to contest the justifications offered by Western com- mentators for the non-entrée or restrictive asylum regime established in the Global North. Instead, he proposes a multipronged strategy consisting of short, medium, and long-term measures to address the global refugee crisis.

The combined attack by the United States, Britain, and France on Syrian targets following the Assad regime's use of chemical weapons has sparked extensive debate on the strike’s strategic aspects, and how, if at all, the offensive will affect the situation and the balance of power in Syria. The attack has also aroused a legal discussion, which once again highlights the limitations of the existing rules of international law when it comes to dealing with situations where the use of force is not based on the authorization of the Security Council or derived from the right to self defense. In this context, the forceful response, in and of itself, particularly being a combined attack by a number of key states, could have an impact on the development of international law with regard to the rules regarding possible legal justifications for the use of force between states.

238. Making cities in conflict areas more resilient

Abstract:
By 2050, the UN estimates that 70 percent of the global population will be living in urban areas. Therefore, understanding and anticipating the ability of cities to manage and avoid the negative effects of climate-related changes and events – for example, hurricanes, overpopulation or supply chain disruption – is of utmost importance. This paper presents a conceptual framework to empirically quantify the climate resilience of cities to guide policymakers and community leaders in identifying challenges and opportunities. This paper tests the framework for data analysis in three cities in conflict-prone territories: Bamako (Mali), Maiduguri (Nigeria, Lake Chad Region) and Baghdad (Iraq). The analysis of the three cases suggested that city resilience in those areas cannot be developed without addressing the root causes of conflict in the entire area, as city-level resilience in conflict areas is closely related to the national level. On the basis of the research, some important observations and recommendations are made. When tested, the analysis revealed that the level of resilience did not necessarily correspond to economic development; it also found that conflict significantly lowered overall urban resilience to climate-related impacts. Large sprawling cities typically score poorly on maintaining resilience. While recovery and learning capacities are usually present in urban areas, very dense urban areas are particularly vulnerable to climate disasters. Cities in the global north have built learning capacity; they have made efforts to share best practices (e.g., the Rockefeller Foundation’s Resilience initiative, efforts by UN CPI and CRI, etc); and they have considered the lessons learned and implemented guidance. Data analysis can help to bolster the learning capacity of cities to cope with climate impacts that could increase tensions in large urban areas. However, there is a significant difference in the availability of data between the developed and the developing world. Data collection in developing countries (and cities) should be strengthened to better estimate climate-related security risks in urban areas and bolster their capacity to maintain key functions and recover and learn from climate events in their own and comparable cities.

Abstract:
As China’s role as a major power in international affairs is growing, the Chinese government is becoming more active and more influential in the United Nations (UN). This is likely to have – or, in the eyes of some, already has – a significant impact on the UN’s (future) functioning. Growing Chinese influence is important for all UN members, and particularly so for Western countries, including the Netherlands, which strives to maintain and strengthen the international legal order as a principal foreign policy aim. This report by Maaike Okano-Heijmans and Frans-Paul van der Putten, with contributions from Etienne Béchard, Louise van Schaik and Vishwesh Sundar, aims to provide a better understanding of the process currently underway. It does so, first, by analysing how and in which direction China’s involvement in the UN is evolving. Next, the discussion turns to the question of how China’s growing involvement is relevant to the setting and the developing of norms and standards within the UN. Finally, the authors explore where European countries and China have common interests, and where their interests are conflicting through presenting three case studies in three thematic areas, namely human rights, development finance and climate change.

240. Domesticating the Giant: The Global Governance of Migration

Abstract:
Migration is a natural and defining phenomenon of the globalized world. The challenge of governing migration lies in its inevitability, volume, and heterogeneity. As a portion of the global population, migrants represent around 3 percent, but their absolute number is rising. There were 170 million migrants in 2000; today there are roughly 260 million. Migration levels will certainly grow while hostilities continue in the most conflict-ridden regions of sub-Saharan Africa and the Middle East, the global wealth gap persists, climate change aggravates living conditions in many areas, and the poorer half of the globe becomes more populous. Moreover, migration is a complex heterogeneous process. Depending on the cause, duration, and legality, migration can be voluntary or forced (refugees and internally displaced persons, including survival migrants such as climate and disaster refugees), permanent or circular, regular or irregular. Politically, migration poses a twofold challenge: balancing security and freedom and harmonizing international obligations with domestic laws. Traditional discussion of migratory movements divided the world into the sending global south and the receiving global north. Interests of the former lay primarily in safeguarding the rights of their citizens regardless of immigration status and ensuring remittance flow. Interests of the latter lay in accommodating the “useful” migrants and restricting the rest. With the shifts in global wealth distribution, this division is losing tenacity. Countries that once were sending migrants are also receiving them today. For nations, migration affects the most rudimentary pillar of sovereignty (national borders), the core of democratic political systems (human rights), and atavistic social needs (national identity). Perceptions of migration affect political popularity: political parties are tempted to use selective, mostly negative, aspects of migration to rally the electorate around national identities. This in turn disproportionately, and often contrary to the objective needs of the host countries, vilifies migration generally. Political opposition to migration occurs despite a consensus that the economies of both sending and receiving countries benefit economically from migration. Even though the sending countries may experience labor and brain drain, they benefit from remittance flows from receiving countries; similarly, the receiving countries get a boost of human capital.
