211. Protecting Civilians in the Context of Violent Extremism: The Dilemmas of UN Peacekeeping in Mali

Abstract:
In the non-permissive environments where they are often deployed, UN peace operations need to be increasingly creative to implement their mandate to protect civilians. They face particularly acute challenges in contexts marked by violent extremism, such as Mali, where attacks by terrorist groups have greatly constrained the capacity of peacekeepers to protect local populations. This paper explores the operational challenges that the UN Multidimensional Integrated Stabilization Mission in Mali (MINUSMA) faces in implementing its protection mandate. It analyzes protection threats related to violent extremism in Mali and explores the protection strategy, tools, and activities developed by the UN mission to address those threats. It highlights some of the practical constraints of operating in a hostile environment and added complications related to the mission’s proximity to non-UN counterterrorism forces. The Malian case demonstrates that each peacekeeping theater needs to be its own laboratory for POC and that approaches, tools, and mechanisms are not directly replicable from one UN mission to another. The report makes three recommendations to improve the delivery of MINUSMA’s protection mandate: Explore the full spectrum of military, police, and civilian tools; Ensure the independence of MINUSMA’s POC activities from counterterrorism agendas; and Design and articulate a political strategy that prioritizes POC.

212. The Mission Is Gone, but the UN Is Staying: Liberia’s Peacekeeping Transition

From 2003 to 2018, the UN Mission in Liberia (UNMIL) was ever-present throughout the country. The peacekeeping mission’s work, and its transition out of the country, are considered positive examples of how the UN can support countries through conflict and post-conflict phases. Nevertheless, UNMIL’s transition offers many lessons that member states, UN officials, and international partners can learn in order to strengthen future UN peacekeeping transitions. This paper examines the process of Liberia’s transition from a peacekeeping mission to a UN country team configuration, focusing on the period from July 2016 to July 2018. It identifies the political and operational dynamics that drove the transition, examines the policy processes and context within which the transition was executed, and assesses the ability of the UN’s post-mission configuration to sustain peace in Liberia. The paper underscores that member states and the UN Secretariat should change their approach to transitions from racing against deadlines to instead viewing them as processes that begin well before a peacekeeping mission closes and continue for several years after the mission ends. By viewing transitions as long-term, multi-stakeholder activities, member states have the opportunity to ensure that future transitions adopt integrated approaches with adequate political, operational, and financial support.

213. Lessons Learned from the UN’s Transition in Côte d’Ivoire

In April 2016, after four years of progressive downsizing, the Security Council decided to close the UN Operation in Côte d’Ivoire (UNOCI) within a year. This decision reflected a consensus that it was time for UNOCI to leave and hand over to the UN country team with no follow-on mission. However, the transition was abrupt, without sustained dialogue, capacity transfer, or financial fluidity, leaving the UN country team unprepared to take on the mission’s responsibilities. This policy paper examines the political dynamics in Côte d’Ivoire and in the Security Council that led to the decision to withdraw UNOCI, as well as the stages of the withdrawal and handover. It also analyzes the gaps and shortcomings that left the country team ill-prepared to take over, highlighting two main challenges. First, the Security Council viewed the transition as a political process. Its objective of withdrawing the mission superseded all others, leading it to underestimate, if not overlook, the continued peacebuilding needs of the country. Second, the transition was accompanied by waning donor interest, undercutting programming by the country team in priority areas like reconciliation, security sector reform, human rights, and land tenure.

214. Mission in Transition: Planning for the End of UN Peacekeeping in Haiti

The process of reconfiguring, closing, and handing over responsibilities to a UN country team or host-state institutions is a crucial—and challenging—part of the life cycle of a UN peacekeeping mission. Transitions have been a central feature of UN peacekeeping in Haiti, in particular, which has gone through numerous transitions since the 1990s. This paper focuses on the two most recent peacekeeping transitions in Haiti: one from the UN Stabilization Mission in Haiti (MINUSTAH) to the UN Mission for Justice Support in Haiti (MINUJUSTH), or from a multidimensional peacekeeping operation involving a substantial military component to a small peace operation focused on police and rule of law; and the ongoing transition toward the closure of MINUJUSTH and preparations for the eventual handover to other actors. For both missions, the paper focuses on three issues: (1) transition planning, including the political dynamics that influenced decision making, gaps between plans and the reality on the ground, and the limited role of the host state, UN country team, civil society, and donors; (2) management, logistical, and administrative challenges; and (3) issues related to business continuity and changes in substantive areas of work. It concludes by offering lessons learned from the past and current transitions that can inform the next drawdown and exit of peacekeepers from Haiti.

215. The Human Rights Movement in Morocco: The Dialectic of Influence

Abstract:
The relationship between the human rights movement and the state in Morocco has gone through two major stages since the movement appeared in the 1970s. The first phase (1970s–1990s) was antagonistic in the broader ferocious political conflict that lasted from independence till the 1990s. Civil and political rights were routinely violated, and members of the opposition were incarcerated in secret detention centres. The state oppressed or ignored human rights activists or tried to contain them during that stage. This came to a gradual end in the early 1990s. The ruling regime changed the way it viewed the human rights movement and human rights themselves. Political detainees benefited from an amnesty and a process of reconciliation evolved as the state opened up the dark files of repressive practices such as arbitrary arrests, torture and enforced disappearances. The second phase, which began in the mid-1990s, came after the ruling regime had created and stabilized state institutions and the modalities of governance. It was then able to begin a calculated political opening bolstered by various internal and external forces. This, however, did not change the essentially contentious nature of the relationship between the human rights movement and the state. The conflict became subtle and more refined. The state attempted to turn the dark page of human rights’ violations within a process of transitional justice. Despite harsh criticism, this process heralded in some way the end of systematic torture, forced disappearance and detentions without fair trials. The scope and spread of human rights organizations and activists expanded in the following two decades, particularly after the movement of 20 February 2011, leading to the adoption of a new constitution that explicitly acknowledged the supremacy of international treaties and human rights laws and legislation. This paper reviews the history of the state’s relationship with the whole paradigm of human rights as it relates to society and politics and with human rights defenders in particular.

Abstract:
The international migrant crisis made headlines during summer 2015 and challenged the national asylum systems of many countries worldwide. Going beyond academic circles, hot debates on migrants and the role of asylum highlighted the gap and paradoxes that exist between claimed values of solidarity on the one hand, and the restrictive policies and regulations towards asylum seekers on the other hand. This paper documents this tension in oil and gas exporting states, particularly in the Gulf Cooperation Council (GCC) and the Central Asian Republics (CAR). It questions the claimed regional, ethnic and/or religious ties and the borders that have been closed to most asylum seekers from Syria and Afghanistan, who are presently living in poorer (oil and gas deprived) neighboring countries. This paper argues that in a time of low oil revenues and fiscal difficulties, rentier states give priority to the Raison d’Etat over any form of transnational solidarity and commitment to international human rights agreements and charters. New and creative institutional arrangements are needed to deal with the global refugee crisis, as traditional solidarities are, in both regions as well as in other rentier countries, victims of the modernization of politics and its uncaring redefinition of state interest in times of low oil revenues.

218. Building Confidence in the Cybersphere: A Path to Multilateral Progress

Abstract:
As use of the Internet has become critical to global economic development and international security, there is near-unanimous agreement on the need for more international cooperation to increase stability and security in cyberspace. Several multilateral initiatives over the last five years have begun to spell out cooperative measures, norms of behavior, and transparency and confidence-building measures (TCBMs) that could help improve mutual cybersecurity. These efforts have been painstakingly slow, and some have stalled due to competing interests. Nonetheless, a United Nations (UN) Group of Governmental Experts (GGE) and the Organization for Cooperation and Security in Europe (OSCE) have achieved some high-level agreement on principles, norms, and “rules of the road” for national Internet activities and transnational cyber interactions. Their agreements include commitments to share more information, improve national protective capacities, cooperate on incident response, and restrain certain destabilizing state practices. Voluntary international agreements are worth little, unless states implement their commitments. So far, implementation has been crippled by vague language, national security considerations, complex relations between public and private actors in cyberspace, and privacy concerns. This is particularly true regarding the upfront sharing of information on threats and the willingness of participants to cooperate on incident investigations, including identifying perpetrators. With multilateral forums struggling to find a way forward with norm-setting and implementation, alternate pathways are needed to protect and build on what has been accomplished so far. Different strategies can help advance implementation of measures in the UN and OSCE agreements. Some commitments, such as establishing and sharing information about national points of contact, are best handled unilaterally or through bilateral or regional inter-governmental cooperation. Other objectives, such as protecting the core architecture and functions of the Internet that support trans-border critical infrastructure and underpin the global financial system, require a multi-stakeholder approach that includes not only governments but also private sector service providers, academic experts, and nongovernmental organizations. This paper compares what the GGE and OSCE norm-building processes have achieved so far and what disagreements have impeded these efforts. It identifies several priorities for cooperation identified by participants in both forums. It also proposes three practical projects related to these priorities that members of regional or global organizations might be able to work on together despite political tensions and philosophical disputes. The first would help state and non-state actors share information and communicate about various types of cybersecurity threats using a flexible and intuitive effects-based taxonomy to categorize cyber activity. The second would develop a more sophisticated way for state and non-state actors to assess the risks of different types of cyber incidents and the potential benefits of cooperation. The third would identify aspects of the Internet that might be considered the core of a public utility, worthy of special protection in their own right and for their support of trans-border critical infrastructure.

219. Forwarding Multilateral Space Governance: Next Steps for the International Community

Over the past decade, concerns about ensuring sustainability and security in outer space have led the international community to pursue a range of governance initiatives. Governance issues regarding the use of space are complicated because of the physical realities of the space environment and because of the legal status of space as a global resource. As the number of space users grows and the types of activities in space expand, competition for access to space will only continue to grow. Different space actors have different priorities and perceptions regarding space challenges. As more and more militaries around the world turn to space assets, the potential development of counterspace weapons also increases tensions. Ongoing multilateral work on space governance has concentrated primarily on voluntary measures. There have been three major multilateral governance initiatives in the field. The three—the EU Code of Conduct, the COPUOS Working Group on the Long-term Sustainability of Outer Space Activities, and the UN Group of Governmental Experts (GGE) on transparency and confidence-building measures—were related to each other, but each aimed to address slightly different aspects of the governance problem. This paper reviews these initiatives and elucidates ways to forward their progress, for instance, by fully implementing the GGE recommendations, the establishment of national focal points for data exchange, and by fully implementing the UN Registry of Outer Space Objects. It also looks to identify additional steps beyond current activities at the multilateral level for establishing a foundational space governance framework, including institutionalizing the UN Space Debris Mitigation Guidelines; establishing a public space situational awareness database; and examining ways to move forward discussion on active debris removal, national legal obligations regarding military activities, and space traffic management.

220. Financialization, Trade, and Investment Agreements: Through the Looking Glass or Through the Realities of Income Distribution and Government Policy?

Abstract:
This paper assesses the effects of trade and investment agreements on income distribution and government policy. The critical process underpinning these effects is the rise of ‘financialization’. Global patterns of greater financialization and of worsening functional income distribution as well as tighter fiscal stances are identified in the data. Tests are conducted by combining financial statistics with databases of bilateral investment agreements and free trade agreements, as well as data generated by the UN Global Policy Model that encompasses several fiscal policy instruments. The empirical validation of these relationships brings to the fore the policy-oriented debate about the purported benefits of modern-era ‘comprehensive’ trade and investment agreements such as TTIP, TTP and CETA. The authors corroborate the findings of their respective earlier studies of these agreements and reiterate their call for caution. To preserve policy space and to avert increases of inequality, policy-makers should resist pressures to get their economies locked in such agreements and should look instead for sustainable forms of international policy coordination.
