291. After Brexit: Could bilateral agreements facilitate the free movement of persons?

Abstract:
Some of the millions of EU nationals in the UK and British nationals in the EU are already suffering from Brexit’s drastic curtailment of the right to free movement. How can migration now be governed and facilitated between the two parties? Although an EU-wide agreement with the UK that ensures free movement remains the ideal solution, it is currently unrealistic. This calls for an evaluation of possible alternatives. Bilateral agreements should be explored and examined as a possible alternative to an EU-wide agreement with the UK to facilitate and govern cross-border mobility. Various bilateral free movement agreements across Europe show that their use is not only legal but also habitual. They offer flexibility when it comes to the rights of entry, residency and work, as well as other important rights. And they could also be used as a foundation upon which to build an agreement between the EU as a whole and the UK, if not to facilitate the rebuilding of mutual trust. Migration law expert Diego Acosta makes a further case for Spain being the first possible candidate for a post-Brexit bilateral free movement agreement concluded between an EU member state and the UK. Spain is the most important EU destination for British emigrants, and British migrants residing in Spain constitute the latter’s third-largest non-national population. In turn, the UK is the most important migrant destination for Spanish nationals worldwide, who represent the fifth-largest migrant group from the EU. He offers concrete suggestions as to what a bilateral treaty between Spain and the UK could include. In addition, governments of EU member states that have important reciprocal migration flows with the UK, as well as the UK government, should consider the following recommendations when exploring the possibility of adopting bilateral agreements on migration: The negotiating parties should place the rights and interests of both short-term and long-term British and European nationals residing in each other’s territory at the centre stage. In negotiating a possible treaty, both the respective EU member state (e.g. Spain) and the UK should take the pre-Brexit status quo as the departing point. The status of mobile nationals could be improved beyond that enjoyed by EU citizens pre-Brexit. For example, political rights could be extended beyond the municipal level. Certain categories of individuals (e.g. retirees, young workers) could benefit from special provisions which also depart from the pre-Brexit situation.

292. Will the EU’s positive agenda on Turkey amount to anything more than wishful thinking?

One year on, it remains to be seen whether the EU’s positive agenda (PA), an effort to establish a new modus vivendi with Turkey, will bear fruit. Turkey is one of the EU’s most important neighbours and a crucial partner on numerous issues, including migration, counterterrorism, energy and trade. Yet relations have always been challenging, with honeymoon periods few and far between. Bickering and animosity have become the norm. In 2020, escalating disputes in areas from human rights to maritime claims and military interventions brought the relations to a major crisis. Looking ahead, Ankara’s domestic and foreign policy ahead of crucial elections in 2023 (or earlier), the Cyprus problem, Germany’s leadership change, the 2022 French presidential election and Paris taking over the EU Council Presidency will all impact relations. Amanda Paul gives a concise state of play of EU-Turkey relations, what we can expect and what should be avoided, and areas for improvement. While Turkish membership of the EU seems highly unlikely, neither Ankara nor the EU is ready to call it quits. With no functioning accession process, EU–Turkey relations need a new framework that reduces the chances of further rupture and creates a new dynamic. Implementing the PA should be the starting point of this framework. In which case, the EU should consider the following four recommendations: green-light the talks to update the Customs Union; enhance migration dialogue; continue support for Turkish civil society and independent journalism; and revitalise foreign policy dialogue. 2022 will likely be a testing year. If the two parties are to move away from years of distrust and muddling through, they will have to exhibit political will and acquire a truly strategic vision for the future.

293. Beyond Networks, Militias and Tribes: Rethinking EU Counter-Smuggling Policy and Response

Abstract:
Countering migrant smuggling and its actors – described as the men behind the facilitation of migrants’ irregular journeys – are important elements of the European Union (EU)’s migration and border control policy. Under the new Pact on Migration and Asylum, the EU has proposed to promote tailor-made and mutually beneficial partnerships with third countries specifically to address migrant smuggling. EU Home Affairs Commissioner Ylva Johansson has also promised a predictable and reliable migration management system that includes “stepping up the fight against human traffickers and smugglers”. The EU has certainly taken important steps to counter irregular migration, including making considerable financial commitments to the fight against smugglers and their networks, to whom the journeys of irregular migrants into Europe are almost single-handedly attributed. Smugglers, characterised as inherently violent and exploitative, are also described as relying on a specific business model that generates incalculable earnings. Much has been written about how these profits, if unmonitored, can be funnelled by smugglers into other criminal enterprises like drug trafficking or weapons smuggling, but also into the more nefarious practices of sex trafficking or terrorism. Within this context, smugglers are also said to exploit an ever-growing number of naïve and desperate victims, primarily young men from sub-Saharan Africa who, driven solely by the power of social media and the iconography portraying European soil as a dreamed destination, do not think twice about embarking on dangerous journeys across vast deserts and seas. At high level policy events and academic exchanges, participants often cite examples of young men who, tricked by Facebook and Instagram posts, arrive in Europe after enduring harrowing experiences only to find themselves in even more desperate situations of homelessness and deprivation, having believed the lies and false promises of smugglers, friends and family members posted online. Migrant women, on the other hand, tend to be described as young sex slaves or prostitutes, victims of the depravity of sexually-predatory smugglers who do not hesitate to exploit them for profit in cities across North Africa and Europe. Migrants do face violence and intimidation at the hands of smugglers. These experiences have been documented at length in a vast number of reports targeting European audiences. Kidnapping, extortion, and physical and sexual assault are undeniable and troubling realities on the migration pathway, and migrants do experience them often at the hands of smugglers. Women, girls, and lesbian, gay, bisexual, transgender, intersex and questioning migrants are also more vulnerable to specific forms of sexual and gender-based violence (SGBV), which are often compounded by racism and other forms of discrimination – this does not preclude the fact that SGBV against migrant men is also common on the migrant trail. This policy study, developed by a team of migration scholars based in EU research institutions, argues that while these general notions have guided the mainstream, collective understanding of migrant smuggling, they do in fact pose several and serious limitations that, if not considered closely, can lead to faulty conclusions and inadequate policy responses. Echoing other studies, this report shows that irregular migration and counter-smuggling policy are often based on limited empirical data, drawn from similar if not identical stakeholders, and developed by a reduced and identifiable core of researchers (most of them, European and/or Europe-based). While this body of work has to a large extent expanded the understanding of smuggling, it has simultaneously privileged Euro-centric perspectives and law enforcement priorities at the expense of silencing the experiences (other than those involving victimisation and abuse) of the very people who rely on smugglers for their journeys. Chapter one examines how research has shown that while in most law enforcement, policy and academic circles the facilitation of irregular migration for profit is articulated as a crime, for most migrants the people behind their journeys merely facilitate a service of mobility, which may be in some instances illicit but not criminal, rooted in the lack of accessible, affordable, legal and safe paths for migration. These actors, commonly depicted in academic publications and research reports as heinously violent and predatory members of tribes or other ethnic and racialised groups, are quite often valued and well-respected people in communities across North Africa and the Sahel, trusted for the efficiency of their mobility, trade and transportation services. Known or depicted as smugglers in policy reports, these facilitators are quite often ordinary men and women, recognised for their contributions to the local economy, including the provision of mobility solutions for young and adult migrants unable to secure the protections afforded by passports or visas.

294. Facilitating Environmental Migration through Humanitarian and Labour Pathways: Recommendations for the UK Government

Abstract:
The impact of climate change, environmental degradation, and disasters on migration and human mobility is receiving more and more attention, by policymakers, academics, and the press alike. While there are gaps in the evidence base, much suggests that the vast majority of people will seek to move internally and regionally, rather than internationally. That being said, there are good reasons as to why high-income countries may want to facilitate so-called international “environmental migration” by adapting their existing legal and policy frameworks. This paper outlines how countries such as the United States of America (US), Canada, New Zealand, Australia, Japan, and various European countries have explored, created, or adapted their legal and policy frameworks to explicitly respond to international environmental migration, and the lessons learned therein. It concludes with a series of policy recommendations for the government of the United Kingdom of Great Britain and Northern Ireland (UK) as to how the UK could adapt their own legal and policy frameworks to better respond to international environmental migration.

295. A Pacific Skills Visa: Improving Opportunities for Skilled Migration Throughout the Pacific Region

Abstract:
The demand for skills exceeds supply, both within the Pacific Islands and the high-income countries of the Pacific Rim. Enhancing skilled migration therefore has the potential to generate large economic gains. The Global Skill Partnership is a migration model that can support such mutually beneficial mobility by moving training into the country of origin. In this paper, we outline its regional application to the Pacific. To assess the potential economic gains from such a Pacific Skills Partnership, we present new data on earnings and the cost of training in the Pacific Islands for three qualifications—accountants, computer science graduates, and chefs—and explore how such training could be financed through loan schemes. Graduates could be provided with internationally accredited qualifications and a new Pacific Skills Visa, facilitating their access to work opportunities abroad, particularly in the regions’ high-income countries. This Pacific Skills Partnership could bring large economic benefits to countries of origin, destination, and the migrants themselves.

297. Why Europe Should Build Legal Migration Pathways with Nigeria

Abstract:
The youth population within Nigeria is rapidly increasing, but despite their high levels of education and skills, many are struggling to find meaningful work opportunities at home. At the same time, Europe’s working-age population is declining, resulting in employers in these countries facing large and persistent skill shortages within a range of mid-skill professions. Despite the large benefits that facilitating migration between Nigeria and Europe could bring, and despite the overtures of both European governments and the European Union, few mutually beneficial migration partnerships exist. Over the last year, CGD has been working with the World Bank to understand how our Global Skill Partnership migration model could be implemented between Nigeria and Europe. The full results of this work have now been published in a new report, Expanding Legal Migration Pathways from Nigeria to Europe: From Brain Drain to Brain Gain. The report explores both why Nigeria and Europe should implement migration partnerships and develops a framework as to how they can do so. This framework is then applied to three sectors and partner countries: a healthcare partnership between Nigeria and the United Kingdom (UK), a construction partnership between Nigeria and Germany, and an ICT partnership with various European states. This brief focuses on the first part of this equation, the why: understanding the opportunity that lies before us to better link the labor markets of Nigeria and Europe and the innovation that could do just that.

Abstract:
In the often heated European policy debates over migration, conflict, lack of development, population growth, and climate change are often described as the ‘root causes’ that make people seek refuge and a better life in Europe. However, recent research-based literature on the links between migration and development stands in stark contrast to such simplified assumptions. This new DIIS Working Paper explores the relationship between migration, development, and foreign aid. It builds on insights from both quantitative and qualitative studies focusing on Africa – especially West Africa – and is divided into three parts. It first examines the factors that underpin human mobility, then looks at contemporary African migration trajectories, and finally discusses how migration relates to foreign aid. The paper shows that irregular migration to Europe is limited and a result of economic progress, rather than poverty or conflict alone, thus making foreign aid an ineffective instrument to curb it. Furthermore, the paper argues that foreign aid initiatives often focus on externally defined root causes of migration and rarely attempt to understand locally determined drivers of migration. To better grasp how development policies and migration intersect, more in-depth research is needed.

299. Governing climate mobility: Scoping study of two localities in Ghana

Abstract:
Climate change is expected by many to produce new and/or intensified mobility patterns, including migration and displacement. However, only limited research exists on the relationship between climate change and human mobility, specifically on the implications of increasingly intense slow-onset climate change, such as weather variability and extremes. This DIIS Working Paper provides initial data and analysis on climate, mobility and governance in Ghana as an input to the Governing Climate Mobility Research Programme. In parts of Ghana, temperature increases have now topped 1.5 ºC, weather patterns and seasons are shifting, and all of this is occurring on the backdrop of other environmental and agrarian changes. This paper documents such changes through multi-decadal analyses of temperatures and rainfall as well as vegetation change. However, it also links these changes, and how they are experienced locally, to existing governance and mobility dynamics in the programme’s case study areas in the Upper West Region and Eastern Region. For instance, the paper indicates how governance interventions, including failures, have affected agrarian livelihoods as seen in the deteriorating irrigation infrastructure in the Upper West Region, and how existing mobility patterns are linked to resource access and rural livelihoods. This working paper is a scoping study and therefore provides a detailed introduction to such environmental, socio-economic, governance and mobility dynamics in the study areas, as well as identifying key dynamics and possible linkages for further study. It builds on a previous GCM working paper that explores the historical linkages between climate, mobility and governance in Ghana.

Takahiro Yamamoto (University of Heidelberg) will present on “Identification documents and human mobility in the Japanese empire,” exploring how foreign diplomatic pressure and the need to surveil the mobility of colonial populations influenced the Japanese government’s border control policy. Martin Dusinberre (University of Zurich) will present a paper titled "The Archiving of Japanese Mobility in late-nineteenth century Queensland", analysing the history of Japanese migration to Australia under British colonial rule. Youjia Li (Harvard University) will focus on the role of human locomotive power in Japan's formal empire in her paper "The Unexpected Network: Push-car Railways and the Change of Local Mobility in Colonial Taiwan" . David Ambaras (North Carolina State University) will serve as discussant.
