21. More than a Wall: The Rise and Fall of US Asylum and Refugee Policy

Abstract:
This article uses a multidisciplinary approach — analyzing historical sources, refugee and asylum admissions data, legislative provisions, and public opinion data — to track the rise and fall of the US asylum and refugee policy. It shows that there has always been a political struggle between people who advocate for a generous refugee and asylum system and those who oppose it. Today, the flexible system of protecting refugees and asylees, established in 1980, is giving way to policies that weaponize them. It offers a historical analysis of US refugee and asylum policies, as well as xenophobic and nativist attitudes toward refugees. It places Trump administration refugee policies in three categories: those that abandon longstanding US legal principles and policies, most notably non-refoulement and due process; those that block the entry of refugees and asylees; and those that criminalize foreign nationals who attempt to seek asylum in the United States. The article concludes with an analysis of public opinion research to square the growing public support for refugees and asylees shown in polling data with the subgroup popularity of Donald Trump’s harsh xenophobic rhetoric and policies. These seemingly contradictory trends are consistent with research on right-wing populism. It argues that the restoration of generous humanitarian policies requires robust civic engagement and steadfast legislative efforts.

22. Working Together to Address Health Workforce Mobility in Europe

Abstract:
The free movement of people is a cornerstone of an open and integrated Europe. Yet the labor migration of Europeans from lower-income countries in southern and eastern Europe to higher-income countries in northern and western Europe has had significant impact on the workforce—including the loss of skilled health professionals in their most productive years. Indeed, since 1989, hundreds of thousands of European health professionals have left their countries of origin for more promising opportunities in the west and north. Denied opportunities for decent work at home, and recruited by countries facing their own labor shortages, their mobility is a byproduct of a failure throughout Europe to develop health workforces in an evidence-based and strategic way. Ultimately, this failure threatens the human right to health. This brief offers policymakers six key insights, drawn from a literature review and interviews with European experts, on the migration and mobility of health professionals. These insights are offered within a framework that prioritizes human rights, gender equality, and worker solidarity.

Seasonal worker programs represent one of the few ways in which low-skilled workers can migrate legally to the European Union, enabling them to work in sectors such as agriculture, hospitality, and tourism. Countries have taken different approaches to selecting seasonal workers, with some recruiting from within the European Union and others soliciting workers from third countries. But while some of these programs are long-established, they can struggle to meet labor demands swiftly while ensuring that workers are treated fairly and will return home when their permits expire. The European Commission has aimed to create common standards for seasonal workers’ admission, residence, and rights across Europe and to address longstanding issues such as worker exploitation, visa overstays, and hiring through the informal economy. As European policymakers take stock of these Commission-driven harmonization efforts to date, this brief by MPI Europe and the Research Unit of the Expert Council of German Foundations on Integration and Migration (SVR) explores some of the challenges common to these programs, drawing on examples in Europe, Australia, and New Zealand. It also highlights practices that can help maximize the benefits for migrants, employers, and countries of destination and origin alike. The authors sketch a number of principles to guide future reforms. Among them: prioritizing more transparent and standardized recruitment procedures, greater monitoring and outreach to protect seasonal workers, and strategies to help deliver on the thus far limited investments to support economic and social development in sending countries.

As COVID-19 spreads throughout the Middle East and civil wars continue, already fragile human rights protections are increasingly under threat. COVID-19 puts migrants and minority communities at increasing risk due to structural inequalities, and activist movements are losing crucial visibility and the ability to mobilize and gather in public. Meanwhile, the impacts of the virus expose existing injustices faced by detainees, women, and occupied communities. How are social movements in Lebanon, Iran, and Iraq adapting to changing dynamics as they confront pandemic-related shutdowns and existing internet restrictions? How do inequalities in the region’s legal systems prevent women from exercising personal rights, as domestic violence rates surge worldwide? The process of matching between firms and workers is an important mechanism in determining the distribution of wages. In a labor market characterised by large dispersion of workers' productivity and worker-firm complementarity, high quality firms have strong incentives to screen for the quality of workers. This process will increase the positive quality association of firm-worker matches known as positive assortative matching (PAM). Immigration in a local labor market, by increasing the variance of workers abilities, may drive stronger PAM between firms and workers. Using French matched employer-employee (DADS) data over the period 1995-2005 we document that positive supply-driven changes of immigrant workers in a district increased the strength of PAM. We then show that this association is consistent with causality, is quantitatively significant, and is associated with higher average productivity and firm profits, but also with higher wage dispersion. We also show that the increased degree of positive assortative matching is mainly reached by high-productive firms "losing" lower quality workers and "attracting" higher quality workers.

26. Mechanisms of Surplus Appropriation in the Informal Sector: A Case Study of Tribal Migrants in Ahmedabad’s Construction Industry

Abstract:
This paper is based on fieldwork I had undertaken regarding tribal migrant workers in the construction sector, in Ahmedabad in May-July 2018, coordinated by Aajevika Bureau(AB). I had undertaken this fieldwork to assess the work of AB and advise them about strategies to collectivize migrant labour groups. While interacting with a particular social group (Bhil tribals from South West Rajasthan) who work in the construction sector, I struggled to capture the specificity of their experience through the concept of informal labour. This paper is an attempt to characterize the specificity of their social experience, while also, reframing the concept of informal labour. I use the concept of labour process (Michael Burawoy: Manufacturing Consent) to argue that there is not a binary or one-dimensional power relationship between informal labour and owner/state/capital, but instead, the process of surplus appropriation occurs at multiple nodes through different agents. In this paper, I have identified multiple modes of surplus extraction which are embedded as institutions or social norms in the labour process. Further, I argue that there is a close link between the status of tribal workers as marginalized within society, and their status as displaced and marginalized in their living areas and workplace. This difference translates into identity based discrimination faced in the city, as well as, structural exclusion from the governance apparatus faced as migrants. Therefore, tribal migrant workers do not earn enough to subsist and are highly dependent on early child birth, non-remunerated services of their family and the social security net provided by their village community. This paper concludes that primitive accumulation, fragmenting land ownership and indebtedness creates a supply of tribal migrants, who have no other recourse to employment and are forced to work in the deplorable conditions found in the construction sector. Tribal migrant workers in the informal sector are an important population to target for social policies, because they are more vulnerable than other social identities. This paper hopes to contribute to the framing of interventions and policies that civil society organizations and state authorities can implement to improve the terms of employment and working conditions of informal labour.

29. Measuring the Spatial Misallocation of Labor: The Returns to India-Gulf Guest Work in a Natural Experiment

‘Guest workers’ earn higher wages overseas on temporary low-skill employment visas. This wage gap can be used to measure gaps in the productivity of workers due to where they are, not who they are. This paper estimates the effects of guest work on Indian applicants to a construction job in the United Arab Emirates, where an economic crisis allocated guest work opportunities as-good-as-randomly among several thousand families. Guest work raised the return to poor families' labor by a factor of four, with little evidence of systematic fraud.

30. Migrant Inventors and the Technological Advantage of Nations

Abstract:
We investigate the relationship between the presence of migrant inventors and the dynamics of innovation in the migrants’ receiving countries. We find that countries are 25 to 50 percent more likely to gain advantage in patenting in certain technologies given a twofold increase in the number of foreign inventors from other nations that specialize in those same technologies. For the average country in our sample this number corresponds to only 25 inventors and a standard deviation of 135. We deal with endogeneity concerns by using historical migration networks to instrument for stocks of migrant inventors. Our results generalize the evidence of previous studies that show how migrant inventors "import" knowledge from their home countries which translate into higher patenting. We complement our results with micro-evidence showing that migrant inventors are more prevalent in the first bulk of patents of a country in a given technology, as compared to patents filed at later stages. We interpret these results as tangible evidence of migrants facilitating the technology-specific diffusion of knowledge across nations.
