Abstract:
The United States Holocaust Memorial Museum’s Simon-Skjodt Center for the Prevention of Genocide released a report in November 2021, “To Make Us Slowly Disappear”: The Chinese Government’s Assault on the Uyghurs. The Chinese government’s attacks on the Uyghur community are alarming in scale and severity. The report expresses the Museum’s grave concern that the Chinese government may be committing genocide against the Uyghurs, a Muslim community in the Xinjiang Uyghur Autonomous Region of northwest China. The report also details multiple crimes against humanity that the Chinese government is committing against the Uyghur population. These crimes include forced sterilization, sexual violence, enslavement, torture, forcible transfer, persecution, and imprisonment or other severe deprivation of physical liberty. The Museum’s findings, based on publicly available information, demonstrate that China is failing to uphold its responsibility to protect its citizens from genocide and crimes against humanity. The Chinese government must halt its attacks on the Uyghur people and allow independent international monitors to investigate and ensure that the crimes have stopped. The seriousness of the assault on the Uyghur population demands the immediate response of the international community to protect the victims.

52. Protecting Women from Intimate Partner Homicide in Post-Conflict Societies: Policy Options for Rwanda

This policy briefing note addresses the challenges and opportunities for identifying women victims of intimate partner violence (IPV) who are at an increased risk of being killed by their partners. It is based on the findings of an APN-supported research project and makes specific recommendations aimed at reducing the rate of intimate partner homicide (IPH) against women in Rwanda. During the genocide against Tutsis, rape was used as a weapon against Tutsi women to humiliate and destroy the targeted group.1 The 2003 Consti- tution of the Republic of Rwanda amended in 2015 marked the turning point for gender equality in the country by putting in place provisions, policies, and programs to increase women’s role in socioeconomic reconstruction. Among other actions, it reserved 24 out of 80 seats in parliament exclusively for women representatives. Rwanda is one of the African countries that domestically implemented UN Resolution 1325 on Women, Peace, and Security (WPS). Regarding this agenda’s call for the abolition of gender-based violence (GBV) in all its forms, the government of Rwanda ratified Law No. 59/2008 on Prevention and Punishment of Gender-Based Violence, which was reinforced by Law No. 68/2018 of 30/08/2018 on Determining Offences and Penalties in General, and the Organic Law No. 01/2012/OL of 02/05/2012, which instituted the penal code for marital rape, forced marriage, child defile- ment, and human trafficking. Subsequently, institutions and programs were established for preventing GBV and providing integrated medical, psychological, and legal services to victims of GBV. Over the past years, Rwanda has made important prog- ress toward gender equality and heightened awareness of GBV, which has resulted in an increase in the reporting of cases of GBV. However, given that IPV in some cases leads to homicide, it continues to pose a major challenge. This brief is based on an adaptation of the Danger Assessment Instrument (DA-20), which measures the risk of IPH in Rwanda for women who have already experienced intimate partner violence. After adaptation, a version of DA-25 has been developed for the Rwan- dan context and its predictive validity has been tested on a sample of 424 women living in the northern region of Rwanda who responded to two scales: Woman Abuse Screening Tool (WAS-8 short scale), which assesses IPV, and DA-25.

International legal scholarship and practice have reached a point where it is undisputed that the prohibition of genocide has the status of jus cogens and entails erga omnes obligations. It is, however, astonishing how little academic focus has been dedicated to the normative development leading to this extraordinary rank. In a legal regime with as little hierarchical structure as public international law, examining the birth process of such a norm promises considerable insights into normative formation in general and may inform jurisprudential theories on the nature of international law. This article illustrates the evolution of the prohibition of genocide by outlining the way to the 1948 UN Genocide Convention and the later interpretations of the norm. It traces the origin of the genocide prohibition to naturalistic ideas of overarching laws of humanity in international law and follows its development into the early 21st century. An analysis of international jurisprudence reveals that, after the jus cogens status of the prohibition of genocide and its erga omnes dimension had been settled, international judges handled the norm in a surprisingly lackadaisical and perfunctory manner. The very recent ICJ order on provisional measures in the Myanmar Genocide case potentially marks a return towards a deeper focus on moral facts determining the prohibition that point to naturalistic theories persisting, notwithstanding the positivistic mainstream approaches to international law. The article contributes to a more accurate picture of and greater academic interest in these naturalistic undercurrents.

Abstract:
The policy of repression of Uyghurs in Xinjiang has become a significant element of criticism of China in the world. In March this year, the EU, U.S., Canada, and the United Kingdom imposed sanctions on China over the matter. Moreover, the Netherlands, the U.S. and Canada described China’s actions as genocide. For China, however, its actions involving Uyghurs are a key element of domestic politics, which is why it presents accusations as disinformation. It has imposed counter sanctions, including on the EU, and their wide scope indicates that for China, Xinjiang is more important than, for example, the ratification of the Comprehensive Investment Agreement (CAI) with the EU.

This year marks the 30th anniversary of the Paris Peace Agreement on Cambodia. That accord closed the door on years of war, during which the Khmer Rouge “Killing Fields” caused the deaths of up to two million persons (out of a population of seven million) and brought the 1,000-year- old civilization to the point of obliteration. When I landed in Phnom Penh in 1996 to begin my term as U.S. Ambassador, the country was in the fifth year of implementing that 1991 agreement. Looking back on this improbable diplomatic success offers a chance to assess the effectiveness of American diplomacy in the 1990s, and how, despite one extremely unfortunate regression, Indochina and Southeast Asia were irrevocably changed by that accord.

Abstract:
The world is observing one of the worst humanitarian crises of this century: the Uyghur genocide, a colonial project that uses modern surveillance and widespread concentration camp apparatuses. At the heart of this genocide is a fundamental “otherization” of the Uyghur people that relies on Islamophobic policy and rhetoric to dehumanize the indigenous population of East Turkistan, known to China as Xinjiang. The Chinese Communist Party (CCP) employs Islamophobia to over-police Muslim populations and curtail their civil liber- ties. Islamophobic rhetoric has also driven surges in hate crimes against Muslim communities. The United Nations notes that this trend continues today as Is- lamophobic incidents continue to rise globally.1 The genocide in East Turkistan is the defining human rights atrocity of the twenty-first century thus far. The CCP has remolded a global trend of Islamophobia to fit their own needs—a new chapter in a horrific history. Though the motivations of the Chinese state in East Turkistan are varied, economic gain, cultural unification, and national consolidation all rank highly. Specific policies targeting the practice of Islam have allowed for a brutal crackdown on cultural norms in the region. Meanwhile, a global trend toward Islamophobia has given the genocide some political cover in the global sphere.

Abstract:
The Chinese government’s treatment of the Uyghurs has gone from a relatively obscure issue in the international press to a central one. It has become the subject of discussion and policymaking in the halls of governments around the world and has gained widespread awareness among the general public. This is because Uyghurs are subject to some of the worst human rights abuses in the world; in many respects, their treatment meets the accepted definition of geno- cide. The fact that these abuses are being perpetrated in the People’s Republic of China (PRC), a nation widely expected to have a major role in shaping the twenty-first century, has contributed to the urgency of the issue. The Uyghur community has welcomed the long overdue response from some governments. An increasing number of parliaments have condemned the Chinese government’s actions as genocide, and some are developing legislation aimed at addressing issues such as forced labor in the supply chain and transnational repression di- rected at Uyghurs living abroad. Although the Chinese government denounces these as attempts to meddle in their internal affairs, the repression of Uyghurs has a global dimension that requires a global response.

The Rwandan experience accomplished a success in dealing with conflicts, making an example for countries that are suffering from civil wars, internal divisions, or armed conflicts now. It demonstrates the ability to rebuild a modern state if an actual willingness is available in spite of the existence of tremendous historical epic violence, oppression or armed conflict. Since the beginning of the nineties, Rwanda has been the scene of the most horrific genocidal wars which caused nearly a million lives of people to be gone. These crimes prompted the resignation of President Bisi Mongo, who was unable to control the country after it plunged into chaos. As a result, a civil war broke out in Rwanda between the government and the Rwandan Patriotic Front. The Hutu majority confronted the Tutsi minority. Their conflict continued until the outbreak of a three-month genocidal war. The massacres, which occurred during the conflict period, are considered the fourth largest genocide in the modern history.

59. International responses to the Rohingya crisis in Myanmar: From political inaction to growing legal pressure

Abstract:
In December 2019, Myanmar defended itself before the International Court of Justice against genocide charges for the atrocities committed in 2016–2017 against the Rohingya Muslims. The Rohingya crisis has driven several hundreds of thousands of the Rohingya as refugees into neighbouring Bangladesh with an unsettled future. In addition, questions of perpetrator accountability remain open. The UN Human Rights Council created a fact-finding mission and an international investigative mechanism for the purpose of bringing the individuals responsible to justice. With Western states generally condemning Myanmar’s actions, China’s influence in and over Myanmar has intensified, as the country has blocked robust action before the UN Security Council, leading to charges of political inaction. There is growing legal pressure against Myanmar at the national and international level, forcing it to respond. While accountability proceedings are important, problems may emerge when several courts deal with the same situation. Their capacity to provide immediate relief in relation to the crisis is also small.

Abstract:
The terms “primary”, “mid-level” and “lower level” are employed to qualify perpetrators of mass atrocities, based on the magnitude of guilt and criminal responsibility. Could this classification be a misnomer? Could the relationship among perpetrators, or the roles they assume be more intricate, warranting a reassessment of the existing hierarchy? This paper explores the need to be more circumspect in penning perpetrators in categories, especially in complex scenarios of mass atrocity. To do so, the Non-Solitarist View of Human Identity and Framing Theory are used to explore the matter, with a focus on perpetrators of the Khmer Rouge era.
