Abstract:
Following the announcement of hosting an international summit on February 13 and 14, 2019, Iran has launched a diplomatic offensive against Poland, where one of the conference main elements will be how to respond to the Iranian interventions in the region. In addition, Iran has also begun to take preemptive moves both to send messages to the powers concerned with the repercussions of those interventions and to tout its ability to contain the pressures of US policy. These moves include attempts to pivot to the East, particularly towards some neighboring countries, and hints at its ability to withdraw from the nuclear deal and resume its suspicious program again.

242. Competing with Whom? European Tax Competition, the “Great Fragmentation of the Firm,” and Varieties of FDI Attraction Profiles

Abstract:
International tax competition is generally framed as states competing for foreign direct invest- ment (FDI), and analyses of the phenomenon draw heavily on FDI statistics. In and of themselves, however, FDI statistics are merely a quantification of the value of investment projects and tell us little about the heterogeneity of these projects and the distinct patterns of competitive dynamics between countries they generate. In this paper, we create a more sophisticated understanding of international tax competition by pointing out its variegated nature. To do so, we introduce the notion of the “great fragmentation of the firm” to distinguish between five categories of FDI: manufacturing affiliates, shared service centers, research and development facilities, intermedi- ate holding companies, and top holding companies. Using a novel combination of firm-level and country-level data, we identify for each category of FDI which European Union member states are most successful in attracting it, what macro-institutional and tax arrangements they rely on for doing so, and what benefits they receive from it in terms of tax revenues and employment creation. In this way we were able to identify five distinct FDI attraction profiles and show that, rather than being a game of all against all, tax competition in the European Union increasingly takes place amongst subsets of countries that compete for similar categories of FDI.

243. Ways out of Europe’s Syria Reconstruction Conundrum

Rebuilding war-torn Syria poses a formidable challenge for European governments, which are unwilling to legitimise the Damascus regime by funding reconstruction. Instead, the EU and its member states could consider bankrolling small projects without regime involvement and testing an approach that trades aid for reforms. What’s new? The Syrian war is drawing to a close, but whether the regime in Damascus can also win the peace is uncertain. Few appear willing or able to invest significantly in reconstruction, and Europe, which could make substantial funds available, is withholding support absent a genuine political transition. Why does it matter? Without reconstruction, Syrians’ living conditions could deteriorate and leave the country’s recovery indefinitely postponed, perpetuating current instability. Yet many European leaders believe reconstruction support without substantial reforms could have a similar effect, empowering a regime intent on repression, not reconciliation. What should be done? Europe should consider supporting small-scale rehabilitation projects on condition of no regime interference. It could also test an incremental incentives-based approach – a progressive lifting of sanctions, gradual normalisation of relations and staggered disbursement of reconstruction funds – in exchange for political reforms and regime steps to ease repressive and discriminatory practices.

244. Hybrid Threats in EaP Countries: Building a Common Response

Four non-governmental organisations from Georgia, Moldova, Armenia and Ukraine conducted a joint study assessing hybrid threats that the EaP countries are currently facing. The project aimed to study the hybrid threats which affect Eastern Partnership states and elaborate recommendations to actively engage civil society in countering them. The project envisaged the creation of a team of experts from Georgia, Moldova, Armenia and Ukraine, which would travel to the capital cities of the mentioned states and meet all relevant stakeholders from government, parliament and civil society. The meetings resulted in the collection of all necessary information, opinions and ideas on the state of institutional and legal measures taken in the countries on countering existing hybrid threats. The team of experts also undertook desk research based on accessible open sources and interviews conducted with different stakeholders, among them government officials, experts and civil society organizations. The research and study visits provided the ground for four country reviews to be written by the experts. Their reports have been integrated mutatis mutandis into the present policy paper, followed by a comparative analysis of threats and institutional responses, similarities and distinctions in the policies of the four mentioned countries. The paper also explores the role and areas of potential engagement of civil society. To effectively counter the hybrid threats, a joining of efforts of official bodies and non-state actors is required. It also needs reinforced international cooperation on a government and civil society level. The paper recommends the governments establish active cooperation among and with the EU countries with the aim of analyzing, exchanging knowledge and countering jointly, where appropriate, hybrid threats. The cooperation should target the development of an appropriate legal environment and adequate institutional capacity. Civil society itself should become more organized and consolidated. The paper advises the EaP CSF to conduct work on consolidating the efforts of civil society in the direction of strengthening the resilience of EaP countries, especially in countering attacks aiming to discredit and weaken the Europeanisation of the mentioned countries. It was advised that the EaP CSF contribute to facilitating the capacity building of civil society organizations so as to help them to actively engage in countering hybrid threats. Despite the existing differences between EaP partner states as regards their foreign policy priorities and geopolitical orientation or trade arrangement, all of them seek closer cooperation with the European Union, peaceful co-existence, and the chance to develop efficient economic ties within the wider region. Continuation of Europeanisation and interaction with EU institutions, supporting democratic transformation, economic and regulatory convergence, social cohesion and human capital development, institutional and state build up, has become irreversible thanks to the success of the EaP. The sources of the new hybrid threats predominantly aim at discrediting and weakening the motivation of the EaP partner states to further integrate with the EU. Indeed, EaP partner states understand the importance of this cooperation and are interested in countering, jointly where possible, any adverse action or attempt to disengage them from that process. Based on the results of the study, we propose a set of recommendations for the governments of EaP states, EU and NATO institutions and their member states.

Abstract:
The objective of the project, in the framework of which this policy paper was developed, is to promote the wider involvement of civil society in the policy area that can and should benefit from a multi-stakeholder approach through all stages of the policy cycle in the upcoming period in order to maximize the impact of joint actions and activities. The paper has an ambition to advise on how civil society should and could be involved in formulating, implementing and monitoring the future deliverables in the area of hybrid threats in the post-2020 Road Map for the EaP policy, including developing specific deliverables with concrete benchmarks for individual countries in a regional perspective. The paper feeds directly into the debate on the new EaP Road Map and structured consultation opened by the EU institutions, and builds directly on the recommendations from the EaP CSF policy paper "Advancing Eastern Partnership: 23 Civil Society Ideas for the Policy beyond 2020". It will be distributed to its target audience in Brussels, EU member states and EaP countries. Further advocacy and discussion with stakeholders in Brussels is planned during the 11th EaP CSF Annual Assembly on December 6, 2019. The paper is a result of the joint research conducted by a team of experts representing CSOs from all six EaP partner states. The team conducted desk research and held consultations with stakeholders and experts in their respective countries. Each of them contributed to country reports and proposed recommendations for the development of cooperation on prevention and countering hybrid threats throughout the EaP area. The findings of the study covered the comparative analysis of hybrid threats in EaP countries, the response of the governments, cooperation between EU and EaP countries on countering hybrid threats, civil society engagement and, finally, the suggestions on the development of cooperation between EU and EaP partner states. The research resulted in concrete recommendations for the governments of the respective countries, EU institutions and member states and for civil society, which is advised to intensify its engagement in countering hybrid threats and in developing a common response.

Abstract:
Since 2016, concern over the resurgence of illiberal populist political parties and movements has been palpable in Europe and the United States. The election of Donald Trump, the United Kingdom’s referendum to leave the European Union, and the electoral advances of far-right parties in many European states, including France and Germany, created the sense that populist parties were a new, unstoppable political force in democratic politics.1 Yet in 2019, the notion that populist parties are the future of European politics seems far less certain. The term “populism” itself may have outlived its usefulness. Originally, it referred to parties and leaders who described themselves as true voices of the people against self-serving, out-of-touch elites—and it was prone to run roughshod over established political norms and institutions. Over the past three years, differences in approaches, tactics, and outlooks between different populist parties have emerged, making it clear that there is no clear populist governing strategy. Accordingly, beyond disrupting the current order, anti-establishment political forces in Europe share no actual transnational policy agenda. Yet populist and anti-establishment forces have upended European politics and contributed to fragmentation and uncertainty. As the example of the record turnout in the 2019 European parliamentary election illustrates,2 the EU itself has become an important dividing line for voters. The high turnout and raucous nature of the 2019 election portends animated debates over European policies. Gone are the days when the EU could move initiatives forward without much public attention or concern. In short, Jean Monnet’s “salami-slicing” method of incremental, technocratically driven European integration3 is dead. A more engaged and aware European public is in itself a positive development. Yet simultaneously, for better or worse, the sudden salience of European policies can present an obstacle to policy initiatives that otherwise would be seen as uncontroversial. Just as partisan divisions in the United States have plagued Washington with significant policy paralysis, the emergence of a similarly contentious and partisan politics in Europe may make it hard for Brussels to act. Europe has proven resilient over the past decade, but that resilience should not be taken for granted. The EU largely has failed to address its structural weaknesses that were exposed following the 2008 financial and fiscal crisis, meaning that the EU would confront a future economic crisis with the same limited toolbox it had in 2008.4 To make matters worse, influential populist actors could also obstruct swift action while benefiting politically at home from the EU’s failings. Unlike only a few years ago, fears of the EU’s sudden unraveling seem farfetched. Yet a protracted death by a thousand cuts, caused by populist leaders undermining EU rules and norms, remains a distinct possibility. The new instability of European politics poses a real challenge to the trans-Atlantic alliance. Unity among free and democratic states of the West is hard to sustain in the current political environment on both sides of the Atlantic. Yet at a time when the alliance faces a rising challenge from autocratic powers such as China and Russia, the case for unity and cooperation is stronger now than at any point since the end of the Cold War. This report seeks to chart a course for the EU and for the trans-Atlantic alliance, while acknowledging that the anti-establishment sentiments that reverberate through European politics are here to stay. While there is a strong case to be made for a Europe that works together to defend democratic values at home and abroad as well as a trans-Atlantic alliance that is willing to work in proactive partnership to tackle big global challenges—from climate change to terrorism to nuclear proliferation—that goal is still a long way off.

Abstract:
70 years ago Bulgaria and the Peope’s Republic of China (PRC) established diplomatic relations. As a small country we are proud to be among the first that recognized the new great state and to have a record of long and constructive relations throughout this period. Despite the differences in the socio-political systems the bilateral relations of our countries are at its peak. The PRC is a key partner of both Bulgaria and the European Union (EU), to which my country belongs. I am personally grateful to the organizers of the high-level symposium for this first visit of mine to understand the sagacity of a Chinese proverb, I paraphraze, it is better to see something once than read about it one hundred times. China proved – and this is a lesson for all, that direct copying of experience and models of development of other countries may lead to nowhere. A methodological lesson in statecraft given by China from the end of the 70s of the last century till nowdays is that thinking big and whole while recognizing the truth in the facts of life, opening to the rest of the world and persistently reforming in a strategically chosen direction is the right way to success. The ability to take the best from the experience and wisdom of the past, sincerely seeking to share the achievements of mankind is a Chinese accomplishment that deserves to be studied by present and future politicians, including in my part of the world.

248. From Joining to Leaving: Domestic Law’s Role in the International Legal Validity of Treaty Withdrawal

If a state withdraws from a treaty in a manner that violates its own domestic law, will this withdrawal take effect in international law? The decisions to join and withdraw from treaties are both aspects of the state’s treaty-making capacity. Logically, international law must therefore consider the relationship between domestic and international rules on states’ treaty consent both in relation to treaty entry and exit. However, while international law provides a role for domestic legal requirements in the international validity of a state’s consent when joining a treaty, it is silent on this question in relation to treaty withdrawal. Further, there has been little scholarly or judicial consideration of this question. This contribution addresses this gap. Given recent controversies concerning treaty withdrawal – including the United Kingdom’s exit from the European Union, South Africa’s possible withdrawal from the International Criminal Court, and the threatened US denunciation of the Paris Agreement – and the principles underlying this body of law, it is proposed that the law of treaties should be interpreted so as to develop international legal recognition for domestic rules on treaty withdrawal equivalent to that when states join treaties, such that a manifest violation of domestic law may invalidate a state’s treaty withdrawal in international law.

Abstract:
This article examines the European Union’s (EU) treaty practice from the perspective of the international law of treaties, focusing on its most significant examples. The starting point is the EU’s attitude towards the codification of treaty law involving states and international organizations. The article discusses certain terminological specificities and a few remarkable aspects, such as the frequent use of provisional application mechanisms as opposed to much less use of reservations, the contributions regarding treaty interpretation, the wide variety of clauses and the difficulties in determining the legal nature of certain texts. The study underlines that treaty law is a useful instrument for the Union and is further enriched with creative contributions; the outcome is a fruitful relationship.
