141. Mobilizing Political Will for Refugee Protection and Solutions: A Framework for Analysis and Action

Abstract:
Many commentators have suggested that the displacement of people across international borders is caused by a lack of “political will,” and that refugee situations could be averted, mitigated or resolved if only such will existed. However, there has been little serious analysis as to what “political will” means and how to generate and sustain it in a refugee context. This paper is an initial attempt to address these neglected issues. It begins by defining the notion of political will and then outlines the gap between the protection principles formally espoused by states and the ways in which they treat refugees and asylum seekers in practice. The paper then identifies the key ways in which political will can be mobilized on behalf of refugee protection and solutions, focusing on the humanitarian interests of political leaders, the obligations that states have assumed in relation to refugees, the incentives that can be used to encourage compliance with refugee protection principles and the pressure that can be placed on states by other stakeholders. Following an examination of interstate cooperation on refugee issues and the role of the UN Refugee Agency in promoting refugee protection and solutions, the paper concludes with a call for political will to be mobilized in a way that is evidence-based, geographically differentiated, inclusive of other actors, and sensitive to the situation of other people who are on the move and whose rights are also at risk.

Abstract:
As the Syrian refugee crisis enters its eighth year, leveraging the private sector’s financial capital and capacity for innovation has emerged as an attractive solution to protracted displacement. But little evidence exists on the feasibility and effectiveness of this approach. This case study highlights a unique type of private-sector engagement in which mainstream business interests align with the needs of refugees and host communities. The IKEA–Jordan River Foundation (JRF) partnership demonstrates how diverse stakeholders can identify synergies, overcome legal and practical barriers, and sustain collaborations through effective management structures.

Abstract:
With the global displaced population exceeding 68 million, the global humanitarian response system is under unprecedented stress. With widening funding gaps and no resolution in sight, new solutions are needed to address the needs of over 68 million displaced people worldwide. The private sector’s innovative and financial capacity is emerging as one such avenue, resulting in dozens of partnerships with local and international nonprofits. Depending on local policy environments, such working arrangements create both opportunities and risks for partners and hosts. This report is an attempt to learn lessons from existing experiences and offer insights on what works under given circumstances. Through desk research on existing partnerships, semistructured interviews with key stakeholders, site visits with partners in Jordan and Uganda, expert roundtables, and public discussions, we gather insights on both conceptual and practical aspects of partnerships benefiting refugees. We introduce a conceptual framework on the variety of options available to partners and offer recommendations for organizing win-win partnerships in the future.

145. Displacement-Emigration-Return: Understanding Uncertainty in Iraq

Following the Islamic State’s (IS) occupation of Iraqi territories in June 2014 more than 3 million internally displaced persons (IDPs) fled their homes in search for a secure place. Of these, around 1,3 million found refuge in the Kurdistan Region of Iraq (KRI). In parallel to new waves of displacement, Iraqis were also choosing to migrate abroad. In 2015, Iraqis were among the top three nationalities reaching Europe through the Mediterranean routes, after Syrians and Afghans (UNHCR 2016b, 34). Besides displacement and emigration, a large number of IDPs have returned to their place of origin since 2017. As the process intensifies, the security, political and economic conditions of the liberated areas still remain unstable and unpredictable. This report provides policy recommendations based on the results of the research study titled “Drivers for onward migration: the case of Iraqi IDPs in the Kurdistan Region leaving Iraq”, which was conducted between May and November 2017. In it, we addressed the questions: what mechanisms are responsible for explaining why IDPs living in the KRI want to either stay, emigrate or return to their places of origin? and what are the relationships between displacement, emigration and return in the context of Iraq? To address these questions, we employed both quantitative and qualitative analyses methods including: (a) evaluating 500 questionnaires distributed among IDPs in the KRI (Erbil, Duhok and Suleimaniyah governorates) between May and June 2017; (b) conducting 30 semi-structured interviews with IDPs in the KRI between June and July 2017, and (c) discussing preliminary results of the study during a workshop in Erbil on 23 July 2017 with local, national and international actors, including governmental and non-governmental organizations. The data indicates that, although slightly more than half of the sample wish/plan to leave Iraq (55%), only a minority of the subjects (23%) actually developed a concrete plan to do so. Emigration was most appealing to those ages 26–35 and among those with no or low levels of education. Moreover, Yazidis and Christians were more represented among those who wished or planned to leave Iraq. In addition, the most important pull factors point to the presence of family/relatives and friends along with the confidence of receiving refugee status upon arrival. Ultimately, IDPs perceptions of insecurity and lack of economic opportunities appear to be the most compelling reasons driving their wish/plan to emigrate. The data also suggests that IDPs’ perceptions towards the future political, economic and security situations in Iraq (expressed in the next five years) is the most relevant factor determining people’s emigration decision: within an overall negative assessment of the future of Iraq, IDPs wishing or planning to emigrate held a more pessimistic view compared to those who wanted to return or stay in displacement. Conversely, the study finds that socio-political (i.e., relations between IDPs and hosting communities) and socio-economic (i.e., income level and employment status) factors are less significant in determining IDPs’ wish/plan to leave the country. Where socio-political and socio-economic factors do not directly influence IDPs’ intentions, they however, contribute to a distressing sense of uncertainty prevalent among IDPs. Political, social and economic uncertainty overarchingly influences displacement, emigration and return in and from Iraq. Additionally, the Government of Iraq (GoI) and the Kurdistan Regional Government (KRG) have not been capable of (or willing to) address such uncertainty. Rather, they have contributed to a governance of uncertainty best illustrated by the absence of a comprehensive framework for managing displacement and return in both the KRI and greater federal Iraq. In response, this study calls for the development of robust policies at the international, national and local levels which: a. Consider displacement in Iraq as a chronic condition versus a sudden crisis; b. Recognize how recurrent, protracted and unresolved displacement waves destabilize the region; c. Appreciate displacement as a diversified phenomenon. These findings stress the destabilizing and traumatic effects of displacement and the urgency of addressing them, thus, we recommend the following prioritized policy areas through which international, regional, national and local actors can contribute to solve, or at least mitigate, the negative impact of displacement: 1. Elaborate and implement a national policy framework for displacement capable of addressing its multiple manifestations; 2. Adopt facilitation (without active encouragement) measures that can decrease the prevalent uncertainty among the population; 3. Include displacement in the broader physical and social reconstruction plan for Iraq. The data for this report was collected in Spring/Summer 2017, and thus, describes a scenario that has changed following the events that took place in September and October 2017 (see Section 3). However, the findings and recommendations that the study identified appear as relevant today as they were pre- Referendum. The second Development Champions Forum of the “Rethinking Yemen’s Economy” initiative recently brought together more than 20 of the leading socio-economic experts on Yemen to discuss the most critical challenges facing the country. Among the key topics included were the need to increase the coverage and efficiency of the campaign international humanitarian organizations and United Nations agencies are undertaking to address Yemen’s humanitarian crisis. Among the major issues the Development Champions identified during discussions were: The need for international humanitarian actors to increase their coordination with local authorities, civil society actors, and the Yemeni private sector; The importance of decentralizing the humanitarian response and the many benefits of prioritising cash transfers to beneficiaries over the direct provision of food stuffs; and The importance of prioritising assistance to the most vulnerable populations, in particular internally displaced peoples. The Development Champions also proposed various policy recommendations for international humanitarian actors, the Government of Yemen, the de facto authorities in various parts of the country, as well as Saudi-led military coalition member states and the international community; these recommendations are discussed below.

Between 2015 and 2017, Australia provided 12,000 resettlement places for refugees fleeing conflict in Syria and Iraq. This special humanitarian intake was an ad hoc, one-off response to international and domestic pressure on the Australian government and reflects similar pledges made by other States to admit Syrian refugees. While Australia’s Syria–Iraq special intake provided invaluable protection for refugees fleeing one of the world’s major humanitarian crises, it raises a number of questions regarding fairness, transparency and efficiency in its implementation. In the context of growing numbers of displaced people worldwide, the Syrian crisis will not be the last situation involving widespread displacement and requiring international cooperation to ensure the protection of refugees. Indeed, the current predicament of large numbers of refugees in places such as Kenya, Bangladesh and the Central Mediterranean also requires stronger responses and support from the international community. This Policy Brief critically analyses special humanitarian intakes from an international and comparative perspective. It examines the normative frameworks applicable to special humanitarian intakes, both in Australia and elsewhere, including international refugee and human rights law, the United Nations High Commissioner for Refugees (UNHCR) global resettlement program, and Australian domestic law. It considers how the Syria–Iraq special intake compares to other similar, one-off arrangements for the relocation and/or resettlement of refugees, such as the Comprehensive Plan of Action for Indo-Chinese refugees in the 1970s and 1980s, the humanitarian evacuation of Kosovar refugees in 1999, and the use of individual emergency and urgent resettlement quotas by States such as Sweden and Canada.

Abstract:
This report summarizes the findings of new research on the impact of violent conflict on civil society organizations (CSOs) and the implications for international actors who partner with them. It finds that local CSOs working in violent conflict settings are more important than ever, as they are at the forefront in responding to the needs of the millions of civilians caught up in violent conflict around the world. Where international actors struggle to get access to contested territories and rely on national or local CSOs to reach conflict-affected communities, partnerships allow life-saving resources to reach the people who need them most. And as commitments to localization grow, international funding flows to CSOs are set to increase. Yet this study finds that international actors often fail to understand the highly politicized and insecure environments they operate in and do not do enough to support and strengthen the CSOs with whom they work.

Climate change is already forcing people from their land and homes, and putting many more at risk of displacement in the future. Supercharged storms, more intense droughts, rising seas and other impacts of climate change all magnify existing vulnerabilities and the likelihood of displacement – disproportionately affecting low-income countries, women, children and Indigenous peoples. This paper describes the effects on communities and how responding to these growing realities demands far stronger action towards ending global climate pollution, supporting resilient communities, ensuring rights for people on the move and developing long-term strategies to ensure that those who are forced to move in the future are able to do so safely and with dignity.

Abstract:
Since 25 August 2017, the Cox’s Bazar and Bandarban districts in the south-east of Bangladesh have seen a mass influx of Rohingya refugees fleeing violence in Rakhine State in Myanmar. To inform programming and the wider humanitarian response, Oxfam undertook a rapid food security, markets and protection assessment in November 2017. This was done to complement a large-scale WASH response launched in early September 2017 at the onset of the displacement from Myanmar.
