51. The European China Strategy to Enhance Economic Security

Abstract:
The recent strategy change of the European countries toward China has identifiable triggering factors such as the continuation of high growth in the Chinese economy, rising status of China in the international community, and China’s FDI expansion. The West has criticized the Chinese Communist Party’s dealing with human rights issues and media control, which was further aggravated by China’s pro-Russian stance upon the outbreak of the Russian-Ukrainian war. Eventually, the European countries responded with confrontational strategies against China. This study analyzes these recent de-risking methods of the EU and four European countries – i.e., Germany, France, United Kingdom, and Poland – regarding economic relations with China. Finally, the Brief concludes with an assessment of the impact of the recent changes in Europe’s China strategy on Korea and policy recommendations.

Abstract:
The rule of law is one of the most important, if not the most important, constitutional principles. It has been a philosophical concept since the time of the Greek philosophers or even before. For the English jurists, the rule of law encompasses two central principles, which are the supremacy of law and equality before law. However, the British showed no concern for upholding it during the era of colonization. In Pakistan, the principles of supremacy of law and equality before law were incorporated into the Constitution. The Pakistani Superior Courts have widened the scope of these two principles in their decisions. However, in reality, such principles as enunciated by the Judiciary are not actually implemented in true letter and spirit.

Abstract:
After the territorial defeat of the Islamic State of Iraq and Syria (ISIS) thousands of women and children who were associated with ISIS have been interned and detained in various camps in northeast Syria. The present article analyses the story of Ms Shamima Begum, a British teenager who, in 2015, was groomed and trafficked to Syria to marry an ISIS fighter and the case of thousands of foreign children, who are currently detained indefinitely, for their perceived links with the terrorist organisation. The investigation will be carried through the lens of international law by exploring whether the tenets of children’s and human rights have been side-lined in favour of short- term security concerns, possibly buoyed by practices of discrimination.

Abstract:
The consideration of education as a social right, a human right, and a factor of social development offer possibilities for effective responses in terms of democratization, equality, and equity to the controversial socio-cultural and socio-economic effects and consequences of the digitization and platformisation of current societies. The scope of this article is the evaluation of Latin American critical edu-communication as a transformative and institutive instrument of practices that, through the integration of digital literacy with dialogic and conscientization strategies, open spaces of democratization and protection of human rights in a context characterized by strong inequalities and the digital divide. In this sense, the analysis through a qualitative methodology of a pilot case study makes it possible to offer necessary suggestions to promote digital media education strategies and the democratization of education.

Abstract:
Children with disabilities are often more prone to abuse in Pakistan. This article is based on a qualitative study using formal interviews as a data collection tool. The participants were asked about their perspective on the current practices of protecting children in schools, especially those with disabilities, and how to improve the system for safeguarding the Children to Learn Initiative. The research found that a right-based, systematic approach needs to be taken to improve school systems for the protection of children with disabilities against abuse and neglect, where attention is paid to prevention, response strengthening, and overall management and referral systems.

Abstract:
In May 2024, during President Xi Jinping’s visit to Serbia, President Aleksandar Vučić signed 28 agreements with China, including a controversial extradition treaty. This treaty raises concerns about potential human rights violations, particularly for Chinese dissidents, as it follows the European Court of Human Rights’ precedent in Liu vs. Poland, which cited risks of ill-treatment in the Chinese prison system. The agreement highlights Serbia’s strategic alignment with China, emphasizing mutual legal cooperation and Chinese investments, despite past human rights scandals involving Chinese companies in Serbia. This development challenges Serbia’s commitments to the European Convention on Human Rights and complicates its EU accession prospects. In May 2024, Chinese President Xi Jinping visited Serbia, France, and Hungary to advance Chinese interests in Europe. Serbia, under President Aleksandar Vučić, signed 28 agreements with China, including a contentious extradition treaty. This extradition agreement potentially undermines human rights protections in Serbia, echoing concerns raised by the European Court of Human Rights in the Liu vs. Poland case regarding risks of ill-treatment in Chinese prisons. The treaty may facilitate the extradition of Chinese dissidents and political refugees, aligning with Beijing’s efforts to control overseas Chinese populations through legal and police cooperation. Serbia has strengthened its partnership with China, evidenced by joint police patrols and surveillance initiatives, and has become a significant hub for the Chinese diaspora in the Balkans. Past human rights issues in Serbia, involving Chinese companies’ labor practices, highlight a pattern of overlooking abuses to maintain strong bilateral relations. China’s support for Serbia on key international issues, such as the status of Kosovo, underpins this strategic alliance. Serbia’s deepening ties with China pose a challenge to its EU accession aspirations, requiring a balance between its obligations under the European Convention on Human Rights and its commitment to China’s vision of state-centric human rights.

57. Freedom of Thought: Reviving and Protecting a Forgotten Human Right

Abstract:
Freedom of thought is an essential plank of the international human rights framework and an inviolable freedom. It has been described by legal experts as not only the foundation of democratic society and the basis and origin of all other rights but also as a “forgotten right” that has languished unused in international human rights law for decades. However, the importance of this right and the need to protect it are becoming more urgent in the digital world. To illustrate the risks emerging technologies present to freedom of thought, Susie Alegre and Aaron Shull outline four contemporary use cases — ranging from the least invasive (data-driven persuasive technologies) to the most invasive (brain-computer interfaces) — that raise many questions: Where does the line fall between our inner thoughts and our expression of those thoughts? What does “consent” mean with respect to technologies that interface with the mind? How can inferences about our inner lives be used against us? And, critically, where is the boundary between lawful influence and unlawful manipulation of our thoughts? Over the past 10 years, recognition has been growing that the right to freedom of thought is key to our future relationship with technology. Alegre and Shull write that an authoritative statement made at the international level on the scope of the right to freedom of thought and its relationship to technology would assist domestic and regional courts, regulators and policy makers grappling with these deeply complex policy areas.

The growing use of artificial intelligence (AI) in military applications has changed the way countries engage in war and in times of peace. With so many potential effects of military AI applications, both positive and negative, there is growing demand for international norms to govern their responsible use based on ethical and legal principles. While some argue that current international and human rights laws are sufficient, this paper makes the case for expanding norms to encompass the rapid growth of military AI use while looking at the challenges facing international norms development, current initiatives, and strengths and weaknesses in the normative landscape.
