Abstract:
In the media, news commentators continue to refer to Srebrenica as a lesson that should never be repeated again. Indeed, such “never again” statements have re-emerged in light of current events unfolding in Syria, as the international community debates what type of intervention should be used to stop further violence. The media have gone so far as to call the Syrian regime's possible use of chemical weapons against its population a “Srebrenica moment” — that is, a moment when moral outrage of civilian deaths leads to a push for military intervention (Lerman and Lakshmanan 2013). While little action has materialized in the case of Syria, the Srebrenican “never again” lesson is also far from being either agreed upon or learned from in Bosnia itself.

Abstract:
Since the beginning of the tragic Yugoslav dissolution wars from 1992 to 1995, the international community has taken new interest in the region of former Yugoslavia and its people. The big amount of foreign aid as well as the multitude of international actors and organisations bears witness to that: Lana Pasic finds that until 2005 at least 9.9 billion dollars have been sent to Bosnia and Herzegovina (BiH) as international humanitarian aid and reconstruction purposes, which is not taking into account the ongoing support from private donors and NGOs.1 In addition to that, a country profile on BiH drafted by the Michigan State University in March 2012 mentions the impressive amount of 15 billion US-Dollars of international aid being given to BiH for a vast variety of purposes since the end of the war until the beginning of 2012, such as humanitarian aid, de-mining and the improvement of Bosnian infrastructure.2 Germany's contribution to this foreign aid sums up to about 680 million Euros between 1995 and 2012.3 This sum provides an idea of how relevant BiH is to German politics – and gives an impression of how relevant Germany might be within BiH and the first decades of this state. It leads to the assumption that Germany is taking great interest in the new Bosnian state and is politically active for this purpose. For the newly united Germany after 1990 that was indeed the case: it was of high relevancy during and after the dissolution wars. It was the first country to recognise the states of Croatia and Slovenia and took in at least 345,000 refugees from BiH from 1992 until 1996. Also, it initiated the Stability Pact for South-Eastern Europe4 and portrays itself as one of the leading partners of BiH's way to accessing the EU.5 This approach is based on a long, multi-faceted relationship between Germany and the region of BiH: for example, immigrants from German territories settled on Bosnian ground as early as the 13th century6 , the two World Wars had a deep impact on the region – e.g. for the Titoist partisan founding myth – and guest workers came to Germany after the German-Yugoslav guest worker contract in 1968.

23. Historical Construction and Development of Bosniak Nation

Abstract:
Every nation and national identity is a product of long historical process because nation is constructed and develops historically. Especially, conflicts with other ethnic - religious groups, nations and central government make great contribution to construction and development of nation. Therefore, as other nations, Bosniak nation historically has been constructed and developed during centuries. Major historical events and steps which shaped and affected historical construction and development of Bosniak nation are as following: (1) Islamization process in Bosnia and Herzegovina under the Ottoman rule since second half of 15th century; (2) the Bosniak rebellions led by Bosniak landowners and kapetans (the commanders of fortresses) against the Ottoman central government in 19th century; (3) armed resistance of Bosniak people against the Habsburg occupation, political opposition of Bosniak clerics and landowners against the Habsburg rule in Bosnia and Herzegovina between 1878 and 1918, and foundation of the Muslim National Organization in 1906; (4) Political opposition of the Yugoslav Muslim Organization founded in 1919 against Serbian and Croatian nationalism which oppressed Bosniaks within the First Yugoslavia; (5) clashes between Bosniaks and the Chetniks and between Bosniaks and the Ustasha during the Second World War; (6) official recognition of Bosniak nation by the socialist regime as one of the six constituent nations of the Second Yugoslavia; (7) significant progress in economic, social, political and cultural status of Bosniak people in the Second Yugoslavia; (8) foundation of the Party of Democratic Action and the Muslim Bosniak Organization after collapse of the socialist regime; (9) the Bosniak armed resistance against Serbian and Croatian militarist-nationalism during the Bosnian War from April 1992 to December 1995; (10) foundation of Bosnia and Herzegovina in which Bosniak politicians undertake influential political roles after the Bosnian War; (11) newspapers and periodicals published by Bosniak intellectuals, political parties and cultural associations in the periods of the Habsburg rule, the First Yugoslavia, the Second Yugoslavia and after collapse of the Second Yugoslavia. So, this article, in order to explain historical construction and development of Bosniak nation, focuses on these historical events and steps occurred within six historical periods of Bosnia and Herzegovina: the Ottoman rule in Bosnia and Herzegovina between 1463 and 1878, the Habsburg rule in Bosnia and Herzegovina until 1918, the period of the First Yugoslavia between 1918 and 1941, the period of the Second World War, the period of the Second Yugoslavia until 1990, and disintegration process of the Second Yugoslavia in the 1990s.

Years of international and national accountability efforts in the former Yugoslavia have only partially helped post-conflict societies to transition. To complement retributive justice efforts more recently, human rights activists have launched a campaign to establish a regional truth commission. This article explores the intricate efforts among nongovernmental organizations (NGOs) in several states across the region – particularly Bosnia and Herzegovina, croatia and Serbia – to coordinate this movement. Drawing on participant observation and in-depth interviews, this study illustrates the movement's struggle from within – caused by the conflicting interests of its members – and from outside, as it seeks support from international and region-specific organizations as well as national governments. While activists have remained unsuccessful in institutionalizing new truth spaces, this article argues that the state-centered strategy of human rights advocates during the campaign widened the gap between the activist leaders and victims' groups, their principal supporters.

Abstract:
Today's Serbia is a country that has made significant progress since the wars that led to the disintegration of Yugoslavia at the end of the last century. Though more than a decade of isolation left it markedly behind many of its regional neighbors, Serbia has now returned to a position of regional leadership. Though many challenges remain, the country's European aspirations are now supported by more than 90 percent of the newly-elected Parliamentarians who will set the course for the coming years. The outgoing government deserves accolades for helping Serbia move closer to European Union membership but also left significant tasks for the new government to address. The road ahead will not be easy and our multi-faceted engagement is designed to help Serbia reach its European aspirations while steadfastly representing our interests in foreign policy and the economic arena.

Abstract:
Turkey's activism in former Yugoslavia is a continuation of the country's post-Cold War strategy in the broader context of South East Europe. It is driven largely by structural shifts related to the spread of democracy, Europeanization and globalization, rather than by ideology or Ottoman nostalgia. Despite its vanishing appeal, the EU remains essential in understanding Turkey's place in regional politics. The Union's expansion has deepened interdependence across South East Europe and transformed the Turkish approach: from power politics to a multidimensional policy reliant on trade, cross-border investment, and projection of soft power. Although Ankara is acting in a growingly unilateralist manner and could be viewed as a competitor in some Western capitals, Turkish policies are benefiting from Brussels and Washington's investment in the stabilisation and integration of the Western Balkans.

27. The International Criminal Court's Provisional Authority to Coerce

Abstract:
The United Nations ad hoc tribunals in the former Yugoslavia and Rwanda had primacy over national judicial agents for crimes committed in these countries during the most notorious civil wars and genocide of the 1990s. The UN Charter granted the Security Council the right to establish a tribunal for Yugoslavia in the context of ongoing civil war and against the will of recalcitrant national agents. The Council used that same right to punish individuals responsible for a genocide that it failed earlier to prevent in Rwanda. In both cases the Council delegated a portion of its coercive title to independent tribunal agents, thereby overriding the default locus of punishment in the world order: sovereign states.

Abstract:
This edited volume brings together “the coming generation of Balkan social scientists” in an effort to open up discussion and shed light in various elements of Bosnia-Herzegovina's troubled post-conflict transition processes. The book, like others focusing on the same subject, illustrates why Bosnia-Herzegovina (BiH) remains the most intriguing piece in the puzzle of Yugoslavia's disintegration. In the most ethnically diverse republic of Yugoslavia, the particularly bloody conflict shocked the world that was watching in disbelief as international community scrambled to respond to the escalating crisis. The Dayton Peace Agreement put an end to the war but put into place a dysfunctional political system fashioned with consociational characteristics that resulted in ethnicization of politics, education and just about every other aspect of life in the country. Finally, the unprecedented international intervention that culminated in the institution of 'international administration', as embodied by the Office of the High Representative (OHR), made BiH the 'perfect' social experiment in the making. As an extreme or crucial case study, it attracted hordes of social scientists analyzing peace building, intervention, state building, nation-building and post-conflict reconstruction. With the international administration now in its sixteenth year of presence on the ground and with the political situation spiraling out of control to the point of talk among (nationalist) political elites of renewed conflict, it is not difficult to understand why the country is a mess that continues to fascinate.

Abstract:
North Atlantic Treaty Organization (NATO), originally created in the post-WW2 world as an organization dedicated to the collective defense of its member states and a countervailing force against the Warsaw Pact, has undergone tremendous change since. The first major turning point came in the wake of the end of the Cold War and the bipolar world. The new situation changed the Organization's mission, functions, and policies mainly within the European theatre, as best reflected in NATO's military intervention in the Balkans (former Yugoslavia in the 1990s. The second wave of change came in the wake of 9/11 and the subsequent direct engagement in Afghanistan; NATO's new function as a military arm of the United Nations – which continues to date.

Abstract:
Information is a fundamental resource in post-conflict societies. However, information-sharing may lead to both advantages and disadvantages. The main focus of the present paper is the flow of information and knowledge from the International Criminal Tribunal for the Former Yugoslavia (ICTY) to the domestic judicial system of Bosnia and Herzegovina. Following a brief introduction of the dynamics of the changing relationship of the Tribunal and the Bosnian judiciary, the paper aims to outline the positive achievements and the practical barriers of the international intervention into the management of war crime cases in Bosnia and Herzegovina. The paper introduces the practical problems that came forth with the introduction of the adversarial procedure in the domestic judicial system, by which measure international intervention might have gone too far resulting also in negative consequences with regard to the management of domestic war crime trials.
