41. Constituent Assembly Elections and Security in Nepal

Abstract:
This USIPeace Briefing highlights the findings regarding the security situation in Nepal in the run up to constituent assembly elections scheduled for November 22, 2007. Since February 2007 the United States Institute of Peace (USIP) has held individual meetings and group dialogue sessions on strengthening security and the rule of law in Nepal. These events have taken place in Washington, D.C., Kathmandu, Banke, Siraha, Kailali, Jhapa, Chitwan and Rupandehi Districts. During the sessions and meetings, including with members of the security sector, challenges and solutions to strengthening security and the rule of law were identified and discussed. While election security for the upcoming Constituent Assembly Election was not the primary subject of the discussions, various participants offered a number of recommendations and raised several concerns. Additionally, general security issues, many of which are related to election security, were discussed and can be included in a broader long-term security strategy.

Abstract:
Government memos leaked to the press are nothing new in Washington, yet they can still command a front-page, above-the-fold headline. The latest came on December 2, 2005, when the Washington Post trumpeted, “Justice Staff Saw Texas Districting as Illegal; Voting Rights Finding on Map Pushed by DeLay Was Overruled.” (Part of this story was recycled by the Post on Monday, January 23, in another front-page, above-the-fold story.) The story that followed loosely described the contents of a 2003 internal Department of Justice memo written by career staffers in the voting section of the civil-rights division. Those staffers—five lawyers and two analysts—had concluded that the Congressional redistricting plan Texas had recently submitted to them for approval was in violation of the 1965 Voting Rights Act because it “retrogressed”—or, more simply, “diminished”—the electoral position of blacks and Hispanics. Then attorney general John Ashcroft and the political appointees in the civil-rights division—as well as, incidentally, a career lawyer higher in the chain of command (a fact that the Post failed to note)—rejected the memo's findings and allowed Texas to implement the new plan.

After the Great Depression and throughout the rest of the twentieth century, Latin American countries basically approached economic development following two successive and quite opposed strategies. The first one was import substitution industrialization. The second was the so-called Washington Consensus approach. While the two views were founded on quite opposite premises, neither the import substitution industrialization nor the Washington Consensus managed to deliver sustained economic development to Latin American countries. Two domestic elements are crucial to understand this outcome. One is the failure of the state. The second is the inability to achieve mature integration into the world economy.

Abstract:
The approval of the Iraqi constitution in the October 15 referendum does not put Iraq on the path to stability and democracy but pushes it toward division into largely autonomous regions. And this new momentum is probably irreversible. Whether it will lead to a catastrophic descent into greater violence or even ethnic cleansing, or to a managed transformation into a loose federation of regions enjoying extreme autonomy, depends on whether it becomes possible for Sunni Arabs to form their own region, as Kurds already have and Shias are bound to do once the constitution is in effect. The central thrust of U.S. policy in Iraq must now be to help Sunnis organize an autonomous region and to convince Shias and Kurds that it is in their interest to make this possible. Paradoxically, announcing now a timetable for the inevitable withdrawal of U.S. troops from Iraq could give Washington additional leverage in influencing all sides to accept the necessary compromises.

In Washington, politicians and pundits have settled on a single magical solution for the country's economic ills: getting China to revalue its currency, the RMB. By any reasonable economic measure, however, the RMB is not undervalued. China does have a trade surplus with the United States, but it has a trade deficit with the rest of the world. And China's accumulation of dollar reserves is not the result of trade surpluses, but of large investment inflows caused in part by speculators' betting that China will yield to U.S. pressure. Focusing on China's currency is a distraction. If the United States wants to improve its economy for the long haul, it had best look elsewhere beginning with raising the productivity of American workers.

Diverse forces are assembling to bring Bush administration officials to account for war crimes. Cindy Sheehan, Gold Star Mother for Peace, insists: “We cannot have these people pardoned. They need to be tried on war crimes and go to jail.” Paul Craig Roberts, Hoover Institution senior fellow and assistant secretary of the treasury under Ronald Reagan, charges Bush with “lies and an illegal war of aggression, with outing CIA agents, with war crimes against Iraqi civilians, with the horrors of the Abu Ghraib and Guantanamo torture centers” and calls for the president's impeachment. Anne-Marie Slaughter, dean of the Woodrow Wilson School at Princeton and former president of the American Society of International Law, declares: “These policies make a mockery of our claim to stand for the rule of law. [Americans] should be marching on Washington to reject inhumane techniques carried out in our name.
