1. Pope Francis: Extending his “Culture of Encounter” into the Arab and Muslim Worlds

Abstract:
In February 2019, Pope Francis became the first pope to visit the United Arab Emirates (UAE). Like John-Paul II before him, he has also visited Egypt, and he went to Morocco in March 2019. The pope participated in a colloquium on “human fraternity” and interreligious dialogue sponsored by the UAE-based Muslim Council of Elders—the brain-child of Sheikh Ahmed el-Tayeb, the grand imam of Egypt’s Al-Azhar, the most important Sunni Muslim university in the world. The Council of Elders sponsors initiatives to engage young Muslims on Islamist ideology by promoting a more “authentic” interpretation of Islam. Islamist violence—with its beheadings and mass executions—has provoked disgust across the Muslim world and is causing young Muslims to become more distant from their imams and mosques. It is becoming clear to many Muslim intellectuals in Egypt, Iraq, and Lebanon that, in order to defeat Islamism, there needs to be greater dialogue and coexistence with Christians. Pope Francis is attempting to lead the way, extending his “culture of encounter.”

Abstract:
For at least three decades now religion has been re-entering the public sphere and politics in Europe and globally. Its re-emergence, however, bears little resemblance to the past when the religion-state coupling was unequivocal. Today, in Europe, the values of freedom of religion and belief, free expression and non-discrimination take precedence over any single religion’s domination – at least that is the prevalent aspiration. In the European neighbourhood, major social and political phenomena have acquired an increasingly religious angle: radicalisation – in the words of Olivier Roy – is becoming Islamised, intra and interstate conflicts have a sectarian character, and governments either want to increase their control over religion or the breakdown of local governance is making religious actors more legitimate representatives than the central government. Within EU member states, religion is resurfacing alongside two simultaneous trends: on the one hand, individualised, atomised urban life that requires more spirituality and a reference point to the realities of modernity and diversity; and, on the other, social polarisation around perceptions of secularisation and religions, particularly Islam. This Joint Policy Study takes an institutionalist view of state-religion relations, although religious institutions are defined in a broad sense and encompass both official and unofficial religion. This leaves the field outside of the institutionalised religion-state relations either relatively small or down to individual expressions of religiosity. Institutionalism, so understood, is a view that policy is carried out through and with institutions. This can vary in different aspects: dependence (state-dependent, statecontrolled, independent of states), size, homogeneity, thematic focus, accountability, credibility, and so on. The chapters in the study aim to provide both more generalised overviews and case studies to cover all levels of state-religion relations in Europe and MENA: relations between state and religious institutions in Europe (chapter 1); relations between state and religious institutions in the Maghreb (Tunisia and Morocco in chapter 3); relations between institutions of different religions (the Vatican and al-Azhar in chapter 4); and the role of Muslim religious institutions in advancing a state policy in an EU member state (Germany in chapter 2).

Abstract:
Because of the current migration crisis the central organizations of the Catholic Church were forced to reflect upon more directly about the humanitarian, pastoral and policy aspects of the refugee issue. However, neither the annual speeches delivered by the pope at the annual World Day of Migrants and Refugees, nor other “ad hoc” communications by the representatives of the Holy See at multiple liturgical and diplomatic events led to any systematic legal and structural changes. These exhortations are not laws in the strict sense, instead they provide guidance to church organizations and pieces of advice for international and national authorities which must, by law, manage the whole migration crisis. The situation has changed with the emanation of a motu proprio titled Humanam progressionem on 31 August 2016, which led to the foundation of the new “Dicastery for Promoting Integral Human Development” inside the Vatican. This new document has amended the governance structure of the Holy See and other relevant regulations. In this paper we focus on the historical and political background which motivated the legislator to modify the existing legal framework. We analyze the new law and the new administrative system in the context of current Canon Law and its influence upon the operations of other Holy See offices.

Donald Trump needed to visit to the Vatican to change the opinion that there were serious differences between the new Administration and the Holy See, expressed in the media. After their mutual attacks during the US electoral campaign and negative reaction of the Catholic community to Trump’s first legislative initiatives, the meeting with Pope Francis was aimed at restoring president’s relations with the world’s biggest religion and sending a positive message to its 70 million followers in the United States.

Through an international reading of the first years of his pontificate, associated to the analysis of the global and regional context – emphasizing the Latin-American conjuncture – that preceded him, this research highlights the role that the Holy See can play in the current reordering moment, not only of the religious, but also of the political context. This study also seeks to build new conceptual categories that may be able to explain the notion of transnational religious actor and its role on the international arena, which is considered a secularized system.

7. The International Legal Status of the Vatican/Holy See Complex

This article offers a re-examination of the international legal status of what is here termed the Vatican/Holy See complex (VHS), focusing on claims to statehood. The problematic ‘effect’ of Vatican City, of the Holy See, of the papacy and of associated entities is interrogated at the level of international law, entering as little as possible into administrative or theological distinctions. The various grounds cited as supporting status amounting to statehood are argued to be inadequate. The continuing exchange of representatives with states by the VHS is missionary and hierarchical in character and is reflective neither of the reciprocity of peers nor of customary obligation going to law. Agreements entered into by the papacy with the Kingdom of Italy (the Lateran Pacts) in 1929, relating to the status of the geographical territory known as Vatican City, cannot be determinative of international status. Nor can membership of international agreements and organizations confer a status amounting to statehood. Events and practices since 1929 have not substantially altered international status as of 1870. The Roman Catholic Church is but one of many faith-based international movements, and since the eclipse of the papal state nearly one-and-a-half centuries ago, the status in international law of its temporal headquarters in Rome should not be privileged.

Abstract:
Mahmoud Abbas, the president of the Palestinian Authority (PA) and chair of the Palestine Liberation Organization (PLO), plans to call on the United Nations in September to recognize a Palestinian state and admit it as a full member of the organization. This strategy marks a dramatic shift in the Palestinians' approach to the conflict with Israel: they are not seeking to revive the moribund peace process; they are seeking to bypass it altogether. Following the collapse of direct negotiations last fall, Abbas and his Fatah-dominated leadership launched an aggressive diplomatic campaign to secure broad international recognition of a Palestinian state along the 1967 borders as a prelude to applying for formal UN membership this fall. If the Palestinian bid to get full UN membership in September is defeated in the UN Security Council -- a U.S. veto is all but assured -- the PA says it is prepared to take the matter to the General Assembly. Initially, the plan was to seek a two-thirds majority vote there to obtain a nonbinding resolution under the "Uniting for Peace" procedure, which allows the General Assembly to act when a lack of unanimity on the Security Council prevents it from fulfilling its "primary responsibility" of maintaining "international peace and security." The PA has since backed away from this option and is now planning to seek a simple majority in the General Assembly, which would allow Palestine to be recognized as a "nonmember state" of the UN, alongside Kosovo, Taiwan, and Vatican City.

Historically the Vatican's view of Israel and Zionism was negative. The Vatican explicitly told Herzl that that the Jews were meant to wander, and if they set foot on Palestinian soil the Christians would be there to convert them. The main concern of the Catholic Church regarding the Holy Land has long been to maintain the status quo of the Catholic holy places. For many years, the Church supported the creation of Jerusalem as an entity independent from the surrounding states—a corpus separatum. But in the 1970s, the Vatican spoke instead of international guarantees for the holy places, an idea that remains Vatican policy today.

During the ceremony of the presentation of my credentials as the Ambassador of Israel to the Holy See on April 10, 1997, I told His Holiness that, actually, this was not my first connection with the Vatican. In fact, when I served as Ambassador of Israel to the Republic of Cyprus, in one of the ceremonies there, I was approached by the non-resident Ambassador of Outer Mongolia, who asked me whether I represented the Holy See in Cyprus. Of course I answered that I represented the State of Israel. Then, looking at my head, he remarked: "Oh, you are right, sir; now I can see the difference in the color!" Of course, he was referring to my skullcap.
