161. The U.S.-Japan-ROK Trilateral: Better at Deterrence than Diplomacy?

Abstract:
Once more, the United States, South Korea, and Japan have confronted a crisis with North Korea. The pattern is now well established. First, there is a provocation—a missile test, a nuclear test, and even worse, the use of force. Next, the United States and its allies in Northeast Asia muster their forces, strengthen their trilateral policy coordination, and sanction the belligerent Pyongyang. The three nations advocate for the accompanying effort by the United Nations Security Council to condemn North Korea’s behavior. Setting aside their political differences, Seoul and Tokyo intensify their military cooperation and Washington calls for greater trilateral unity in confronting a shared security challenge. In 2017, policymakers in Seoul, Washington, and Tokyo found themselves in a similar cycle but with the threat of war ever more real. The dramatic escalation of tensions between President Donald J. Trump and the North Korean leader Kim Jong-un seemed to bring the region to the brink of a second Korean conflict. But today, just as dramatically, an accelerated series of high-level summits suggests that the Korean Peninsula could be on the brink of peace. President Moon Jae-in met with Kim at Panmunjom, and both Kim and Moon stepped across the line of demarcation at the Demilitarized Zone (DMZ) between North and South Korea. The two leaders have embraced a “new era of peace,” with the promise of ending the state of war on the peninsula. Trump has also said he is willing to meet Kim to discuss denuclearization. CIA director Mike Pompeo visited Pyongyang on April 1 to test out that proposition, and as secretary of state, Pompeo had the lead in setting the stage for a meeting in Singapore. The Moon-Kim meeting set up the premise of a negotiated denuclearization process. Trump and Kim will define the contours of that path forward.

Abstract:
As the second batch of US sanctions, which are set to focus on oil exports, approaches, the government of President Hassan Rouhani are taking proactive measures to ease the sanctions that coincide with the spiraling internal protests due to the failure of handling various crises affecting living conditions. However, many obstacles continue to undercut the ability of government to pass its plans to cope with the sanctions, most notably the regime’s attempts to revive the roles of certain institutions that have oversight powers over government programs, such as the Expediency Council, and to continue questioning the ministers, such as the Ministry of Interior and Ministry of Culture and Islamic Guidance on some security and cultural issues.

163. Limited Impact: European Moves to Dodge US sanctions on Iran

Abstract:
The European Union seeks to continue its economic relations with Iran under the nuclear deal, despite the US withdrawal from the deal on May 8 and the imposition of new economic sanctions against Iran. Accordingly, the EU has adopted, over the past months, countermeasures to protect its economic interests with Iran and to sidestep US sanctions. The most important of these measures is introducing the “Special Purpose Vehicle” and reviving the “Blocking Statute”, as well as allowing the European Investment Bank (EIB) to work in the Iranian market. However, these mechanisms seem to have little impact due to the reluctance of the European companies and institutions themselves to continue to deal with Iran for fear of US sanctions.

Abstract:
The successful test of a US thermonuclear weapon in 1954 raised a compelling question as to the worldwide dispersion of radioactive fallout. This article reexamines the Eisenhower administration's test-ban policy in the context of global radioactive contamination. To explain the shifting public discourse of the global fallout hazards and its impact on the test-ban debate, the article focuses on epistemic frictions, seeking to demonstrate how a variety of expert bodies evaluated scientific uncertainty and moral ambiguity concerning the biological effects of fallout from different sets of concerns, and how the resulting incongruence both within and between the scientific advisory committees fueled the fallout controversy and affected the Eisenhower administration’s test-ban policy leading toward the test moratorium in 1958.

Abstract:
North Korea has become a de facto nuclear power. Regardless of one’s views about the regime and its treatment of the country’s ordinary citizens, its nuclear and weapons of mass destruction (WMD) programs, and its illegal activities ranging from proliferation of WMD to currency counterfeiting, the international community has to accept that it is dealing with a nuclear North Korea. This means that stopping and rolling back Pyongyang’s nuclear programme is no longer a realistic goal, at least in the short term. Both in public and in private, the regime has clearly indicated that the program itself is not a bargaining tool. Rather, the Kim Jong-un regime considers a nuclear deterrent the best means to avoid the same fate as the Muammar Gaddafi and Saddam Hussein regimes: military strikes led or supported by the U.S., followed by the execution of their leaders at the hands of their former citizens. The debate has to now shift towards how to deal with a nuclear North Korea. Sanctions have clearly not worked. The current round of UN and bilateral sanctions implemented from July 2006 onwards has failed. Pyongyang had not even conducted a nuclear test when sanctions were first implemented. Today, it is believed to be in possession of dozens of nuclear devices.3 Isolation of the Kim Jong-un regime has not worked either. Two consecutive South Korean conservative governments led by Lee Myungbak and Park Geun-hye dismantled many of the cooperation mechanisms set up by their predecessors. The Barack Obama administration refused to countenance diplomatic engagement with Pyongyang unless it changed its behavior. Xi Jinping is yet to meet with Kim Jong-un, even though they sit less than two hours away from each other. In return for sanctions and isolation, North Korea has pressed ahead with its nuclear and ballistic missile programs. Deterrence is a useful way to prevent a North Korean attack on Seoul, Tokyo or the U.S. mainland. Nevertheless, few experts think that Pyongyang would strike first.4 Engagement thus seems to be the only viable option to deal with Pyongyang.

These are critical times for those who work to further the public interest. Across the globe, divisions and distrust erode the clarity required to tackle the great challenges of our day. Those who advocate for truth find themselves under attack from those who fear what they might lose if the status quo is changed. There is exceptional need today for powerful voices speaking on behalf of sound policy. The 10 articles in this 29th edition of the Journal of Public and International Affairs all reflect a dogged determination among young policy professionals around the world to press ahead in spite of the headwinds. These pages contain fresh ideas on electrifying rural Myanmar, reforming the U.S. banking system, strengthening the Jordanian labor market, and preventing recidivism among convicted sex offenders in Texas, to name just a few. The JPIA was born from the conviction that graduate students have a unique and invaluable voice in key policy debates. On November 5th, 2018, the Trump administration re-imposed severe sanctions on Iran. These sanctions, which President Obama called the “toughest sanctions ever faced by the Iranian government,” were lifted by the 2015 Joint Comprehensive Plan of Action (JCPOA), also known as the Iran Deal. The JCPOA was signed with a view to blocking Iran’s alleged pursuit of nuclear weapons, allowing international inspectors into Iran in return for sanctions relief. Withdrawing the United States (US) from the deal was a prominent promise of Donald Trump leading up to the presidential elections of 2016. In a May 2018 speech that described the deal as rooted in “fiction,” President Trump made good on his promise to leave the JCPOA and to move to unilaterally re-impose sanctions on Iran.

Abstract:
US President Donald Trump’s decision to withdraw from the 2015 Iran nuclear deal, known as the Joint Comprehensive Plan of Action (JCPOA), will severely degrade regional and global security. His decision has increased the risk of war and a nuclear arms race in the Middle East and beyond. He has undermined attempts to limit the proliferation of nuclear weapons through multilateral diplomacy, as unilateral withdrawal equals non-compliance with a legally-binding UN Security Council resolution. This is a rejection of the UN as arbiter of international peace and security, as well as of international law as a lynchpin of international relations. The steps that Europeans now take will have serious consequences for their alliance with the US, for security in the Middle East, as well as for their relations vis-à-vis China, Russia and the wider world.

The Trump–Kim summit is a distinct new phase in the dramatic cycle that defines the North Korea nuclear issue and the peninsula’s highly theatrical brand of geopolitics. Now that North Korea has finally reached the threshold of a nuclear missile capability to directly threaten the US mainland, its scripted brand of hyperbole and brinksmanship is encountering a different sort of melodrama: the political theatre of Donald Trump. The North Korean nuclear issue cannot be understood without an appreciation of the fundamental tension within inter-Korean relations. There is no precedent for a minor, revisionist power developing an asymmetrical nuclear deterrence relationship with the United States. The result is unlikely to be stable.

170. International Collaboration Efforts to Denuclearize the Korean Peninsula

The international community’s confrontation with North Korea reached crisis proportions in 2017, following Pyongyang’s ballistic missile launches and its sixth nuclear test. In the wake of a series of high-level summits, tensions began to thaw in 2018. At the inter-Korean summit in Panmunjom on April 27, 2018, South Korean President Moon Jae-in and North Korean leader Kim Jong-un agreed to seek support from the international community to denuclearize. But the international community, led by the U.S. in concert with the United Nations Security Council, has already worked tirelessly over the past 26 years to coordinate efforts to prevent North Korea from developing nuclear weapons. Successive U.S. administrations have worked through the cycle of confrontation, crisis, discussions and agreements with North Korea. Nonetheless, all these agreements have ultimately fallen apart, allowing North Korea to advance its nuclear program. This paper focuses on two key questions: How has the international community contributed toward denuclearizing the Korean Peninsula, and what is its role in facilitating the complete, verifiable dismantlement of North Korea’s nuclear program? Ultimately, the success of denuclearizing the Korean Peninsula will be measured by whether North Korea completely dismantles its nuclear program. Fortunately, the international “tools” are on the table, but successfully denuclearizing North Korea will, in the end, be a matter of effectively enforcing existing international measures.
