Abstract:
Today’s realities demand that the United States change its approach to the Israeli-Palestinian conflict. Its current focus is on high-profile diplomatic initiatives that aim for a permanent agreement in which the United States is the central mediator. Instead, the United States must focus on taking tangible steps, both on the ground and diplomatically, that will improve the freedom, prosperity, and security of all people living between the Mediterranean Sea and the Jordan River, while also cultivating the conditions for a future two-state agreement negotiated between the parties.

Abstract:
At the end of January, US President Trump announced a Middle East peace proposal that he himself lauded as "the deal of the century". The introduction to this peace proposal called "A Vision for Peace" stresses that it would "create a realistic two-state solution" because it addresses "today's realities" surrounding the Palestinian issue. However, the nature of this proposal differs greatly from two-state solutions previously pursued by the US and the international community as a whole. Israel and the Palestine Liberation Organization (PLO) signed the Oslo Accord in September 1993. The concept underlying that accord was a two-state solution in which an independent Palestinian state with its capital in East Jerusalem would be established in the West Bank of the Jordan River (hereinafter, "the West Bank") and the Gaza Stripboth of which have been occupied by Israel since the 1967 Arab-Israeli War and would co-exist with Israel. Circumstances in the West Bank and Gaza have changed greatly over the past 27 years, however, and the prospects for a two-state solution have mostly perished. In that sense, the Trump peace plan can be said to have struck the final fatal blow that killed the two-state solution.

Yet, ASEAN now faces significant challenges, not least from competition between the United States and China that threatens to draw individual ASEAN countries into taking sides. This concept of engagement responds to the National Defense Authorization Act of 2020 regarding the benefits and risks for U.S. national security. Persistent engagement with North Korea’s national security elites, the report argues, is a policy wager with a large potential upside and very little cost and risk.

Part 1 – Reviving Palestinian Political Life Former Vice President Joe Biden’s election victory over President Donald Trump is likely to produce a major reset in American-Palestinian relations as well as in Washington’s role in Israeli-Palestinian peacemaking. No U.S. president had done more to isolate Palestinians and delegitimize Palestinian national aspirations than Trump. Meanwhile, Biden has pledged to reverse the most destructive aspects of Trump’s policies and restore U.S.-Palestinian relations in the hope of salvaging what remains of a two-state solution. Yet even as the Palestinians breathe a collective sigh of relief at Trump’s departure, the Palestinians’ internal house remains in a state of disarray and decline. The Palestinian national movement, now at one of the lowest points in its history, continues to be racked by political division, institutional stagnation, and a lack of strategic clarity.

What’s new? On 29 February 2020, the United States and the Taliban signed an agreement meant to prompt peace talks between the militant group and the Afghan government. Many issues have delayed those talks, including widespread concerns about the Taliban’s willingness to compromise in a political settlement ending the war. Why does it matter? The U.S.-Taliban deal opened a fragile window of opportunity to settle the world’s deadliest conflict. But for talks among Afghans to progress, the Taliban will need to move beyond vague governing principles and put forth concrete negotiating positions on reconciliation, power sharing and governance. What should be done? The Taliban should swiftly determine clear negotiating positions and be prepared to debate – and eventually reach compromises – on these as intra-Afghan talks unfold. The U.S. and other donors should leverage prospects of post-transition assistance as encouragement, while the Afghan government and civil society should engage the group and its ideas.

On 14 January 2020 the United States, the European Union, and Japan (hereinafter referred to as “US-EU-Japan”) issued a trilateral joint statement, proposing a set of new rules to strengthen WTO regulation on industrial subsidies. While a total of seven joint announcements have been made so far, this is the first time that three WTO Members have presented specific ideas on how to amend existing subsidy rules. Many of the proposed amendments seem to primarily target China’s trade policy and practices. Among the six amendment items proposed in the Joint Statement, it seems that the United States is paying particular attention to the sixth item, i.e. in making explicit the possibility of using the out-of-country benchmark and on introducing necessary requirements to do so in measuring the benefit conferred and, ultimately, in calculating the amount of the countervailing duties (CVDs). Against this backdrop, in this Brief the author analyzes the relevant WTO provisions and GATT/WTO jurisprudence, and discusses various scenarios on future negotiations on WTO Reform on industrial subsidies.

20. Taliban Fragmentation: Fact, Fiction, and Future

The U.S. and Afghan governments have, at various times, intentionally pursued strategies of “divide and defeat” in an attempt to fragment and weaken the Taliban. These approaches have proved ineffective and, as long as peace efforts are being pursued, should be discontinued. Contrary to lingering narratives from earlier eras of the Afghan conflict, the Taliban today are a relatively cohesive insurgent group and are unlikely to fragment in the near term. This has not happened by accident: the Taliban’s leadership has consistently, at times ruthlessly, worked to retain and strengthen its organizational cohesion. To this day, the group is unwilling to cross internal “red lines” that might threaten that cohesion. The literature on insurgency and negotiated peace suggests that only cohesive movements are capable of following through and enforcing peace agreements. Many of the feared scenarios of Taliban fragmentation, including the defection of “hard-liners” or mass recruitment by the Islamic State, do not correspond to current realities on the ground. Fragmentation of the Taliban is not impossible, and the group is certainly far from monolithic, but ideological rifts are not a sufficient explanation of why this has taken place in the past—or might again. By studying what makes the Taliban cohesive and what has caused instances of its fragmentation, all parties invested in an Afghan peace process might be better equipped to negotiate with the Taliban under terms the movement would be willing to accept, even if it has not defined those terms publicly. This report examines the phenomenon of insurgent fragmentation within Afghanistan’s Taliban and implications for the Afghan peace process. This study, which the author undertook as an independent researcher supported by the Asia Center at the U.S. Institute of Peace, is based on a survey of the academic literature on insurgency, civil war, and negotiated peace, as well as on interviews the author conducted in Afghanistan in 2019 and 2020.
