31. Pirates, Boat People, and Bystanders: Contradictions at the Marine Bedrock of the International Human Rights Regime

Abstract:
This paper explores the high seas as a critical space for the formulation and development of international human rights law in two inter-related areas: anti-piracy campaigns and rescue of the so-called “boat people.” While the high seas have been instrumental in promoting inter-state cooperation and coordination, I argue that they have also laid bare the limits of states’ nominal commitments to rights protection. Using historical case studies of the Vietnam crisis, Haiti arrivals to the United States, and the current marine policies of Australia, I show that states too often willfully neglect their human rights obligations. In doing so, these states might succeed in protecting their short-term interests, but undermine the foundations of international human rights regimes in the long run.

Abstract:
Turkey represents a multi-layered challenge for the United States in the Eastern Mediterranean, where it is simultaneously an ally and an antagonist. Its status as a partly European and partly Middle Eastern state confounds a US policy process that has stark divisions between the two regions. Turkey’s maritime activities stymie a policy process that is overwhelmingly terrestrial in its orientation. Turkey is also seeking to become more deeply involved in a region in which the United States has important stakes but where it is seeking to reduce its footprint. Most importantly, though, the United States lacks both a strategy and a policy towards the Eastern Mediterranean, providing opportunities for a proactive Turkey to act while the United States and its allies react. While a strategy would not by itself resolve growing US tensions with Turkey, it would provide opportunities for greater policy coordination across the US government, and with allies as well. The US–Turkey alliance was a bulwark of US global strategy for decades, but tensions have been growing lately. Turkey’s Kemalist heritage, its massive conventional army, and its wariness of the Soviet Union just to its north served US strategy in the half-century after World War II. However, in the last two decades, all three pillars of the relationship have been shaken. Turkey’s simultaneous embrace of a muscular nationalism, politicians’ marginalisation of the military, and the country exploring a new modus vivendi with Russia all render Turkey a troubling and confounding partner.

Abstract:
This is a study of Eastern Mediterranean security and how the United States and Israel can improve cooperation to protect their common interests. The study’s particular focus is the maritime domain. Few things in world affairs survive for millennia. It’s also true that few are ever really new. In the Eastern Mediterranean, what has endured for thousands of years is the strategic attention of great powers. The region retains it today, commanding interest not only from local and regional actors, but also from global players. As Iran works to extend its reach to the Mediterranean, Russia, as it has for centuries, strives to exert its influence across the Middle East. The United States, on the other hand, has been signaling a desire to reduce its involvement in the region. Remarkably, China too has become a player. Its increasing presence in the Middle East reflects commercial and strategic motives and signifies its rise as a force competing for global economic and military predominance. China is at once a security challenge and a close economic partner. It is the world’s major rising and disruptive power and plays a huge role in global trade and investment.

Abstract:
The US-Japan-Australia-India Quadrilateral Strategic Dialogue (QSD), or simply “Quad,” process continues to attract the attention of policy-makers, analysts, and scholars interested in the impact of this new and potentially significant alignment formation on the security dynamics of the Indo Pacific region. The reemergence of the Quad meetings in 2017 after their abrupt termination over a decade ago in 2007 has led analysts to wonder if it is now here to stay this time as an enduring additional component of the region’s multifarious security architecture. It has also animated a heated debate about its true nature and purpose, with commentators bitterly divided in their appraisal. Some believe it lacks real substance and cohesion, whilst others argue it has the portentous makings of a new military alliance aimed at containing the PRC. Nevertheless, despite prodigious efforts on behalf of the strategic commentariat, the actual substance and nature of the Quad itself remains enveloped by mixed signals, misapprehensions, and mischaracterizations. As Graeme Dobell recounts: ‘The Quad is more notable for the questions it provokes than the answers it offers.’

On the wall in the entranceway to the personal offices of the Commander, Pacific Fleet, there hangs prominently displayed a life-size portrait of Adm. Chester William Nimitz, the legendary architect of the American naval victory in the Pacific sixty-five years ago. The painting is specially lit, giving the admiral's thoughtful gaze a lifelike glow as if he were present, judging the decisions and actions of his successors in command as these officers find means to preserve regional peace and guard American interests. In the painting's background are the objects of naval war, standing as striking reminders of the heavy price in American blood and treasure paid for the nearly three generations since then during which the Pacific Ocean has been an American lake. It has been this freedom from serious threat that has provided room for American strategic and operational maneuver during the Korean conflict, the Vietnam War, and the Cold War, that has afforded an avenue for the movement of forces during conflicts in Iraq and Afghanistan, the capacity to deter conflict in East Asia, the access needed to assure the security of allies and partners, and the ability to provide support to populations devastated by disaster.

36. From NORAD to NOR[A]D: The Future Evolution of North American Defence Co-operation

Abstract:
The North American defence environment is in the process of a major transformation, occasioned by dramatic changes in the geostrategic/political landscape and the development of new generations of weapon systems. As a result, the requirements to deter, detect and defend North America from a variety of new threats are transforming. In this context, Canada and the United States, through the Permanent Joint Board of Defense (PJBD) established the Evolution of North American Defense (EvoNAD) study, and tasked its execution to the North American Aerospace Defense (NORAD) command. EvoNAD considers a long time horizon and has been broken into subcomponents reflecting six domain priorities: air, maritime, cyber, aerospace, space and land. The overarching factor which binds the six components together is the recognition that the single-domain threat environment is evolving into a multi-domain one. In the past, the threat to North America resided largely on a single axis (north-south), within a dominant domain (air, combined with ballistic missiles), met by a bi-national structure. While this threat seemed to collapse with the end of the Cold War, NORAD continued and evolved to adapt to new threats as well as to continue to monitor the Cold War-styled air and aerospace threats. Subsequently, 9/11 created a new threat environment and forced NORAD to consider threats emanating from within North America as well as outside of it. In addition to a number of changes, including direct feeds from the Federal Aviation Administration (FAA) and NAVCANADA, NORAD expanded into the maritime domain via a maritime warning mission. Roughly at the same time, NORAD’s attention also turned to the cyber-domain and its common threat to North America. The air threat has now returned with the resumption of long-range Russian flights across the Arctic, and down the Atlantic and Pacific coasts. This threat, however, is of a different character because of the development of a new generation of Russian long-range air-launched cruise missiles, as well as sea-launched cruise missiles, which have direct implications for NORAD’s capacity to deter, detect and defend, as well as for its current area of operations and mission suites (air/aerospace warning and control and maritime warning). Not only will these new long-range capabilities diffuse to other potential adversaries, generating a global threat environment, but also the first generation of hypersonic weapons has set the conditions for the merger of air and missile defence, and the air and outer space domains. Finally, the consequences of an attack against North America, alongside potential catastrophic natural disasters relative to the role of military forces in support of civil authorities, raises issues for both Canada and the U.S., and thus NORAD, regarding the most efficient and effective means to respond. The multi-domain/multi-dimensional North American threat environment should drive both Canada and the U.S. towards deeper defence co-operation, and the functional demands of this new threat environment could lead to NORAD’s ultimate transformation into an integrated, multi-domain and dimensional North American Defense Command solution. Of course, this outcome is not inevitable, and numerous barriers exist. Nonetheless, the same logic which led to NORAD’s creation in 1957 (with the agreement signed in 1958), remains valid. Driven by the common recognition that the defence of North America is indivisible, a North American Defense Command would be a natural evolution in Canada – American defence relations.

Abstract:
500 nautical miles north of the city of Tromsø, off of the northern cape of Norway, lies the Svalbard Archipelago; a collection of islands nearly one fourth the size of continental Norway with a unique history and an even more unique status under international law. Since its official discovery in the mid-1500s Svalbard has generally been an area of peace and cooperation due in large part to its location on the fringes of civilization. However, Svalbard’s tranquility has been punctuated by periods of competition and conflict when profitable resources are at stake. From whaling in the 1700s, coal in the late 1800s, and fishing in the present, profit from natural resources has been a consistent driver of instability in the area. Outside of resource-driven tension, the island chain spent most of its pre–20th century existence as a de facto “no man’s land” or global commons, ungoverned by any one nation.

Maritime territorial disputes in Asia are increasingly contentious, with competing claims and confrontations among numerous states of the region carrying significant implications for the relations among the countries of the region, between the U.S. and the region, and for the broader US-China relationship. This analysis examines the politics of the U.S. approach to the challenge, focusing on the role of Congress as a factor shaping the U.S. response. After establishing an analytical framework that directs attention to legislative-executive interactions and the domestic political/institutional context, it assesses the consequences of this context for U.S. policies and approaches to the problem. The analysis reveals the sequence and dynamics of congressional engagement, by which members moved from indirect and non-legislative approaches to direct and legislative approaches to narrow the boundaries and the shape the direction of US foreign policy. It concludes by addressing the implications for the U.S. approach and the relationships among the key parties.

Abstract:
China’s first overseas military base in Djibouti is near the U.S.’ sole military base in Africa—Camp Lemonnier—and signals China’s interest in protecting its growing economic and security interests in Africa and the Indian Ocean. While the base reflects China’s growing economic and security ambitions, it is unclear at present whether the facility represents just an effort for China to enhance its peacekeeping and humanitarian and disaster relief capabilities, or suggests greater ambitions. If, as some reports suggest, China does open more military bases in African and the Indian Ocean region, then the Djibouti base would mark the beginning of a sea-change in Chinese naval ambitions in the Indian Ocean region (Sina, December 19).

Summits between Barack Obama and Xi Jinping in September and November helped to keep tensions in check in the last four months of 2016. Despite persisting differences over how much pressure to impose on North Korea after Pyongyang conducted its fifth nuclear test, the US and China agreed on a new UN Security Council sanctions resolution. The US Navy conducted another freedom of navigation operation (FONOP) near the Paracel Islands in the South China Sea. A Chinese Navy vessel snatched a US drone, claiming it was threatening the safety of the Chinese ship and its crew, and returned it to the US five days later. Incremental progress was made on trade disputes at the 27th annual US-China Joint Commission on Commerce and Trade (JCCT) in Washington, DC. Meanwhile, the election of Donald Trump as the next US president threatened to inject significant uncertainty into US-China relations as Trump received a phone call from Taiwan’s President Tsai Ing-wen and suggested that he might use Taiwan as a bargaining chip to extract concessions from China on other issues.
