11. A Rockier Road to U.S. Citizenship? Findings of a Survey on Changing Naturalization Procedures

Abstract:
Becoming a citizen benefits immigrants and U.S. communities in a variety of ways, including by promoting integration and enabling immigrants to vote and run for public office, sponsor close relatives for immigration, and travel visa free to many countries. Citizens also earn more than noncitizens with similar characteristics, and these higher earnings lead to greater economic activity and higher tax payments. For the approximately 9 million immigrants eligible to naturalize, however, the hurdles to becoming a U.S. citizen appear to be growing. This report presents the Migration Policy Institute’s analysis of a 2019 national survey conducted by the Immigrant Legal Resource Center of 110 naturalization assistance providers. The study aims to understand how U.S. Citizenship and Immigration Services (USCIS) naturalization procedures have changed during the Trump administration. USCIS continues to approve the vast majority of citizenship applications, with an approval rate that has hovered around the 90-percent mark since fiscal year 2010, but the time it takes to process an application has grown considerably. This appears to be due at least in part to changing adjudication policies and practices, including those described by the surveyed organizations: About one-quarter of survey respondents reported their clients missed interviews when USCIS sent notices to incorrect addresses, sent them too late, or sent them to the attorney but not the applicant. Interviews had doubled in length, from 20–30 minutes to 45–60 minutes, according to one-quarter of respondents. More than one-third reported USCIS more often issued requests for evidence to support applications, especially for documents related to tax compliance and income, continuous residency and physical presence, marriage and child support, and criminal history. USCIS officers asked detailed questions not directly related to citizenship eligibility, and administered the English and civics tests differently, often more strictly, according to 10 percent of respondents. These changes were underway before a trio of new 2020 developments that threaten to further increase the application backlog and make it more difficult for eligible immigrants to access citizenship: a COVID-19-related suspension of USCIS operations for three months, the likely furlough of two-thirds of the agency’s staff due to a major budget shortfall, and a planned increase in the cost of filing a citizenship application alongside new restrictions on eligibility for fee waivers for low-income applicants.

ThE PROBLEM of the acquisition and sale of Alaska, and to whom it belongs, excites the minds of researchers to this day. There are supposi- tions that once the first Russians had traversed Siberia, they settled in Alaska during the second half of the 16th century.1 The next period, in which Alaska gets mentioned by Russian people, dates to 1648, in connection with the names of the Cossack Semyon Dezhnev and his associate Fedot Popov, who circumvented the Asian continent, then passed from the Arctic Ocean to the Pacific Ocean basin.2 Later on, an official expedition was organized; its commander, Vitus Bering, announced in 1728 his discovery that Asia and America did not have a land bridge between them.3 The first legal documentation of Alaska’s coastline took place on August 21, 1732, when the crew of the St. Gabriel, under the leadership of surveyor Mikhail Gvozdev and navigator Ivan Fyodorov (or K. Moshkov, according to other sources), recorded its contours without going ashore. From this date began the jurisdictional affiliation of Alaska with the Russian Empire. however, the territory for a long time contin- ued to be developed on the basis of civil law. The bureaucrats of the Russian Empire did not duly administer the land in Alaska. This situation contributed to the consolidation of legal relations within civil society on the territory along the lines of the Novgorod Republic.

13. Effect of “Just Cause” Eviction Ordinances on Eviction in Four California Cities

The Eviction Lab’s recently released dataset of evictions in the United States provides rich opportunities for exploring the effect of state and local policies on eviction rates. Just cause eviction ordinances—local laws that outline what constitutes grounds for eviction—have gained traction as a policy solution for addressing the eviction crisis. This paper analyzes the relationship between just cause eviction ordinances and eviction rates and eviction filing rates in four California cities. A difference-in-differences matched case model suggests that there is a statistically significant, large, and negative difference between eviction rates and eviction filing rates before and after the passage of just cause eviction ordinances in the four treatment cities, as compared to the difference in these rates before and after the passage of just cause eviction ordinances in matched control cities. Cities that implemented just cause eviction laws experienced lower eviction, by 0.808 percentage points, and eviction filing rates, by 0.780 percentage points, than those that did not.

Abstract:
The National Security Law, imposed on Hong Kong by China on 30 June, has reduced protests against China’s policy. The scale of the restrictions, including those potentially affecting foreigners, and China’s supervision over the implementation of the law have already worsened the living conditions of Hong Kong residents and functioning of foreign companies. China’s actions caused an international reaction, mainly from the UK, the U.S. and the EU. Concerned about the safety of its citizens, the EU recommends that Member States suspend their extradition agreements with Hong Kong.

Abstract:
U.S. legislation and case law have both upheld and challenged the legal authority of the Guantánamo Bay military prison. This includes the 2001 Authorization for Use of Military Force (AUMF) and the Military Commissions Act of 2006, as well as Supreme Court cases such as Hamdan v. Rumsfeld (2006) and Boumediene v. Bush (2008). Serious legal issues have arisen around the legal rights and protections of those imprisoned, including the right to habeas corpus and the right to be tried under the U.S. legal system (as opposed to U.S. military tribunals). Attorneys for those imprisoned at Guantánamo Bay military prison have been subjected to surveillance and interference by the U.S. government, and the U.S. government tightly controls the release of information about the military prison and those imprisoned there.

The President’s National Security Advisor John Bolton has long been beating the drums of war with Iran. Those drums are growing louder. In the last month, Bolton has repeatedly threatened that Iran’s support for its “proxies” could bring “a very strong response”—even military force. By threatening military action against Iran in retaliation for the acts of groups it supports, Bolton is trying to frame a war on Iran as a justified—even righteous—act of self-defense even if he cannot prove that Iran itself has participated in any attacks. Such a war would, however, be illegal.

19. Russian Meddling in the United States: The Historical Context of the Mueller Report

Abstract:
One of the most significant—and most disturbing—aspects of the Mueller report is the confirmation that Russia attempted to influence the 2016 election, based on the Special Counsel’s exhaustive collection and review of intelligence. This campaign by a foreign adversary represents a serious threat to U.S. national security and is reminiscent of Moscow’s actions during the Cold War. As this CSIS Brief highlights, Moscow has long conducted an “active measures” campaign against the United States, including trying to manipulate U.S. domestic politics. U.S. policymakers now need a forceful response to Russia’s intelligence campaign.

20. The WTO's Existential Crisis: How to Salvage Its Ability to Settle Trade Disputes

US refusal to allow the appointment of new judges (or members) to the World Trade Organization’s Appellate Body—a key component of its renowned dispute settlement system—has pushed the organization into an existential crisis. The Appellate Body no longer has the requisite number of members to hear new cases on appeal. The terms of two of the three remaining members have expired, leaving the WTO without an appeal function. US officials charge that certain Appellate Body decisions on WTO dispute panel rulings have expanded WTO obligations and constrained WTO rights—what trade lawyers call “judicial overreach”—and so they have blocked the appointment of new Appellate Body members until other WTO countries address US complaints. Schott and Jung analyze the WTO cases brought against the United States and find that the problem of judicial overreach seems to surface primarily in a subset of US losses in antidumping and countervailing duty (AD/CVD) cases that target specific methods of calculating dumping margins. They warn that disabling the whole appellate system is a disproportionate response to the specific problem. It will weaken enforcement of WTO obligations and undermine prospects for negotiations to update the WTO rulebook, thus corroding the rules-based trading system, one that has been modeled on US law and practice. A better approach would be to exempt AD/CVD cases from appellate review (while still subjecting them to dispute panel rulings). This targeted change in the WTO Appellate Body process, coupled with procedural reforms already advanced in proposals that have been widely supported by WTO members, could mitigate US concerns and allow the Appellate Body to be repopulated.
