91. Sustainable aviation fuel policy in the United States: A pragmatic way forward

Abstract:
The aviation sector has been working to decarbonize, but it faces unique challenges since decarbonization options that may work for ground or maritime transport are generally not feasible for air travel. Sustainable aviation fuels (SAF) present an opportunity to decarbonize the aviation sector, but federal policies that address SAF have largely included SAF as an add-on to existing policies that are meant primarily to address ground transportation. However, due to the unique challenges presented to decarbonization by the aviation sector, the use of SAF should be incentivized through pragmatic, sector-specific federal policies. The new Atlantic Council report by Fred Ghatala, Sustainable Aviation Fuel Policy in the United States: A Pragmatic Way Forward, provides a set of near and long-term federal policy options that could be implemented in order to encourage the use of SAF. The report contextualizes each policy choice and explains the implications of each option, differentiating between policies that can be implemented in the near-term and policies that require long-term implementation.

92. China’s Response to Climate Change: A Study in Contrasts and a Policy at a Crossroads

China is the world’s leading emitter of heat-trapping gases, by far. In 2019, Chinese emissions were greater than emissions from the United States, the European Union, and Japan combined. There is no solution to climate change without China. China’s response to climate change is a study in contrasts. China leads the world in solar power, wind power, and electric vehicle deployment, but also in coal consumption. The Chinese government has adopted some of the world’s most ambitious energy efficiency and forest conservation policies, but is financing a significant expansion of coal-fired power plant capacity at home and abroad. China’s leaders are strongly committed to the Paris Agreement, but appear to attach less priority to climate change than in years past. This Asia Society Policy Institute issue paper, China’s Response to Climate Change: A Study in Contrasts and a Policy at a Crossroads, written by former senior policymaker and current Columbia University fellow David Sandalow, explores these contrasts. It does so at an important time in Chinese climate change policy. During the next 18 months, the Chinese government will spend heavily on economic stimulus measures, release its 14th Five-Year Plan (for 2021–2025), and develop short- and long-term climate action plans (known as its “updated nationally-determined contributions” and “mid-century strategy” in the terminology of the global U.N. climate process). Decisions by the Chinese government will reverberate globally, including in the United States. A potential Biden administration’s ambition in addressing climate change would be reinforced by ambition in China. This issue paper also provides an up-to-date snapshot of China’s climate policies, drawing on data from 2019 and the beginning of 2020 (during the height of the COVID-19 economic lockdown), as well as recent remarks by Chinese leaders. It starts by examining Chinese emissions of heat-trapping gases. It then discusses China’s principal climate policies, explaining the main tools the Chinese government uses to address climate change and related topics. The issue paper concludes with a discussion of processes that will shape Chinese climate change policy in the years ahead. This paper is the second in a series of policy products that the Asia Society Policy Institute will publish as part of a project exploring the possibilities around U.S.-China climate cooperation.

The 2017 hurricane and wildfire seasons were among the worst on record in the United States. The storms that year included three of the five costliest in the nation’s history: Harvey and Irma along the Gulf Coast, and Maria in the Caribbean. More than 70,000 wildfires scorched about 10 million acres. All told, these events affected the lives of nearly 47 million people, testing the Federal Emergency Management Agency (FEMA) in unprecedented ways.

Abstract:
The multilateral trading system under the World Trade Organization (WTO) has been of the utmost importance for Japan's trade policy. In particular, Japan strongly supports the WTO’s rule-based dispute settlement mechanism, and frequently uses it. At the same time, in recent years, the adoption and implementation of regional and mega-regional trade agreements have become critical in Japan’s trade policy, with the stalling of the Doha Round negotiations in the WTO. Although the core of its trade policy remains the same today, Japan has been forced to rethink and modify it in response to the aggressive and unilateral trade policy of the Trump administration.

Ifri’s Executive Chairman Thierry de Montbrial spoke at the 20th World Knowledge Forum in Seoul on September 25, 2019 with Robin Niblett, Chatham House's director, Ed Feulner, The Heritage Foundation's Founder and Former President and Feng Zhu, Director of the Institute of International Studies at Nanjing University about the major governance issues of our time. The global geopolitical situation is caught in a maelstrom. The conflict between the United States and China is getting worse and subsequent negative effects are rising. In Europe, Brexit is making the continent more divisive than harmonious. The instability in Middle East is not solved. In addition, the North Korea’s nuclear weapons are an endless source of problem that defies a quick solution, which made the politics surrounding the Korean Peninsula more complex. The problem is that the currently weak global governance may lead the global political landscape into a serious crisis. To give an answer to these problems, heads of top think tanks share their prospect and the future of the global governance, giving a guideline for each country to listen for a better direction.

96. Preferential Trade Agreements vs. Multilateralism: In the New Trump-World, Does Canada Face an Impossible Choice?

International trade is often framed in starkly divergent terms: either countries choose multilateral trade agreements (MTAs) and advance the cause of global economic liberalization, or they choose preferred trade agreements (PTAs) and put the entire system at risk. Canada has a long track record of pursuing PTAs and with the Trump administration’s opposition to multilateralism, and longstanding opposition in elements of the Republican and Democratic parties, this trend will likely continue. The question is whether progress will come at the expense of the global trade system. Some economists believe PTAs to be trade-diverting, reducing trade with more efficient producers outside the agreement. Others insist that PTAs can create trade by shifting production to lower-cost producers in one of the participating countries. One prominent contrary argument holds that PTAs lead to discontinuities in tariff regimes between countries and regions, increasing transaction costs, disrupting supply chains, creating opportunities for corruption and harming global welfare, especially in developing nations. While debate continues about the effects of PTAs, a closer examination suggests that worries are overblown about their negative impacts on global trade flows. Evidence indicates that they support rather than harm the international trading system. Countries shut out of PTAs are more motivated to seek out agreements in new markets, increasing liberalization overall. They may also seek a reduction in most-favoured nation (MFN) tariffs, which would deprive PTAs of their major tariff benefits. Studies have found complementarity between preferential and MFN tariffs, revealing that PTAs promote external trade liberalization. Even if a PTA reduces a given country’s incentive to push for multilateral liberalization, it raises the odds of that country liberalizing its trade to avoid getting left behind. PTAs are a response to the difficulties of securing sweeping multilateral agreements. The World Trade Organization (WTO) Agreements authorize them under GATT Article XXIV, GATS Article V, and the enabling clause, and the WTO facilitates a degree of governance over PTAs through its dispute settlement process. Over the past 25 years, countries have adopted these deals at a rapid pace. Between 1994 and 2005, the number of PTAs increased from 50 to 200. By April 2018, 336 were in effect. At the same time, global trade has increased significantly. Between 1994 and 2010, the volume of world merchandise exports more than doubled. The proliferation of PTAs has resulted in a rise in international trade governance, because the countries involved shape their relationships in line with the WTO agreements. This juridification makes PTAs subordinate to the international system rather than giving them room to dissolve it. Canada should therefore have no fear of pursuing PTAs within the larger framework of the effort to achieve multilateral trade liberalization.

97. From the Global to the Local: Leveraging International Engagement to Advance Justice at Home

This policy paper is authored by Maha Jweied, who served in the U.S. government between 2006-2018, most recently as the Acting Director of the U.S. Department of Justice’s Office for Access to Justice. Maha is currently a fellow at CIC-NYU and advisor to the Pathfinders for Justice. This paper sets out how the former U.S. Department of Justice’s Office for Access to Justice leveraged international activity and mechanisms, including the UN’s 2030 Agenda for Sustainable Development, to advance its domestic priorities. The strategy resulted in notable accomplishments and even protected a number of them after the office was closed in 2018. The brief also recommends that the incoming Biden-Harris Administration reestablish the Office for Access to Justice, revitalize the White House Legal Aid Interagency Roundtable charged with implementing Goal 16 for the United States, link U.S. domestic priorities to all 17 Sustainable Development Goals, and prioritize the United States’ role as a leader in the global movement for equal justice for all.

Abstract:
Keep a highlighter and pen handy. I don’t recall the last time I used the former so frequently or made so many comments in a book’s margins. Each draft of this review has had a different emphasis. The conclusion I reached was this: the reader will have an incredible number of issues to mull over, and this review simply cannot discuss every worthwhile topic. Thus, while not a casual read, this volume certainly is a rewarding one. The book commences with a basic political insight: a constitution originating in one country may not be transplanted to another country and be expected to work in the same manner as it had in the country of origin. This book demonstrates the many reasons why that is so, and more particularly, how current legislative and executive practices have undermined the framers’ understanding of the rule of law. In sum, our nation’s governance has become increasingly arbitrary under a system the authors aptly describe as “quasi-law.”

99. Reflections on Judicial Duty

Abstract:
In this timely study Bruce Frohnen and George Carey uncover serious lapses in the operation of our federal government—lapses which constitute a depressing failure to be true to the Constitution. The authors charge all three branches of the federal government with neglect of their constitutional duties and, all too often, exceeding their constitutional authority. Congress has delegated law-making responsibilities to administrative agencies and has not exercised oversight of the agencies it has created. Presidents have usurped lawmaking functions through executive orders, and the Supreme Court has failed to check the reach of the legislative and executive branches. I applaud the authors’ efforts to call attention to these serious problems. While I agree with the Frohnen and Carey concerning the Court’s failure to check the excesses of the executive and legislative branches, especially during the New Deal, I respectfully disagree that the Supreme Court has exceeded its judicial power. To make their case, our authors focus on just one highly controversial and unpopular case, Roe v. Wade. I will argue that the Court in this matter has remained within its constitutional boundaries, following common law and its own self-imposed rules.

Abstract:
My thanks to the participants in this symposium. I know that my co-author, George Carey, would be as gratified as I am at the serious consideration given, here, to Constitutional Morality and the Rise of Quasi-Law. At first I was puzzled by William Gangi’s summation of our book as one that addresses the adage that “a constitution originating in one country may not be transplanted to another country and be expected to work in the same manner as it had in the country of origin.” The book includes some comparative analysis of constitutions to show their reliance on the underlying culture for their success and the importance of the fit between tradition and text. Still, it focuses on the American Constitution, not on the application of any country’s constitution to other countries. Then again, as Gangi notes, in a more fundamental sense our book is about the interaction between the written constitution of the United States and the unwritten constitution of institutions, beliefs, and practices that shaped the American people, the American culture, and the constitutional morality that until fairly recently held officials to their public duties. This is a particular instance of the universal problem of “fit” between constitution and culture.
