1. Tesla as a Global Competitor: Strategic Control in the EV Transition

Abstract:
In this paper, we assess the implications of Elon Musk’s strategic control over Tesla, the pioneering company that has become central to the electric vehicle transition. We document how, as Tesla’s CEO for 16 years, Musk has exercised strategic control to direct the transformation of the company from an uncertain startup to a global leader. Now that Tesla is profitable corporate predators (aka hedge-fund activists) may challenge Musk’s strategic control—a possibility of which the CEO is well aware. To retain his control over Tesla as a publicly listed company, Musk depends on holding a sufficient proportion of Tesla’s shares outstanding to possess the voting power to fend off predatory value extractors. In addition to accumulating Tesla shares by investing $291.2 million at early stages of the company’s evolution, Musk has relied upon massive stock-option grants from the Tesla board, under the guise of “compensation”, in 2009, 2012, and 2018, to boost his shareholding and, with it, his voting power. Hence the Delaware Court of Chancery’s decision in January 2024 to rescind Musk’s 2018 stock-option package—by far the largest ever granted to a corporate executive—poses a threat to Musk’s strategic control at Tesla. As the “Technoking” of Tesla strategizes to maintain his control over the company’s decision-making, anyone concerned with the role that Tesla will play in the evolving EV transition should be asking how CEO Musk might use, or abuse, his powerful position.

Abstract:
The impact of the green tech trade war between the United States and China, which began with US semiconductor export controls, is now being felt in other areas. In December 2023, China introduced export controls on graphite, a key element used in the production of noncarbon technologies like batteries and solar panels. The effects were immediate: Chinese graphite exports to the rest of the world declined by 93 percent (by volume) in a single month. Exports to the United States and Japan—which is collaborating with the United States on semiconductor controls—dropped to zero.1 But although China is the largest player, it is not the only graphite producer in town. This Policy Brief assesses the prospects for three Sub-Saharan African countries—Madagascar, Mozambique, and Tanzania—for providing stable supplies of natural graphite to the US market, considering both domestic factors in the three countries and US policies established by the Inflation Reduction Act (IRA). These countries have adequate graphite resources and operators headquartered in Western allies. The problem is that there are significant governance-related challenges in Madagascar and Mozambique and some domestic challenges to incorporating East African graphite into US electric vehicle (EV) supply chains. US critical mineral sourcing policies will need to be modified to facilitate greater involvement of African producers in US graphite supply chains.

3. Industrial policy for electric vehicle supply chains and the US-EU fight over the Inflation Reduction Act

Abstract:
The Inflation Reduction Act (IRA) of 2022 provoked a transatlantic trade spat. After the law was passed, the Biden administration addressed some of the concerns raised by the European Union by writing controversial rules to implement the legislation. These regulations are expected to have complex effects that, in some instances, may offset the intended impact of other provisions in the original legislation. This paper examines how the law, its implementing regulations, policy decisions on leasing, as well as potential critical minerals agreements all have the potential to affect the electric vehicle (EV) supply chain. The EV case study showcases the political-economic complications involved in US and EU attempts to cooperate over clean energy transition policy to address the global externality of carbon dioxide emissions. EVs are but one example of the challenge facing partners with integrated supply chains and similar levels of economic development that share concerns about climate change, rising inequality, workers, other social issues, and democracy itself. The EV conflict laid bare the differing US and EU prioritization of these issues relative to economic efficiency, World Trade Organization rules, the approach to nonmarket economies, and national security vulnerabilities that arise from depending on an authoritarian regime such as China for import sourcing of critical inputs.

4. How the United States solved South Korea’s problems with electric vehicle subsidies under the Inflation Reduction Act

Abstract:
South Korea felt “betrayed” when President Joseph R. Biden Jr. signed his administration’s flagship climate legislation, the Inflation Reduction Act (IRA) of 2022, into law. This paper first shows how the Biden administration addressed Korea’s concerns about the law’s effect on its sales of electric vehicles (EVs) in the United States. Thanks in part to the Treasury Department’s regulations written to implement the law, Korean exports of EVs to the United States grew even after the IRA went into force. Whether these actions by the Biden administration are enough to assuage the concerns of the Koreans—and other allies adversely affected by the IRA—remains to be seen. Furthermore, the US accommodation of Korean concerns came with tradeoffs by offsetting key incentives Congress may have intended in passing the IRA. The paper examines the potential impact of the law on South Korean battery companies, and it provides an initial exploration into how the Korean government responded to the IRA by adjusting its own policy mix of EV consumer tax credits and industrial policy for its EV plants and battery makers.
