81. The Privatisation of Security and the Market for Cyber Tools and Services

Abstract:
This paper seeks to identify the emerging and expanding gaps in the governance of private cybersecurity companies and activities and to explore ways forward and policy options for governments. The first section of the paper will explore the characteristics of typical cyber operations and challenges related to their conduct by private actors. Section two will address the governance challenges around cybersecurity and three main departure points for regulation: the fact that geographic scope does not limit cybersecurity companies, that cyber operations can slide from defensive to offensive very quickly; and that cybersecurity services are often exported for the purpose of (or with the knowledge they will be) violating human rights. This section will also integrate perspectives of international law. Section three will lay out suggestions for policy options in relation to international law and existing international normative frameworks. In conclusion, the paper will offer a framework and way forward as food for thought in order to address cybersecurity operations in relation to PMSCs.

This is largely because demand is significantly outpacing supply, large candidate pools are left untapped, employer requirements aren’t well sync’d to the skills needed, and awareness of cyber career paths remains low. After months studying the challenge, the Aspen Cybersecurity Group offers a mix of principles, partnerships, and specific steps employers can take to close the skills gap.

Abstract:
In the last decade, one can notice the huge interest of researchers in the field of cyberpolicy, which is primarily due to the widespread use of the Internet in the public space. This fact is also an impulse for conducting interdisciplinary research that combines knowl- edge from social sciences on the one hand, and uses content from technical sciences on the other. Compared to the form of conducting election campaigns in the 20th century in the U.S., during the 2016 election campaign there were significant changes in the conduct of po- litical struggle. These changes consist above all in the use of cybernetic tools, which to a large extent, however difficult to determine, shaped electoral behavior. The contemporary political competition is more and more dependent on technology, which becomes the main element of the professionalization of election campaigns. Investigating the impact of cyberspace on electoral results is a big challenge, considering the fact that the area of cybertechnology is extremely complex. Cyberspace has now become a field for many political phenomena that are constantly evolving and in most cases their importance is immense for the functioning of the political system. The article is intended to deal with selected phenomena related to cybertechnology that were compared with other events from the U.S. election campaign in 2016. The article aims to investigate selected events resulting from the use of cybertechnol- ogy, which had an impact on electoral behavior.

This comparative project evaluates the role of firms, governments, and other key stakeholders in the rise of industrial policy in important states in the cybersecurity industry. In particular, we focus on the U.S., China, Taiwan, Japan, the EU and other key European states. Our goals are as follows: 1) to examine the motivation for government promotion of the cybersecurity industry; 2) to inventory existing measures employed by these countries; 3) to understand the driving forces of cybersecurity industrial policy in these countries; and 4) to examine the likely conflicts that will arise from the competitive pursuit of such industrial policies and how they might possibly be resolved through international cooperation. To this end, we suggest an analytical framework to serve as the comparative structure for this project, drawing on a variety of approaches to understand industrial policy.

Abstract:
Elections, when free and fair, are regular and legitimate occasions to vie for power in a democratic country. In order to compete and to be elected, political competitors, usually organized into parties or movements, must follow the democratic principles that rule electoral competitions. There are numerous international regulations that set worldwide standards for democratic elections, which have been adopted by many countries and that constitute the concept of electoral integrity.[1] This refers not only to management of the so-called e-day (election day), but also includes many provisions that must be respected throughout the electoral cycle.

Abstract:
U.S. policy faces numerous challenges in Central Asia, such as the decreasing U.S. military and economic resources in the region; Russian and Chinese hostility to a long-term U.S. military presence in Eurasia; restrictions on religious and other freedoms due partly to counterterrorism concerns; limited U.S. involvement in the region compared to other external players (like Japan as well as Russia and China); an undeveloped U.S. policy regarding regional multinational institutions; and the indifference and ignorance of U.S. business toward regional commercial opportunities beyond the energy sector. However, advocates of “America First” in the Trump administration do not see these threats as sufficiently serious to garner U.S. military intervention beyond occasional training, equipping, and intelligence sharing. Terrorism, drug trafficking, economic isolation, and human rights restrictions in Central Asia do not present an immediate existential threat to the United States, sowing ambivalence over the future of U.S. foreign policy in the region.

Abstract:
Generating the innovation to sustain the United States’ technology-based military superiority will, of necessity, be a core element of defense strategy for the Trump Administration. This paper identifies the challenges faced by the DoD’s large, multi-faceted research and development ecosystem in meeting that national security goal, and proposes a holistic and balanced strategy for addressing them. Fundamentally, the outgoing Obama Administration concluded that the U.S. military dominance against our near-peer adversaries is eroding in a globalized environment where commercial innovation is not only being rapidly generated through agile and fast-paced processes but is being rapidly disseminated globally and therefore available to potential adversaries. In contrast, the DoD faces the challenge of building a future force that is second to none while using internal processes that generally are overly cumbersome, somewhat antiquated and slower—processes which constrain its ability to access all available innovation, commercial and otherwise, and to rapidly transition that technology to the war fighter in order to produce robust effects on the battlefield. Notwithstanding years of studies that have highlighted well known institutional obstacles to change in both our defense R&D ecosystem and the Department more broadly, these challenges still largely remain. Numerous DoD initiatives to address these issues and incentivize change unfortunately have not moved the needle.

Russia’s interference in the 2016 presidential election was an attack on the American people, threatening the integrity and legitimacy of the democratic process, as well as the outcome of the election. And yet, the Intelligence Community Assessment on Russian activity in the election found that this was but the most recent and aggressive expression to date of a longstanding Russian desire to sow chaos and instability in the United States. Russia’s meddling in the 2016 election should be a wake-up call to every American about the diverse ways in which Russian malicious cyberactivity could affect every aspect of their lives.1 The so-called information warfare campaign ordered by Russian President Vladimir Putin during the election is part-and-parcel of a longstanding and multi-faceted Russian intelligence strategy that “blends covert intelligence operations—such as cyberactivity—with overt efforts by Russian Government agencies, state-funded media, third-party intermediaries, and paid social media users or ‘trolls’” in order to cripple its adversaries.2 The election is not the first time Russian cyberactors have been successful. Over the past decade, Russian hacking groups—many of which are backed by the government—have successfully deployed a technology-based strategy to infiltrate, tamper with, and steal sensitive information across government, military, banking, and communications systems in the United States and Europe.

After five years of publishing the Marine Corps University Journal, MCU Press looks forward to an exciting future by redesigning and reformatting the journal to emphasize its role in supporting the national conversation. The new MCU Journal will focus on publishing established authors along with young, emerging scholars, combining the strengths of both on themes of international relations, national security, political science, and other disciplines. By engaging authors in a variety of fields, we can cross disciplines to bring new knowledge, constructs, and solutions to our readers. Moreover, by bridging the civilian and military divide, our audience can read about different perspectives on policy and contemporary issues. For the spring 2016 issue, we have done just that with articles on domestic and international topics as well as book reviews, all of which represent the ideas being broached by academic scholars, think tank analysts, and military leaders. Headlines so far for 2016 have highlighted the fact that the United States seems to be lagging on the cyberfront. Journalists, in such stories as “Federal Government Confirms That It Still Sucks at Cyber Security” and “New Military Outfit to Enhance China’s Cyber Security, Espionage Prowess,” point to a higher level of advances being made overseas as our own government struggles to safeguard what should be secure networks and the identities of millions. These recent issues might make the casual reader wonder how our military intends to counter cyberattacks from foreign soils when the government cannot seem to manage at home.
