Abstract:
Advancing U.S. national interests in an era of global threats depends on effective multilateral action. Global institutions inherited from the past are struggling to adapt to the rise of new challenges and powers. “The international architecture of the 20th century is buckling,” declares the new U.S. National Security Strategy. President Barack Obama has committed his administration to renovating outdated institutions and integrating emerging powers as pillars of a rule-based international order. Renovation of the United Nations Security Council (UNSC) and its membership must be a core component of this agenda. President Obama's announcement in November 2010 of U.S. support for a permanent UNSC seat for India is a critical first step in this direction.

In June 2010 intercommunal violence exploded in Kyrgyzstan's southern cities of Osh and Jalalabad, resulting in the dramatic scene of thousands of ethnic Uzbeks fleeing their homes to avoid persecution by groups of ethnic Kyrgyz (allegedly backed by government troops). Reports of arson, rape, and other atrocities were widespread, accompanied by varying accounts of the number of civilians killed.1 The response to the persecution and displacement followed a pattern that we have seen before: calls for urgent international action by nongovernmental organizations, such as Human Rights Watch and the International Crisis Group, followed by a muted response on the part of international organizations (in this case, the Organization for Security and Co-operation in Europe and the United Nations Security Council). While both Russia and the United States were active in supporting efforts to organize humanitarian assistance to those affected by the violence, neither state was prepared to tackle the political and logistical challenge of deploying military forces to the region to protect civilians.

Ten years have passed since the adoption of the Convention Against Transnational Organized Crime (the Palermo Convention) by the UN General Assembly on November 15, 2000. At the signing of the convention in Palermo, Sicily, in December 2000, many government delegations welcomed the Palermo Convention as an important step in the fight against organized crime. Some warned against viewing it as a final measure and stressed that the convention and its protocols should be considered as a starting point rather than an end in itself.

The past decade has seen a nine-fold increase in UN peacekeeping operations. With over 123,000 deployed personnel across 16 missions, and at a cost of approximately USD 8 billion per year, the scale of United Nations (UN) peacekeeping today is unprecedented. While prior reforms have enabled growth and helped to define the core strengths of operations, UN peacekeeping now finds itself, once again, at a crossroads: 'The scale and complexity of peacekeeping today are straining its personnel, administrative and support machinery.' The peacekeeping partnership is under stress – among contributors, the Security Council, and the UN Secretariat. Several current peacekeeping missions are deployed beyond their doctrinal and capacity comfort zones.

Der Report analysiert die Entscheidungsprozesse des Sicherheitsrats der Vereinten Nationen, die am 3. Dezember 1992 zu der Verabschiedung der Somalia‐Resolution 794 geführt haben. Fürdie Analyse wird der Multiple‐Streams‐Ansatz verwendet. Im Rahmen des Ansatzes warden Entscheidungssituationen als mehrdeutige Stimuli in Bezug auf Informationen, Ziele und Messkriterien betrachtet. Entscheidungen sind vor einem solchen Hintergrund oft weder rational begründbar, noch sind sie gezwungenermaßen linear‐kausal mit einem bestimmten Problem verbunden. Die Organisation ist stets mit einer hohen Anzahl von simultan auftretenden Problemen und Optionen konfrontiert und muss unter Zeitdruck bestimmen, welche Probleme und Handlungsoptionen auf die Agenda gesetzt werden und in welchen Themenbereichen eine Entscheidung ansteht. Lösungen werden hierbei zu einem bestimmten Zeitpunkt (künstlich) in Übereinstimmung mit Problemen und Akteuren gebracht und in eine Entscheidung transferiert. Die Untersuchung führt zu dem Ergebnis, dass die Verabschiedung der Resolution 794 weniger auf die tatsächliche Problemlage in Somalia zurückzuführen war als auf Dynamiken des amerikanischen Wahlkampfs und den stetigen Einsatz des VNGeneralsekretärs Boutros Boutros‐Ghali.

77. Close Encounters of a Sovereign Kind

Abstract:
This article considers the prominence that threats of force have had in international political life since the end of the Cold War, and how we tend to overlook these threats in favour of the actual uses of force. Security Council Resolution 678 of November 1990 is one such example. Emblematic of the rule of law and its New World Order, it is often invoked for the 'authorisation' it gave to Member States of the United Nations 'co-operating with the Government of Kuwait ... to use all necessary means to uphold and implement resolution 660 (1990) and all subsequent resolutions and to restore international peace and security in the area' - but this provision was made contingent upon whether 'Iraq on or before 15 January 1991 fully implements [previous] resolutions'. We examine the range of circumstances in which threats of force have arisen and find that these go beyond the archetypal 'close encounter' between states - such as the Cuban Missile Crisis of 1962 and the 'threats of force' directed against Iraq prior to Operation Desert Fox (1998) and Operation Iraqi Freedom (2003). Making use of the jurisprudence of the International Court of Justice from its Nuclear Weapons advisory opinion (1996), we advance the idea of a prohibition of the application of force, and consider the logistics of its operation in state practice; first, in the recent relations between the United States and Iran and, then, through a modern reprise of the facts of the Corfu Channel Case of April 1949. We allude to the importance of the legislative background and purpose behind this prohibition, constantly reflecting upon the intricacies of state relations in which this provision of the United Nations Charter seeks to make its mark.

78. The Somali conflict: The role of external actors

Somalia has been without a functioning state ever since 1991, when the former dictator, Siyad Barre, was overthrown. None of the competing factions were strong enough to take his place as ruler of the country, producing first chaos, but gradually a form of stateless order. The international interventions have ever since the failed, and counter-productive intervention by the United Nations and the United States in the early 1990 exacerbated rather than mitigated the problems, let alone solved them. This was especially the case for the Ethiopian invasion (December 2006-January 2009), which produced utter chaos and a severe humanitarian crisis. Since the withdrawal of the Ethiopian forces, Islamist extremist militias have been establishing control of Somalia, and they may or may not be able to maintain this control. If they pursue their radical programme of Islamisation, their reign is likely to be short, but if they moderate themselves they may retain control.

To the Editor:The shift in U.S. nuclear policy advocated by Ivo Daalder and Jan Lodal ("The Logic of Zero," November/December 2008) might make sense for a number of important reasons -- not least among them safety, cost, and reducing the risk of annihilation through miscalculation. But it would be naive to expect any of the authors' recommendations to alter the decision-making of the rogue states that are currently pursuing nuclear technology. Assuming it were feasible, even the complete elimination of the United States' nuclear arsenal would almost certainly have little positive effect on Tehran's or Pyongyang's proliferation, as the same complex set of internal and external factors now driving their policies would persist, as would their perceived vulnerability to U.S. conventional superiority. The less drastic measures the authors call for, such as Washington's accepting international oversight over its own fissile material, far from enhancing the likelihood of reaching agreements with rogue states, would probably barely register in negotiations.

80. The Future of Foreign Assistance Amid Global Economic and Financial Crisis

Though the United States of America faces its toughest budgetary and economic challenges since the Great Depression, it cannot afford to eliminate, or even reduce, its foreign assistance spending. For clear reasons of political influence, national security, global stability, and humanitarian concern the United States must, at a minimum, stay the course in its commitments to global health and development, as well as basic humanitarian relief. The Bush administration sought not only to increase some aspects of foreign assistance, targeting key countries (Iraq and Afghanistan) and specific health targets, such as the President's Emergency Plan for AIDS Relief and the President's Malaria Initiative, but also executed an array of programmatic and structural changes in U.S. aid efforts. By 2008, it was obvious to most participants and observers that too many agencies were engaged in foreign assistance, and that programs lacked coherence and strategy. Well before the financial crisis of fall 20 08, there was a strong bipartisan call for foreign assistance reform, allowing greater efficiency and credibility to U.S. efforts, enhancing engagement in multilateral institutions and programs, and improving institutional relations between U.S. agencies and their partners, including nongovernmental organizations (NGOs), recipient governments, corporate and business sector stakeholders, faith-based organizations (FBOs), academic-based implementers and researchers, foundations and private donors, United Nations (UN) agencies, and other donor nations.
