391. Syria Under Bashar (I): Foreign Policy Challenges

Abstract:
Since the end of the Iraq war, Washington and Damascus have been locked in a dialogue of the deaf. U.S. policy has been reduced to a series of demands and threats. Syrian policy, with President Bashar still struggling to formulate and implement a coherent strategy, has been mainly wait-and-see – offering a few concessions and hoping to weather the storm while refusing to relinquish what it sees as trump cards (support for Hizbollah and radical Palestinian groups) so long as the conflict with Israel continues. Despite the current deadlock, however, the current regional situation presents an opportunity for an intensive, U.S.-led diplomatic effort to revive the Israeli-Syrian peace process and thereby achieve significant changes in Syrian policy.

With a decision notably brief for the mountain of argument leading up to it, the U.S. Supreme Court in Rasul v. Bush held on June 28, 2004, that foreign nationals imprisoned without charge at the Guantanamo Bay interrogation camps were entitled to bring legal action challenging their captivity in U.S. federal civilian courts.

Abstract:
The Yemeni media recently reported that thousands of Iraqis who fled Saddam Husayn's brutal regime and have lived in Yemen for more than a decade are now thinking about returning home. Many of these individuals are encouraged by signs of new infrastructure and a recovering economy in Iraq. If and when they return, they will see a number of stark similarities between their old homeland and Yemen, including primordial federalism, a "triangle" of terrorism, and questions of Sunni-Shi'i relations. Although Yemen is certainly not a model to which Iraq should aspire, San'a does have experience in dealing with challenges similar to those currently facing Iraq. Yemen's handling of these challenges provides reasons for cautious optimism about Iraq's future.

Abstract:
September 11 is a date that has become fixed in the calendar of public memory. For one side in the conflict between the United States and the Islamic network opposed to its power in the Middle East, the shocking display of destruction is remembered as a day of infamy; for the other side, as a day of martyrdom. Which of these claims is true—indeed, whether either is true—depends on the identity and political imagination of the person doing the remembering. But regardless of which meaning the day is now made to bear, the leadership on both sides of the conflict agree on one thing: this was a moment in time that cannot and should not be forgotten. For some, on both sides, 9/11 deserves to be seen as a genuine turning point in history, changing the global political order in a way that allows no going back. For others, again on both sides, it might more usefully be seen as a moment of illumination, when the sudden flash of violence lit a political landscape whose contours theretofore had been difficult to see.1 Whether as a turning point or a moment of illumination, whether as infamy or martyrdom, 9/11 has become a point in time signifying more than the events that took place on that day.

Abstract:
The US carried out the Iraqi occupation quickly, easily and with few casualties. It put an end to the security bureaucracy in the name of building new Iraq after the war. After a short while it faced unexpected resistance in the regions where Sunnite Arabs live. Insurgents have proved by their choice of targets and use of methods that they have a long-term and systematical resistance strategy. The insurgents could organize quickly because of effective tribal order, power of old security bureaucracy which kept its integrity after the war and refusal of foreign occupation. Insurgents want to control the public in order to get rid of weakness. Therefore, the keypoint of contention is who will control the public. While insurgents commonly use "terror" and "violence", occupiers try on the one hand to make insurgents ineffective, on the other, to win the "heart and brain" of the public. Security questions may spread to whole country in Iraq where there are ethnic and religious struggles. Iraqi Shiites may be involved in the conflict. Kurdish claims on Kirkuk may bring an ethnic conflict to the agenda. If the US administration can't provide stability in Iraq as soon as possible, Iraq may drift into a civil war.

396. Preventing Nuclear Terrorism: A Progress Update

In the past year, there has been notable progress in ensuring that stockpiles of the essential ingredients of nuclear weapons around the world are secured from theft and transfer to terrorists. But there remains a dangerous gap between the pace of progress and the scope and urgency of the threat – a gap that, if left unfilled, could lead to unparalleled catastrophe. We must close the gap – to take action now that, within a few years, could reduce the danger that terrorists might turn the heart of a U.S. city into a new Hiroshima to a fraction of what it is today. This paper is intended to outline the continuing threat; summarize the progress made in addressing it in the past year, and the gaps that still remain; and recommend steps to close the gap between threat and response. The terrorists who have sworn to kill Americans wherever they can be found have undertaken an intensive effort to get a nuclear bomb, or the materials and expertise needed to make one. We need to be racing as fast as we can to stop them before they succeed. This paper is about steps to win that race.

The challenge of preventing and responding to the new security threats is very different from the one we, as a nation, faced in the Cold War. Today, the private sector is on the frontline of the homeland security effort: Its members are holders of information that may prove crucial to thwarting terrorist attacks; stewards of critical infrastructure that must be protected and dangerous materials that could be used to do harm; and important actors in responding to attacks. As we said in our first Task Force report, private sector information is essential to counter-terrorism, and government agencies should have timely, needed access to that information, pursuant to guidelines that give confidence that the information will be used in a responsible way.

398. Protecting the American Homeland: One Year On

Abstract:
Since the attacks of September 11, 2001, a good deal has been done to improve the safety of Americans, not only in the offensive war on terror abroad but in protecting the homeland as well. Now aware of the harm terrorists can inflict, Americans are on alert, providing a first, crucial line of defense. Air travel is much safer. Intelligence sharing has improved, especially information about specific individuals suspected of ties to terrorism. Measures have been taken to ensure that suspicious ships entering U.S. waters are screened more frequently. Some early steps, with more to follow, have been taken to reduce the country's exposure to biological attacks, and oversight has been tightened on labs working with biological materials. Terrorism insurance is now backstopped by a new federal program. Certain types of major infrastructure, such as well-known bridges and tunnels and nuclear reactors, are protected by police and National Guard forces when terrorism alerts suggest that such measures are necessary.

Currently, the United States relies on conventional bunker-busting bombs—such as the GBU-28, which was used in both Afghanistan and Iraq—to destroy hardened, underground targets. Legislation is pending in Congress that would provide funding for research—but not engineering or development—for low-yield, earth-penetrating nuclear weapons for targets that cannot be destroyed by conventional bunker busters.

The Constitution of the United States of America makes clear that one of the paramount responsibilities of the federal government is to "provide for the common defense." In the past, the primary threats to the United States and U.S. interests were hostile nation-states. Today, the real threat to America is terrorist groups, specifically the al Qaeda terrorist network. Therefore, al Qaeda, not rogue states, should be the primary focus of U.S. national security strategy.
