Abstract:
According to mainstream functionalist theories of international law and relations, international organizations are vehicles of states, tied to their masters by meticulous legal instructions. As Jan Klabbers recently pointed out in this journal,1 functionalism was based on the idea of establishing peace by channelling international relations into the purportedly technical, a-political realm of international organizations. Research of the last couple of decades has profoundly rebutted the assumption that international organizations are a-political. They have been discovered, among others, to serve as platforms for the formation of epistemic communities, as agorae for political deliberation and contestation or to use their bureaucratic potential and the flexibility of their mandates to establish a degree of independence from their principals. The book by Tana Johnson, professor of political science at Duke University, adds another important perspective that has not been explored so far. She turns our attention to the fact that institutional design might matter for the international organization’s independence from member states. As chief witness for her thesis, she summons the Intergovernmental Panel on Climate Change (IPCC). Originally a brainchild of the US government, it is today a fairly independent institution fallen from grace with its master. Johnson argues that it owes its independence to the influence of international bureaucracies – that is, staff of other international organizations, upon the process that led to its establishment. The thesis puts the spotlight on the fact that a majority of new international organizations that saw the light of the day during the last decades was fostered by pre-existing international organizations.

Before the ink on the Treaty of Versailles was dry, the idea of creating an organization dedicated to educating, informing and advising future leaders about the causes and consequences of war was already gaining traction. At 'a series of unofficial meetings held in Paris in 1919',1 Lionel Curtis, an Oxford professor and visionary with a reputation for possessing an impressive array of entrepreneurial skills, was spearheading efforts to establish an Anglo-American research institution where scholars could explore international problems and advocate policy solutions.2 This kind of organization appealed to Curtis and to those with whom he discussed it for several reasons, not the least of which was that it could provide a valuable forum for both policy-makers and prominent policy experts in the leading western powers to talk to one another about international affairs. It was also a concept with which several of the delegates attending the Paris peace talks had some familiarity. In the nineteenth and early twentieth centuries a number of institutions had already taken root in Great Britain and in the United States with the aim of helping policy-makers navigate their way through complex policy problems. They included the Royal United Services Institute for Defence and Security Studies (1831), founded by the first Duke of Wellington; London's Fabian Society (1884), home to a number of prominent scholars, including Sidney and Beatrice Webb, co-founders of the London School of Economics; the Washington-based Carnegie Endowment for International Peace (1910), established by the Scottish-American steel tycoon Andrew Carnegie; and the Institute for Government Research (1916), which merged with two other institutions to form the Brookings Institution in 1927.3 Curtis and his colleagues in Great Britain and the United States were also aware of the ground-breaking research that had been conducted at hundreds of settlement houses in their respective countries. It was at places such as London's Toynbee Hall (1884) and Chicago's Hull House, co-founded by Jane Addams in 1889, that sociologists and other university faculty with expertise in social welfare policy could study the working conditions of the poor.4 In short, proponents of establishing a foreign affairs research institution recognized the importance of encouraging a dialogue between leading social scientists and high-level policy-makers.

3. Who Runs the International System? Power and the Staffing of the United Nations Secretariat

Abstract:
National governments frequently pull strings to get their citizens appointed to senior positions in international institutions. We examine, over a 60 year period, the nationalities of the most senior positions in the United Nations Secretariat, ostensibly the world's most representative international institution. The results indicate which nations are successful in this zero-sum game, and what national characteristics correlate with power in international institutions. The most overrepresented countries are small, rich democracies like the Nordic countries. Statistically, democracy, investment in diplomacy, and economic/military power are predictors of senior positions, even after controlling for the U.N. staffing mandate of competence and integrity. National control over the United Nations is remarkably sticky; however the in influence of the United States has diminished as US ideology has shifted away from its early allies. In spite of the decline in US influence, the Secretariat remains pro-American relative to the world at large.

Nye led a seminar on presidents and the creation of the American era at Georgetown University's Mortara Center for International Studies. At the 17 th Conference of the States Parties to the Chemical Weapons Convention (CWC) held in November 2012, the subject generating the most debate concerned the place of non-governmental organisations (NGOs) in CWC meetings and whether their role should be rather passive (i.e. 'attend') or be characterised by more active involvement (i.e. 'participate'). The latter option would allow them to address States Parties at meetings or organise side events within (rather than outside) the conference building. Addressing one of the core functions of the disarmament treaty, Libya, Russia and the United States reported in detail on progress and issues affecting the destruction of their respective chemical weapon (CW) stockpiles. Despite the fact that all three countries had missed the ultimate destruction deadline of April 2012, no state raised its flag to comment, question or protest about the delays. When the negotiators of the CWC concluded their business in September 1992 and decided to forward the treaty text to the UN General Assembly (UNGA) for assent, missing the destruction deadlines was universally viewed as one of the worst possible breaches of the CWC. In practice, a robust verification regime combined with permanent in - formation sharing, voluntary transparency beyond the requirements in the Convention, and dialogue over the years yielded commonly approved decisions to extend the destruction deadlines with strict monitoring and reporting requirements. Confident that the holders of the three largest declared CW stockpiles have no malicious intent, States Parties can continue with the implementation of all dimensions of the CWC without recriminations or deadlock.

Section 337 of the Tariff Act of 1930 gives the United States International Trade Commis¬sion (ITC) the power to exclude products from the United States that are imported pursuant to “unfair methods of competition.” The range of potential activities covered by the law is broad, but the most common claim brought before the ITC is patent infringement. In addition to fil¬ing a lawsuit in federal district court, U.S. pat¬ent holders can often use Section 337 to bring a second case over the same subject matter as long as the defendant imports the impugned product from abroad. This tactic has become increasing¬ly popular because the ITC renders its decisions relatively quickly and has the authority to order a very powerful remedy—total exclusion of the product from the U.S. market.
