Abstract:
Since the 2010 earthquake, almost $6 billion has been disbursed in official aid to Haiti, a country with a population of just under 10 million. An estimated $3 billion has been donated to NGOs in private contributions in addition to official aid. The United States Government alone has disbursed almost $2 billion of this total amount and has pledged over $3 billion for relief and reconstruction.

Abstract:
Considering the fact that less systemic sensitivity has appeared towards U.S. military actions on the global scale and that the great powers in the international system do not engage in any serious effort at preventing this state, the role of domestic interest groups has increased as has the president's attention to their opinions. Despite the fact that no serious threat to U.S. security existed and the country's national interests were not at stake, Barack Obama ordered the use of military force against Muammar Gaddafi. Liberal humanists in the power structure played a crucial role in order to make the necessity of attack inevitable by aggrandizing the threat. By embracing the opinion expressed by the liberal humanists and repeating this aggrandizing for election purposes as well as for preserving his own liberal base, Barack Obama found a military attack on Libya rational and necessary.

Abstract:
Natural disasters such as earthquakes, floods, and hurricanes can devastate people's lives and a country's economy, particularly in the developing world. More than 200,000 people perished when a catastrophic earthquake struck Haiti in January 2010, and Americans responded with an outpouring of private and public assistance. Those relief efforts, as they nearly always do, focused primarily on delivering aid. The United States barely used another tool for disaster relief: migration policy. This policy brief explores the various legal channels through which the U.S. government could, after future overseas disasters, leverage the power of migration to help limited numbers of people. We describe what could have been done for Haiti, but the lessons apply to future scenarios.

Abstract:
After a natural catastrophe in a developing country, international migration can play a critical role in recovery. But the United States has no systematic means to leverage the power and cost-effectiveness of international migration in its post-disaster assistance portfolios. Victims of natural disasters do not qualify as refugees under U.S. or international law, and migration policy toward those fleeing disasters is set in a way that is haphazard and tightly constrained. This paper comprehensively explores the legal means by which this could change, allowing the government more flexibility to take advantage of migration policy as one inexpensive tool among many tools for post-disaster assistance. It explores both the potential for administrative actions under current law and the potential for small changes to current law. For concreteness, it focuses on the case of the 2010 earthquake in Haiti, but its policy lessons apply to future disasters that are sadly certain to arrive. The paper neither discusses nor recommends "opening the gates" to all disaster victims, just as current U.S. refugee law does not open the gates to all victims of persecution, but rather seeks to identify those most in need of protection and provide a legal channel for entry and integration into American life.

25. New SME Financial Access Initiatives: Private Foundations' Path to Donor Partnerships

Abstract:
In recent years, a number of private foundations and organizations have launched ambitious initiatives to support promising entrepreneurs in developing countries, on both a for-profit and not-for-profit basis. Many of these programs have focused exclusively on building business capacity. While these tailored programs play an important role in supporting small- and medium-sized enterprise (SME) development, their overall effectiveness remains hamstrung in part by continuing constraints on entrepreneurs' access to expansion and operating capital. Simultaneously, the U.S. government, other bilateral donors, and international financial institutions (IFIs) have launched a series of initiatives that provide both financial and technical assistance to SMEs in developing countries. Surprisingly, collaboration or formalized partnerships between private foundations and donor agencies has been somewhat limited-particularly on a strategic or globalized basis. This paper is targeted for these private foundations, especially those focused on women entrepreneurship. First, it provides a brief literature review of the rationale for and against SME initiatives. Second, it presents an overview of existing targeted USG and IFI programs. Lastly, it offers several new, incremental options for private foundations to establish focused partnerships with donor agencies in support of their ongoing organizational goals.

26. Defending Democracy in Cote d'Ivoire

In early April, in the final days of Côte d'Ivoire's torturous four-month-long political crisis, French and UN helicopters bombarded the presidential residence in Abidjan. This military operation sealed the fate of the incumbent, Laurent Gbagbo, paving the way for Alassane Ouattara, the widely recognized winner of the November 2010 presidential elections, to claim office. But the French and UN action had another effect: it triggered commentary and outrage about international interference -- in particular on the part of France -- in African affairs. Ivoirian newspapers backing Gbagbo fulminated about France's desire to retake its former colonies. The French press, meanwhile, obsessed about whether France's military intervention spelled a new era of Françafrique, the term, first introduced in the 1950s, for French interference in the internal affairs of its former African colonies. The New York Times ran a story about France's "long shadow" over its former colonies, and pundits around the world worried that these international actions could doom Ouattara's legitimacy. Such a Eurocentric focus, however, both mischaracterizes the internal dynamics of the conflict and misses the more significant diplomatic development -- namely, the role of African regional organizations. In the end, France and the UN did not win the war for Ouattara and his self-styled "Republican Forces." By the time France and the UN intervened, Ouattara's forces controlled 90 percent of the country and were on the verge of taking the commercial capital, Abidjan. International forces did manage to hasten Gbagbo's demise: in effect, accomplishing the inevitable and preventing a final attack on Abidjan, which would have resulted in a terrible humanitarian crisis.

27. Reconstruction Zones in Afghanistan and Haiti

Abstract:
The longest war and one of the largest relief efforts in U.S. history- in Afghanistan and Haiti, respectively-are testing the cost-effectiveness of U.S. foreign assistance in conflictravaged or disaster-torn countries. U.S.-led economic reconstruction in both countries is clearly off track and becoming increasingly costly and unpopular-both at home and in the respective countries. Reconstruction zones (RZs), consisting of two distinct but linked areas to ensure synergies between them-a local-production reconstruction zone (LRZ) producing for local consumption and an export-oriented reconstruction zone (ERZ) producing exclusively for export- could be used to replace the fragmented way aid is provided to these countries with an integrated strategy for economic reconstruction. With an appropriate legal and regulatory framework, ERZs-operating as free-trade zones- could create appropriate links to the national economy as well as positive externalities or spillovers. Such a framework would avoid the problems created by these zones operating as enclaves in Haiti in the past. By targeting aid to provide adequate infrastructure and services within the RZs at a manageable scale, countries could jump-start their productive sectors and create jobs and entrepreneurship in agriculture, light manufacturing, and services, both for domestic consumption and for exports. By creating dynamic and inclusive growth, RZs could help countries stand on their own feet, consolidate peace, and overcome the unsustainable aid dependency to which they have grown accustomed.

The United States should take modest steps to create a legal channel for limited numbers of people fleeing natural disasters overseas to enter the United States. This would address two related problems: the lack of any systematic U.S. policy to help the growing numbers of people displaced across borders by natural disasters and the inability of U.S. humanitarian relief efforts to reduce systemic poverty or sustainably improve victims' livelihoods. The aftermath of the 2010 Haiti earthquake presents a compelling case study of the administrative and legislative ways the U.S. government could address both problems. Migration is already a proven and powerful force for reducing Haitians' poverty. A few modest changes in the U.S. approach could greatly aid Haiti's recovery.

Human rights are (universally) declared to be universal, yet we continue to live in a world where it is seemingly quite natural to limit human rights obligations to a state's own territorial borders. No doubt, many will accuse me of overstating matters when I say that territorial constraints constitute the single greatest impediment to the protection of human rights. What the territorial approach has done is to perpetuate a world of haves and have-nots among states, in which human rights protection is in large part dependent on the accident of birth. By rejecting the universality of duties, we have made a mockery of the universality of human rights.

30. How Can Bill and Melinda Gates Increase Other People\'s Donations to Fund Public Goods?

Abstract:
We develop a simple theory which formally describes how charities can resolve the information asymmetry problems faced by small donors by working with large donors to generate quality signals. To test the model, we conducted two large-scale natural field experiments. In the first experiment, a charity focusing on poverty reduction solicited donations from prior donors and either announced a matching grant from the Bill and Melinda Gates Foundation, or made no mention of a match. In the second field experiment, the same charity sent direct mail solicitations to individuals who had not previously donated to the charity, and tested whether naming the Bill and Melinda Gates Foundation as the matching donor was more effective than not identifying the name of the matching donor. The first experiment demonstrates that the matching grant condition generates more and larger donations relative to no match. The second experiment shows that providing a credible quality signal by identifying the matching donor generates even more and larger donations than not naming the matching donor. Importantly, the treatment effects persist long after the matching period, and the quality signal is quite heterogeneous—the Gates\' effect is much larger for prospective donors who had a record of giving to "poverty-oriented" charities. These two pieces of evidence support our model of quality signals as a key mechanism through which matching gifts inspire donors to give.
