21. Shattered Boundaries: Whither the Cyber Future

Abstract:
Under strain exerted by the internet boom of the early 2000's, the legal framework of boundaries applied to commerce, communications, law enforcement and even some aspects of armed conflict began to groan and fracture. Obsolescence was temporarily postponed by buttressing; one key reform of the USA PATRIOT Act was that it characterized internet service companies as communications providers. Police access to voicemail was directed through wiretap warrants rather than physical searches. Old communications-related statutes were adapted and “duct-taped.” Over the past couple of years, however, these fractures have grown to such magnitude that the old framework may no longer be adjusted to keep pace; it finally may be shattering.

NED established the Center for International Media Assistance (CIMA) in 2006 with encouragement from the U.S. Congress, which hoped that such an initiative would create a solid base of knowledge about the growing but not well understood field of media assistance. Two years later, CIMA published a volume entitled Empowering Independent Media, which provided a comprehensive look at both the key issues in the field as well as its latest findings and developments. Not surprisingly, the volume's recommendations became essential reading for policy makers, donors, and implementers on how to strengthen all aspects of media assistance.

Public broadcasting has been in critics' crosshairs since its creation in 1967. Assailed from all sides with allegations of bias, charges of political influence, and threats to defund their operations, public broadcasters have responded with everything from outright denial to personnel changes, but never have they squarely faced the fundamental problem: government-funded media companies are inherently problematic and impossible to reconcile with either the First Amendment or a government of constitutionally limited powers.

An important aspect of CIMA's work is to research ways to attract additional U.S. private sector interest in and support for international media development. The Center was one of the of the main nongovernmental organizers of World Press Freedom Day 2011 in Washington, DC.

Abstract:
The field of private sector funding of independent media abroad has continued to undergo a massive upheaval over the past two years. Two major factors have driven the change. The first is economic: The 2008 recession sharply reduced the portfolios of most traditional foundations and media philanthropies, many of them by 20-30 percent. They were still recovering when the aftershock of 2011 struck. These institutions, many of them based on the East Coast, had formerly led the way in funding international media development activities, with an emphasis on journalism training and support for freedom of expression. Now they are in a period of retrenchment, struggling to maintain existing commitments and with few resources to pursue new initiatives.
