51. Japan's alliance diversification: a comparative analysis of the Indian and Australian strategic partnerships

Abstract:
As part of its movement toward 'normal country' status, Japan has begun to engage in a policy of alliance/alignment restructuring and diversification. This is a twin-track policy – the reconfiguration of existing allied relationships and the creation of new cooperative bilateral links. In recent years, Tokyo has deepened its ties with the United States and Australia on the one hand, while cultivating new partners such as India, as well as several Southeast Asian states. This article examines the nature and dynamics of two of the most important new strategic partnerships: India and Australia. Through a comparative analysis, it seeks to account for their formation, structure, and prospects using a specifically designed model of 'strategic partnership' drawn from Organizational Theories literature. It concludes that these strategic partnerships represent a major platform of a more robust and comprehensive security policy on the part of Japan, forged in response to a shifting international environment in the Asia-Pacific region.

Abstract:
Why should anyone be interested in the national context of a state policy? In the case of California's Global Warming Solutions Act (AB 32), the answer flows directly from the very nature of the problem— global climate change, the ultimate global commons problem. Greenhouse gases (GHGs) uniformly mix in the atmosphere. Therefore, any jurisdiction taking action—whether a nation, a state, or a city—will incur the costs of its actions, but the benefits of its actions (reduced risk of climate-change damages) will be distributed globally. Hence, for virtually any jurisdiction, the benefits it reaps from its climate-policy actions will be less than the cost it incurs. This is despite the fact that the global benefits of action may well be greater—possibly much greater—than global costs.

In Joseph Heller's comic war novel, Catch-22, the catch-22 of the title refers to a supposed military regulation that allowed one to be relieved of military service if one was insane, but further provided that no one who realized he would be better off out of military service could possibly be insane. Humanity's so far leaderless approach to dealing with rapidly accelerating climate change embodies a similar, but profoundly tragic, catch-22 that has, among other twists and contradictions, transmuted justice into paralysis. Many thought that the natural global leader of the effort to gain control of global climate change would be the United States, with its splendid cadre of scientists and its history of technological innovation. But our politicians have failed to be worthy of our scientists or of the trust we citizens have placed in them. Facing reality appears to be increasingly unpopular among those who pass as our national political leaders. Those who refuse to face reality often find that what they ignore may come back to bite them, and worse, it may hurt others who trust them with their well-being. It is unclear which members of the U.S. Senate have sold their souls to the fossil-fuel interests and which have simply closed their minds. But the effect is the same: the facts on the ground—and in the air, water, and ice of the planet—are racing further and further ahead of the faltering U.S. political efforts to respond to them. And the American failure of political leadership is one major factor that is crippling efforts to negotiate multilateral action at the international level.

Abstract:
Developments in climate change policy and international investment law may be ushering in a new era characterized by profound harmonization between the two regimes. Although policy instruments such as the Kyoto Protocol's “Clean Development Mechanism” (CDM) have been in existence for years, it is only relatively recently that the international community has turned to low-carbon foreign direct investment (FDI) and away from command-and-control regulation as the preferred means by which to achieve future greenhouse gas emissions reductions. Meanwhile, states have begun to renegotiate international investment agreements (IIAs) or sign new treaties to take into account policy goals, including climate change mitigation, that extend beyond the regime's traditional preoccupation with investor protection. Though still somewhat tentative, emerging trends in both arenas are thus showing unmistakable signs of convergence.

Abstract:
Until recently, most of the attention in US climate policy was focused on legislative efforts to introduce a price on carbon through cap and trade. Since that policy has stalled, at least at the national level, the Clean Air Act has assumed the central role in the development of regulations that will reduce greenhouse gas (GHG) emissions in the US. The modern Clean Air Act (CAA) was passed in 1970 and conveys broad authority to the Environmental Protection Agency (EPA) to develop regulations to mitigate harm from air pollution. In 2007 the Supreme Court confirmed that this authority applied to the regulation of GHGs ( Massachusetts v. EPA). Subsequently, the agency made a formal, science-based determination that GHGs were dangerous to human health and the environment, which compels the agency to mitigate the harm and forms the basis for the agency's regulation of GHG emissions.

Harvard Law School's Emmett Environmental Law and Policy Clinic* supports immediate large-scale carbon capture and sequestration ("CCS") demonstration projects as part of a larger national and global effort to address climate change. Large-scale CCS projects (those that sequester at least 1.5 million tons of captured carbon dioxide ("CO2") annually) must be demonstrated soon to confirm CCS as a viable strategy to combat climate change and to show the commitment of the United States to achieving meaningful reductions in domestic CO2 emissions.
