Abstract:
According to mainstream functionalist theories of international law and relations, international organizations are vehicles of states, tied to their masters by meticulous legal instructions. As Jan Klabbers recently pointed out in this journal,1 functionalism was based on the idea of establishing peace by channelling international relations into the purportedly technical, a-political realm of international organizations. Research of the last couple of decades has profoundly rebutted the assumption that international organizations are a-political. They have been discovered, among others, to serve as platforms for the formation of epistemic communities, as agorae for political deliberation and contestation or to use their bureaucratic potential and the flexibility of their mandates to establish a degree of independence from their principals. The book by Tana Johnson, professor of political science at Duke University, adds another important perspective that has not been explored so far. She turns our attention to the fact that institutional design might matter for the international organization’s independence from member states. As chief witness for her thesis, she summons the Intergovernmental Panel on Climate Change (IPCC). Originally a brainchild of the US government, it is today a fairly independent institution fallen from grace with its master. Johnson argues that it owes its independence to the influence of international bureaucracies – that is, staff of other international organizations, upon the process that led to its establishment. The thesis puts the spotlight on the fact that a majority of new international organizations that saw the light of the day during the last decades was fostered by pre-existing international organizations.

We are still in the early stages of a transformation of the U.S. electricity sector into a cleaner, more flexible, more resilient, and more dynamic system. The early history of investment in and adoption of clean energy technologies and practices has been mixed. The venture capital model has proven to be inadequate for scaling up clean energy, and anticipated policy developments have been slow to be realized. The sector-reshaping impact of unconventional gas, uneven capitalization of clean energy companies, and the mixed signals of government policymakers have slowed the march to a more distributed energy economy rooted in the greater use of renewables, the more efficient use of energy, and the optimization of information technologies in the energy sector.

Abstract:
In the last several years, rail has come to play an important role in the transportation of growing U.S. crude oil production. Over the last seven months, a number of serious accidents have resulted in intense review of the safety of shipping large quantities of oil by rail. The focus has been on classification of the oil, the integrity of tank cars, and rail operations. Regulatory processes have been initiated to attempt to deal with these issues in a timely manner. This analysis provides facts that illuminate the players, concerns, current status of regulatory action, as well as the potential issues going forward.

Abstract:
In the last nine years, U.S. shale gas and tight oil production has skyrocketed. Between 2005 and 2014, U.S. production of crude oil and natural gas has risen by nearly 65 and 34 percent, respectively, due to tight oil and shale gas development. The shale gas supplies from Pennsylvania alone equal the entire natural gas export capacity of Qatar, the world's second largest natural gas exporter in 2012. And the increase from light tight oil production in places like North Dakota and Texas over the last five years is equivalent to Iraq's current production levels. These increased energy supplies have fed not only national but global markets, helping to offset other market disruptions and stabilize prices, to the benefit of many.

Yes The reported snooping by the U.S. National Security Agency (NSA) on world leaders is a rich teachable moment. It shows the underside of international relations. Spying on other governments—including friendly ones—is a pillar of modern foreign policy and a vital tool to protect against modern security threats like international crime, terrorism, cyber-attacks, drug trafficking, climate change, and stealing technology. As the saying goes, friends today may be foes tomorrow. We really don't know what information was gathered, but it caused an upheaval in various capitals friendly to the United States. Brazilian President Dilma Rousseff cancelled a long-awaited state visit to the U.S. because of the Edward Snowden revelations, claiming that the NSA spying was an attack “on the sovereignty and the rights of the people” of Brazil. Similarly, German Chancellor Angela Merkel was upset by reports that the U.S. was listening to her cell phone communications; she, in turn, demanded a no-spying agreement with the United States.

The U.S. intelligence community and other federal agencies have commissioned the National Academies of Science (NAS) to study climate engineering. The term 'climate engineering' (CE) refers to a family of concepts that might be used to curtail global warming. In 2013, the NAS assembled an expert panel to study the subject. The panel plans to issue a report in the fall of 2014.

The release of the second installment of the Intergovernmental Panel on Climate Change's Fifth Assessment Report on March 31, 2014, provoked the usual calls for urgent and immediate action in response to climate change, including in particular at the international level in the form of a new climate treaty built upon domestic regulatory regimes. Irrespective of whether these calls for action are overly strident or carefully measured, the law plays a central role. In almost any discussion, the breadth and stringency of national and sub-national regulations and the extent to which a treaty can make them “legally binding” assumes paramount importance. But this emphasis on law is misplaced, because it runs headlong into the hard reality that would confront any international climate agreement in the US Senate. And given the soaring use of coal around the world, it also draws attention and resources away from far more achievable opportunities to develop and deploy advanced coal technologies that would allow the world's most abundant, accessible, and affordable energy resource to meet critical energy needs in balance with each country's environmental, economic, and security priorities.

Abstract:
Undertaking research on the political economy of sanctions in Iran covers a wide area of study. In a research project, relevant data and key questions can be collected in order to organize them methodologically and write a book on this issue. In this article, within the conceptual framework of political economy, interactions of a few variables involved in the sanctions on Iran are studied. First, the article explores the immoral aspect and consequently illegal aspect of sanctions as an American policy tool to coerce Iran's behavior regarding its legal right of nuclear enrichment. Then the article sheds light on economic impacts of the sanctions through examples. It also discusses political impacts of the sanctions and practical experience of how Iranians tackle these restrictions. It finally proposes an alternative way to change this hostility dominated environment of the Iran-US relations. This article concludes that As sanctions remain over a prolonged period they tend to become even less effective in achieving their political objectives; the sanctioning countries consequently tend to impose additional, more extensive sanctions, which only promotes further radicalization in both the sanctioned and sanctioning countries. The only way to stop this vicious cycle is for both sides to negotiate in good faith and with open minds.

For the last several years, California has considered the idea of recognizing, within its greenhouse gas cap-and-trade program, offsets generated by foreign states and provinces through reduced tropical forest destruction and degradation and related conservation and sustainability efforts, known as REDD+. During their deliberations on the issue, state policymakers have heard arguments from stakeholders in favor of crediting REDD+ offsets, and those against. After years of planning and cooperative efforts undertaken with states in Brazil, Mexico, and elsewhere, California is still determining whether to embrace REDD+ offsets. The most salient and potentially persuasive arguments in favor stem from the opportunity to influence and reduce international forest-related emissions contributing to climate change, while simultaneously reducing the costs imposed by the state's climate change law. The state is still grappling, however, with serious questions about the effectiveness of REDD+ in addressing climate change, as well as the impacts of REDD+ on other social and environmental objectives. The suitability of the state's cap-and-trade program as a tool for reducing emissions outside the state, given the co-benefits that accrue to local communities from in-state reductions, remains another key area of debate. The outcome of this policy discussion will depend on interrelated questions of program design, future offset supply and demand, and the weight given to the importance of prioritizing in-state emissions reductions and co-benefits.

30. What Future for Human Rights?

Like people born shortly after World War II, the international human rights movement recently had its sixty-fifth birthday. This could mean that retirement is at hand and that death will come in a few decades. After all, the formulations of human rights that activists, lawyers, and politicians use today mostly derive from the UN Universal Declaration of Human Rights, and the world in 1948 was very different from our world today: the cold war was about to break out, communism was a strong and optimistic political force in an expansionist phase, and Western Europe was still recovering from the war. The struggle against entrenched racism and sexism had only just begun, decolonization was in its early stages, and Asia was still poor (Japan was under military reconstruction, and Mao's heavy-handed revolution in China was still in the future). Labor unions were strong in the industrialized world, and the movement of women into work outside the home and farm was in its early stages. Farming was less technological and usually on a smaller scale, the environmental movement had not yet flowered, and human-caused climate change was present but unrecognized. Personal computers and social networking were decades away, and Earth's human population was well under three billion.
