481. Iraq's Transition: On a Knife Edge

Abstract:
The situation in Iraq is more precarious than at any time since the April 2003 ouster of the Baathist regime, largely reflecting the Coalition's inability to establish a legitimate and representative political transition process. The broad plan sketched out by UN Special Adviser Lakhdar Brahimi, the apparent willingness of the U.S. to delegate at least some political responsibility to the UN and the decision to loosen the de-Baathification decree are all steps in the right direction. But critical questions remain both unanswered and, in some cases, unasked.

After an unprecedented, multilateral military intervention in Kosovo succeeded in expelling Serb forces and enabling the return home of more than a million displaced persons, the international community embarked on the ambitious, long-term project of securing, rebuilding, and establishing the rule of law in Kosovo, while setting the territory on the path to self-governance. Visionary promises were made to the people of Kosovo, and careful planning was undertaken at NATO and United Nations headquarters and in many European capitals. But six months into the mission, the international community has so far not been able to deliver on its promises. No Kosovars of any ethnicity feel secure, tens of thousands of people remain without adequate shelter as winter sets in, civil registration has yet to get underway, there is as yet no agreed-upon, functional system of justice, and criminals – including suspected war criminals – continue to operate with effective impunity.

The hopes and aspirations for international cooperation that marked the end of the Cold War had their most exuberant expression in the industrialized countries' ambitious approach to humanitarian intervention. Confronted with an unprecedented number of internal conflicts and media images of mass suffering, the Security Council charged the United Nations with more than a dozen new missions between 1987 and 1996. Conceived largely as peacekeeping operations, these interventions nonetheless took on the requirements and drama of humanitarian assistance as genocide, mass migrations and starvation took their toll on millions of people.

Abstract:
Increased concerns about the negative humanitarian consequences of multilateral sanctions have prompted calls for reform. Drawing upon expertise in both humanitarian activities and sanctions scholarship, the report by independent analysts offers a series of recommendations to the United Nations system for ameliorating the adverse humanitarian consequences of sanctions and making their implementation more effective and accountable. The authors call for greater transparency in the functioning of UN sanctions committees and urge that the present ad hoc policy be replaced by a more regime-like system characterized by agreed principles, rules, and procedures.

Abstract:
This occasional paper explores the relationships between emergency and development assistance. These relationships are important because the development community has seen much of its investment eroded or negated in recent years by war and governmental collapse and because relief agencies have recognized the need for sustainable peace if their work is to have long-term significance. Understanding the connections is also important because of evidence that emergency assistance can be inappropriate or even dangerous and that development aid, like emergency assistance itself, has in some cases contributed to fueling and igniting conflict.

Abstract:
In December 1997, the Third Conference of the Parties (COP-3) to the United Nations Framework Convention on Climate Change (UNFCCC) met in Kyoto, Japan to negotiate a protocol to limit greenhouse gas (GHG) emissions. Two of the main features of the Kyoto Protocol are (1) legally binding requirements for Annex I countries to reduce collectively their emissions of six greenhouse gases by at least 5.2% below 1990 levels between 2008 and 2012; and (2) flexibility measures, including joint implementation (Article 6), a Clean Development Mechanism (Article 12) and emissions trading (Article 17, which appeared as Article 16bis in the draft Protocol text adopted in Kyoto) to encourage countries to meet their obligations at the lowest cost. Although emissions trading (ET) provisions were included in the Kyoto Protocol, the Parties did not establish rules and guidelines for the trading system. Instead, Governments have been asked to address these issues at COP-4, to be held in Buenos Aires, Argentina on 2-13 November 1998.

489. The Konjic Conundrum: Why Minorities have Failed to Return to Model Open City

On 1 July 1997 Konjic became the first municipality in Bosnia and Herzegovina (Bosnia) to be officially recognised as an Open City by the Office of the United Nations High Commissioner for Refugees (UNHCR). At the time, the Open Cities Initiative was supposed to form the backbone of UNHCR's approach to minority return. To obtain Open City status Konjic had to demonstrate a willingness to accept the return of minority displaced persons. In return, the UNHCR endeavoured to reward the municipality with additional funding. However, despite large-scale financial assistance and although close to 2,000 minority families have formally registered their intent to return, reliable sources estimate that fewer than 300 minority returnees have made their way home to Konjic since the Dayton Peace Agreement (DPA) brought the Bosnian war to a halt.

Abstract:
John W. Holmes' talk for the first annual meeting of the Academic Council on the United Nations System ( ACUNS ) in 1988 was titled Looking Backwards and Forwards. I would like to put the emphasis in this article on looking forwards—from Copenhagen plus one to the year 2000, 2015, or even 2030. In short, I would like to direct attention to the world that the United Nations will need to face in the years ahead, and explore how human advance can be carried forward over that period, rather than dwell on the predicaments in which the world is at present caught up or through which the UN has struggled over the fifty years of its existence.
