Abstract:
Despite the need for a multifaceted approach to protracted refugee situations, the overall response of policy makers remains compartmentalised. Security, development and humanitarian issues tend to be discussed in different forums, each with their own institutional arrangements and independent policy approaches. Meaningful comprehensive solutions for protracted refugee situations must overcome these divisions and instead incorporate the recent policy initiatives of a wide range of actors. This type of broader engagement—with a catalytic role by UNHCR—cannot occur without the sustained engagement of all branches of the UN system. In this way, the establishment of the UN Peacebuilding Commission provides both a timely opportunity and a possible institutional context for this type of cross-sectoral approach.

52. 'Justice on the Cheap' Revisited: The Failure of the Serious Crimes Trials in East Timor

From 2000 to 2005 a UN-sponsored tribunal in East Timor sought to achieve accountability for violence associated with the 1999 vote for independence from Indonesia. Despite criticism of the tribunal's performance the UN has maintained that it was a success. In fact the East Timor tribunal represents a virtual textbook case of how not to create, manage, and administer a hybrid justice process. It was handicapped from the beginning by a debilitating lack of resources, an unclear mandate, inadequate recruitment, ineffective management by a peacekeeping mission that had other priorities, and above all a lack of political will both at UN headquarters and at the mission level. Trial practices and jurisprudence were too often deeply flawed, in important respects did not meet international standards, and, in a significant number of cases, undermined the rights of the accused to a fair trial. Because the UN risks repeating some of the same mistakes in Cambodia it is particularly important now to assess the failings of the East Timor trials.

Abstract:
The goal of reconstructing policing systems which embody and embrace democratic norms has achieved an honoured place on the global security agenda. The need to secure minimal levels of security in transitional, developing, war-torn and post-conflict societies, and to keep local violence and conflicts from spilling over into regional arenas, has led to numerous efforts by international actors and donors to help local states and societies construct effective and fair public security systems. The paper examines efforts by the UN but also be regional organizations, NGOs, bilateral donors and domestic political and police actors to promote and structure reforms. Sufficient examples now exist to extract and suggest lessons on the process required to establish functioning and democratic policing systems. The paper will draw on existing academic literatures, reports by governments, international organizations and NGOs, and personal interactions with actors in this field to summarize what we know, and what we still lack information on, about how to plan for and implement the restoration of policing systems.

Abstract:
The Mozambique Security Network Symposium was held in Maputo on 30 June-1 July 2003. The meeting gathered approximately sixty participants from government, regional and sub-regional organisations and civil society. The event was made possible through the support of the UK Government's African Conflict Prevention Pool and was facilitated by the Global Facilitation Network for Security Sector Reform (GFN-SSR), a project funded by the United Kingdom that seeks to unite all actors and agencies in this field of study. Through the generous support of the United Nations Foundation, a number of representatives from Latin American countries also attended the meeting to draw on lessons learned and shared experiences from another southern region.

One year into the occupation of Iraq the United States and its Coalition partners remain in discussions over the country's fate. The deliberations have generally focused on the involvement of the United Nations, the schedule for handing over sovereignty to a democratic Iraqi government, and ultimately what the Iraqi government should resemble. The terms of the debate have regularly been sidelined by unforeseen events, including the recent rebellion in Fallujah, Shiite opposition in the south, grandstanding by local politicians, demagoguery, defection of Iraqi police and security forces and the wavering of Coalition partners, to name but a few. While progress is clearly being made in some areas, there are numerous signs that Iraq may not be ready for the June 30 transition of power. The top U.S. administrator in Iraq, L. Paul Bremer, has suggested that by June 30 Iraqi security forces simply will not be up to the task of defending against insurgents. Secretary of Defense Rumsfeld is more optimistic and remains committed to the June 30 deadline.

Abstract:
The Quartet was born at a meeting of foreign ministers in Madrid in April 2002, in response to Israeli army incursions into the Palestinian territories and in an attempt to give a fresh impetus to Western efforts to revive the lapsed Middle East peace process. The Quartet consists of the EU, Russia, the US and the United Nations. Given the relative passivity of the Russian and UN participants, the Quartet is effectively being driven by the US and the EU. While not yet successful in re-activating the peace process, it confirms in principle for the EU for the first time since the end of the Clinton period that the peace process is no longer the exclusive domain of the US, and that the US appears to welcome a more active European role as a political player, rather than just a payer of aid.

The proliferation of small arms and light weapons directly enables a horrifying number of deaths and injuries around the world each year, and it poses a grave threat to the stability and development of many countries, as well as to the success of UN-mandated peace operations. One of the most meaningful and straightforward initiatives concerned governments could undertake is to provide full unilateral transparency around the small arms shipments they are authorizing for import or export.

Abstract:
In the Programme of Action, agreed at the July 2001 UN Small Arms Conference, national governments adopted a wide-ranging set of commitments which, if implemented, would aid greatly in preventing and reducing the negative impacts of these weapons. In an extensive review, this paper reveals that states, intergovernmental organizations (IGOs), and nongovernmental organizations (NGOs) have taken up this challenge in a broad series of meetings, programmes, and policies. Individual states are enacting new laws, building needed capacity, and funding projects in affected states. UN agencies are engaged in various activities in support of the Programme, while the UN Secretariat is carrying out the tasks assigned to it in this document. At the same time, regional IGOs are taking action loosely based on the Programme. And NGOs, both global and local, have embarked on specific programmes and awareness-raising initiatives, empowered by the mandate contained in the Programme.

Abstract:
Throughout the 1990s, the notion of conflict prevention had an impressive career. It reappeared on the international scene when UN Secretary-General Boutros-Ghali coined the term "preventive diplomacy" in this Agenda for Peace (1992). Since then, several international organizations or multilateral institutions, including the UN and its sub-organizations, the OSCE, the OAU, the OECD or the G-8, have published piles of papers and declarations committing themselves to the prevention of violent or armed conflicts, to change their policies accordingly (e.g. in the area of development or financial aid) and to develop new or to reform old tools, ranging from fact-finding or observer missions, special envoys, the use of sanctions, peace-building efforts, institution-building, reconciliation processes to humanitarian aid as well as long-term financial and economic assistance. Until now, however, many celebrated declarations hardly moved from rhetoric to substance, the "culture of prevention", as it has been called by UN Secretary-General Annan, is still to be developed.

60. Ending Starvation as a Weapon of War in Sudan

Warring parties and international aid providers in Sudan have an historic opportunity to bring to an end what is perhaps the most extreme and long-running example in the world of using access to humanitarian aid as an instrument of war. A mid- December meeting between the UN and Sudan's warring parties – the Technical Committee for Humanitarian Assistance (TCHA) – provides an unparalleled vehicle to build on recent short-term agreements and to once and for all remove the institutional barriers to unimpeded access for humanitarian agencies. Such an opportunity may not arise again, so it is imperative that mediators, the UN Security Council, and interested governments provide concentrated and immediate support for this objective.
