This publication offers the Key Issues and Policy Recommendations based on the results of the Third International Conference “Governance and Reform of State Security Services: Best Practices”. Conference Three – the third in a series of eight – focused exclusively on the SSU reform process; aiming to unpack the issues raised during the first two events: the SSU’s military status, pre-trial investigation powers and its oversight and accountability. Building on the findings and recommenda- tions of the previous conferences, this Conference aimed to identify current reform priorities, discuss relevant European good practices and assess capacity development needs for intelligence governance in Ukraine.

Abstract:
There are often misunderstandings among member states in international organizations (IO) regarding the legal nature of certain acts. Issues of privileges and immunities based on the principle of functional necessity, both inherent and implied powers, and the principle of good faith under common law are continuously criticized and debated by both member states and IOs alike. For this reason, international legal order can be a process of continuous transition and constant evolution. This essay analyzes the development and changes of legal norms in the European Union’s (EU) Common Foreign and Security Policy (CFSP). On that basis, it will unfold by looking at the EU’s legal structure to create a solid framework for understanding the current challenges for common European defense policy in relation to Russia’s involvement in Ukraine. Although there have been substantial legal improvements introduced by the Treaty of Amsterdam (effective 1999) and by the Treaty of Nice (effective 2003) to help clarify the ambiguous nature of the CFSP, its objectives remain wide and abstract. Ombuds institutions for the armed forces are key actors in establishing good governance and implementing democratic controls of the security sector. These institutions are tasked with protecting the human rights and fundamental freedoms of armed forces personnel, as well as providing oversight and preventing maladministration of the armed forces. Abstract:
Results of a nationwide sociological survey conducted by the Razumkov Centre KYIV-2016 This publication presents the results of a nationwide sociological survey conducted by the Razumkov Centre’s Sociological Service in the framework of Ukraine’s security governance challenges monitoring project, implemented by the Geneva Centre for Security Sector Governance (DCAF), jointly with Razumkov Centre, with support from the Kingdom of the Netherlands. The survey and the publication were made possible through financial support from the Ministry of Foreign Affairs of the Kingdom of the Netherlands. The assessments and conclusions made by the authors do not necessarily coincide with official position of the Ministry of Foreign Affairs of the Kingdom of the Netherlands. The survey was conducted by the Razumkov Centre’s Sociological Service on 27-31 May 2016, in all regions of Ukraine, except Crimea and the occupied territories of Donetsk and Luhansk regions. 2,019 respondents aged above 18 years were polled. The sampling error does not exceed 2.3%.

Abstract:
This preliminary study performed by the Institute of Gender Programs and the Center for Army, Conversion and Disarmament Studies (CACDS), with financial support from DCAF, presents an analysis of the basic legislation regulating military service of women in the Armed Forces of Ukraine, the National Guard and the State Border Service. Concluding that the majority of problems faced by servicewomen during their professional career are not currently addressed by legislation, the study supplies preliminary recommendations and suggests amendments to specific legal provisions to fill relevant gaps in national legislation.
