591. State Identity, Continuity, and Responsibility: The Ottoman Empire, the Republic of Turkey and the Armenian Genocide

Abstract:
By studying the continuity between the Ottoman Empire and its succeeding Turkish Republic, this article aims to address one crucial aspect of the denial of the Armenian genocide by the Turkish state, namely the issue of state responsibility. There are psychological barriers in Turkey which have largely suppressed the memories of possible wrongdoings during World War I and the ensuing 'Independence War'. However, the barrier that is created by the issue of state responsibility is identified here as the fundamental obstacle for genocide recognition by the Turkish state. This article aims to apply some of the existing legal principles and theories of international law in order to test their applicability to the two Turkish states and the issue of internationally wrongful acts committed during World War I and the ensuing years. In addition to the Turkish Republic bearing the identity of the Ottoman Empire, this article suggests that the Republic not only failed to stop doing the wrongful acts of its predecessor, but it also continued the very internationally wrongful acts committed by the Young Turk government. Thus, the insurgent National Movement, which later became the Republic, made itself responsible for not only its own wrongful acts but also those of its predecessor, including the act of genocide committed in 1915–1916. The issue of possible liability has ever since the creation of the Republic formed the denialist policy which is Turkey's to this day.

Abstract:
We have been asked by the European Journal of International Law to write a reply to an article entitled 'State Identity, Continuity and Responsibility: The Ottoman Empire, the Republic of Turkey and the Armenian Genocide'. The article accuses Turkey of 'practising a denialist policy' with regard to 'the act of genocide committed during 1915–1916', demanding that it 'make itself responsible for its own internationally wrongful acts committed against Armenians and other Christian minorities', and also accuses it of 'expanding the massacres beyond its borders into the Caucasus and the territories of the independent Republic of Armenia'. According to the same article, there is a state succession and continuation of responsibility from the Ottoman Empire to the Turkish Republic, and the Republic must assume full responsibility for and should also repair the injury caused by the Ottoman Empire.

593. Tolerance as a European Norm or an Ottoman Practice? An Analysis of Turkish Public Debates on the (Re)Opening of an Armenian Church in the Context of Turkey's EU Candidacy and Neo-Ottoman Revival

Abstract:
Turkey has undergone significant legal and institutional reforms regarding minority rights and cultural rights in the past decade as part of a reform process to meet political criteria for EU membership. However, it has not been studied so far if this increasing institutional compliance has also led to transformations at a normative level in the public discourse in Turkey. To explore this question, this paper presents the results of a qualitative media analysis that I conducted on the restoration and reopening of an Armenian church in 2007 – a milestone for the Republic as churches were destroyed or doomed to vanish for nearly a century since the Armenian Genocide in 1915. The restoration of the Sourp Khatch/Akhtamar Church became a showcase for Turkey's self-promotion as a 'tolerant nation'. However, the church was notably made accessible to the public as a museum that initially lacked the cross on its dome and was conceived to only host a religious service once a year. This opening of a church-museum is a symbolic instance in Turkey's ongoing transformation process in which tolerance and plurality have become prominent keywords in politics and public debate. Yet, as the findings suggest, they do not so as a reflection of European norms, but rather stand for a rediscovery and reinterpretation of Turkey's Ottoman past practices as a multi-religious empire. I show, however, that this reinterpretation occurs on the shaky grounds of a blindfolded view of the past, in particular the denial of the Armenian Genocide, and on the denial that minorities are still endangered in present day Turkey. I conclude that, without an acknowledgement of the Armenian Genocide, Turkey's nostalgic embracement of the Ottoman past and representation of norms such as tolerance as the 'true' Turkish/Islamic norms do not stand for a norm internalization or a norm adaption process, but instead, for a disconnection between norm and practice.

Abstract:
According to the common idea, "the economic power determines the political power." By this general principle, when we look at the powerful states, we see that these states (countries) have, at the same time, the powerful political effect on the other actors. In this paper, some trade and economic data of Turkey are shown in order to localize its place in the World rankings. By this purpose, this paper argues the fact that Turkey which, being one of the countries belonging G-20, has tried since 1991 to play a big role in its bilateral relations in Caucasia, Central Asia and Middle East (CCAME). However, when the data of international business of Turkey and those of each one of the countries of Central Asia treated in the contents of research are studied, it is seen very clearly that the influence of Turkey in Central Asia is not very dominant or does not create a dominating effect over the economic plan in spite of the existence of the diplomatic effects, visa facilities and the visits based upon the cultural level and mutually testified. Without any doubt, although nobody can deny the existence and the probability of the gradual growth of Turkey's relations in CCAME's countries, Turkey, whose face is turned mainly towards the occident and the large majority of trade made within the European countries,tries to be an influential actor in the determined areas. Naturally, in spite of the celebration of Nawruz with the Turkic World, acting as a Muslim country in Middle East, and accepting the norms of European Union as a European democratic and laicized country in Europe, Turkey presents several identities and makes it a multi-colored actor who can be used in favor of Turkey's interests.

Abstract:
This article examines the Turkish-Armenian relations, its development throughout the history and the situation between those two countries since Recep Tayyip Erdogan became the prime minister of Turkey in 2003 resulting in the change of the Turkish foreign policy. The main focus is on the problems between Turkey and Armenia stemming out from the different view on the happenings in 1915 and the recognition of the so called Armenian genocide. The article analyzes the decision-making of the individuals, the international organizations and the states when it comes to the question of the so called Armenian genocide and the reasons of the decisions made by individuals and states. These decisions are subjected to criticism on the basis of the reality image theory by Ibrahim Canbolat (1993) and the Thomas theorem (1928) as well as other criteria. States are the most important actors in the article because they form the foreign policy and the influence of this particular problem of the decisions of states influences the relations between Turkey and the EU as well as other world powers. Turkey's importance and image are still worsened due to these reasons and unfortunately, it seems that states have no interest in finding the truth.

Abstract:
Turkey's foreign policy toward the Middle East has gone through a radical change over the decades. Earlier periods were marked by almost a complete neglect. However, since Özal, Turkey's interest toward the region has constantly increased. Especially in the last few years of the AKP government, in line with the new foreign policy vision, the Middle East has started to occupy a central place in Turkish foreign policy. In this article, underlying factors of this changing policy and newly envisioned regional role for Turkey will be analyzed. Turkey now pursues a pro-active and multidimensional foreign policy; and the Middle East seems to be the most suitable area for Turkey to implement a successful foreign policy based upon its new parameters.

598. Was Huntington Right? Revisiting the Clash of Civilizations

Abstract:
This essay is an attempt to revisit Samuel Huntington's controversial thesis about a clash of civilizations. Though the author has been an early critique of Huntington, he finds substantial evidence that corroborates Huntington's central thesis when he analyzes the American policy toward the Middle East through the prism of the clash of civilizations paradigm. He suggests that the pattern of double standards that are witnessed in American foreign policy toward the Middle East is an integral part of a world where supposedly immutable differences based on civilizations form the primary source of conflict. In order to support his argument the author draws on examples from several cases, such as the American policies toward the Israel-Palestine issue, America's position on Iran's nuclear enrichment program, American reaction to the Israeli raid on the Turkish ship Mavi Marmara, as well as Turkey's longstanding candidacy for membership in the European Union. In all, he finds startling double standards that fit Huntington's paradigm, for as he pointed out double standards are an integral part of a mindset that sees conflict in terms of clashing civilizations.

Abstract:
Contrary to the evaluation of several political leaders and analysts, the new Islamic governments that have been elected in Tunisia, Egypt and Libya in the aftermath of the Arab Spring do not follow the zealous Islamic Iranian model. Rather, they tilt more to the Turkish Islamic democratic system. Significantly, the new Muslim Brothers' regime under president Morsi in Egypt has adopted a balanced realistic policy in domestic, regional and international affairs. While giving Shi'i Iran a cold shoulder, Morsi is inclined to play a leading role in a new regional Sunni-Muslim coalition with Saudi Arabia and Gulf Emirates, and Turkey, the major Sunni Muslim power. Although the would-be Ankara-Cairo new axis will be cautious not to alienate Tehran, it will probably make efforts to contain Iran's attempts to create a Shi'i crescent in the region to control the oil resources in the Gulf. Turkey and Egypt will try to reduce Iran's advances in Iraq and Syria by fostering their Sunni Muslim communities and helping the Syrian Muslims to topple the Alawi regime. Finally the Ankara-Cairo strategic axis, backed by most Sunni-Muslim regimes and in coordination with Obama's new administration, is likely to induce Israel to settle the Palestinian issue.

Abstract:
This article examines the trajectory of Islamism as a modern phenomenon. It demonstrates that, having evolved under the influence of myriad political, intellectual and historical developments of the past two hundred years, the concept is still surrounded by various debates, movements, acts of violence, ideologies, policies and positions. Islamism also continues to be a significant element in Turkey's political and intellectual life as well. The article then engages several critical questions. Has Islamism reached its end? Is a new type of Islamism emerging? Is post-Islamism on the horizon. In response, the article argues that Islamism's diversification–as opposed to its end–leads the movement to survive as pluralities that result from structural changes stemming from global and plural modernities' interaction with societies. In line with social and political organizations' pursuit of violence, poverty, challenge, reconciliation and alliance, Islamism too is being plurally reconstructed.
