Abstract:
The closure case against AK Party heralds a new era in Turkish politics marked by the increased intervention of the judiciary in politics. Inasmuch as the governing party enjoys support of half of the Turkish electorate, the case has harmed the image of Turkish democracy and consequently risks jeopardizing Turkey's quest for full membership in the EU. The overall reaction of the West to the case indicates that the Western political and intellectual elites avoid the conventional Islamist secularist dichatomy in interpreting Turkish politics. To-level EU bureaucrats have emphasized that closure would seriously jeopardize the process of membership. AK Party needs to accelerate the democratization process by focusing on the rest of the constitutional reforms required for EU membership.

Abstract:
Female students with headscarf are currently prevented to enter the university in Turkey although there is no legal ground for such a ban. The ongoing controversy about the type of clothing for female students at the higher education institutions has become more intensified since the recent constitutional change in February 2008 to lift the de facto headscarf ban. The debate over this question revolves around whether headscarf is a religious attire or a political symbol, whether it should be banned to protect the secular foundations of the state or conversely allowed on the basis of individual freedom of religion as a corollary of secularism. The solution lies in the implementation of constitutional amendments without a further delay.

Abstract:
This policy brief aims to discuss the limits of the freedom of political parties in Turkey. The political party bans consitute one of the most important problems threatening the freedom of political parties in Turkey. The restrictions on the political parties come to the fore in two different forms: dissolution after the military coups and closure by means of legislation. In the current context of the case opened against the AK Party, it may be possible and advisable to apply an amendment, bringing Turkish jurisprudence in such matters in line with the standards of the European community.

Abstract:
In the parliamentary elections of July 22, 2007, AKP (Justice and Development Party) won 47% of the votes, obtaining a very strong mandate to take issue with Turkey's outstanding problems. In the predominantly Kurdish east and southeast region, the AKP doubled its vote from 26% to 53%. The AKP seemed to have persuaded the Kurds thanks to the party's earlier moves to solve the Kurdish problem by granting more rights and freedoms as well as jobs and economic prosperity. Having started the negotiation process with the EU and obtaining such a strong mandate from the Kurdish voters, why did the AKP turn its back to the Kurdish issue? This can be explained with reference to three groups of factors working at the domestic, the EU and international levels.

Abstract:
The recent closure case brought against the ruling Justice and Development Party is a direct assault on Turkey's democracy. For this reason, America should not lose the opportunity to swiftly and unequivocally repudiate the establishment's attempts to re-assert control over Turkish politics by undemocratic means. The lack of a concrete resolution on the part of the U.S. in regard to the case has already resulted in a credibility gap. Given America's emphasis on and interest in Turkey's democracy and attendant reform process, a simple re-affirmation of its commitment to citizen's choices in free and fair elections would send a powerful message to a country that is on edge. Instead, Turkey is left with 'friends' who lack credibility and resolve at the worst possible moment. If the ruling party and its leadership are banned from political life, not only will Turkey lose its credibility in the Middle East as the only indigenous Muslim-majority democracy, the United States will also lose credibility in the world theatre for failing to support democracy in Turkey.

Abstract:

The restrictions on the political parties come to the fore in two different forms: dissolution after the military coups and closure by means of legislation. In the current context of the case opened against the AK Party, it may be possible and advisable to apply an amendment, bringing Turkish jurisprudence in such matters in line with the standards of the European community. It is concluded that the Constitutional Court should interpret cases of the dissolution of political parties in the context of the principles of "secularism" and the "unitary state" in such a way as to take into account the requirements of the principle of "the rule of law" and to allow different political alignments to express themselves in a "human rights respecting" and "democratic" country.

Türk siyasal hayatı krizlerle doludur. Belirli aralıklarla siyasal sistem krize girmekte ve krizden çıkış için çeşitli yöntemler uygulanmaktadır. Sürekli tekrarladığı dikkate alındığında, krizlerin iyi analiz edilmediği ortaya çıkmaktadır. İktidarlar, genellikle krizden kaçınma ve krizi aşma politikası uygulamaktadırlar. Bu politika, sistemin belirli bir süre yürümesine yardımcı olsa da, krizlerin tekrarlamasına engel olamamaktadır. Asıl yapılması gereken ise, krizin kalıcı olarak çözülmesidir. Krizin çözülmesi de krize yol açan aktörlerin iyi analiz edilmesiyle mümkündür. Çalışmada kriz yönetimine değinildikten sonra, Türk siyasal krizinde rol oynayan aktörler ve faktörler incelenmiştir. Bu çerçevede sorunların kaynağını insandan çok sistemde aramanın yararlı olacağı tezi işlenmiştir.

Abstract:
The Kurdish Question is not a mere ‘terrorism problem,’ but rather an issue with ethnic, cultural, legal, political, social, economic, and psychological dimensions. It was there before the PKK existed; even if the PKK were to be completely eliminated, the problems and demands of the Kurds would persist. The era of armed conflict has inflicted heavy material and emotional losses on the region and Kurds in particular, and on the entire society in general. The state’s failure to pursue policies during non-violent periods in favor of restoring permanent peace has caused it to miss very important opportunities to find a solution, and has created among Kurds a feeling of distrust towards the state. The Kurdish Question, which has so far been a political issue between Kurds and the state, increasingly risks rapid transformation into a clash between the Turks and the Kurds.

On November 5, Turkish prime minister Recep Tayyip Erdogan and deputy chief of military staff Gen. Ergin Saygun visited President Bush in Washington to discuss the growing threat posed by the Kurdistan Workers Party (PKK). The composition of the Turkish delegation was symbolically important and demonstrates a new political stability based on the working relationship between the governing Justice and Development Party (AKP) and the Turkish military. Yet the newfound weight of the PKK issue may prove problematic for the United States -- and, in the long term, for Turkey as well.
