81. What Accounts for the Success of Islamist Parties in the Arab World

Abstract:
Islamist organizations are generally considered to be the strongest and most credible opposition to incumbent regimes throughout the Arab world. Fear of Islamic takeovers has led regimes and other outside powers to justify not holding free elections, citing examples that include the Algerian election of 1991, the Iranian Revolution, the AKP victory in Turkey and the perceived popularity of Islamist opposition groups throughout much of the Arab world (Brumberg 2002). Yet, other analysts have questioned the actual strength of Islamist movements within the Arab world, noting that although Islamists may be the main challenger, few have actually been successful in taking power (Roy 1994).

Abstract:
Turkey's membership in the European Union (EU) is contingent on economic, political, and cultural factors. Rather than a geographic area with a particular cultural and religious history, the EU defines "Europe" as a political project that espouses values such as human rights, pluralist democracy, and a liberal economy. However, Turkey's EU accession process highlights the cultural and religious dimension through which "Islam" and "Europe" may be mutually redefined. This article examines how Turkish Muslim immigrants in Europe have become an example of the compatibility of "Islam" and "Europe." It is concluded that opposing Turkey's EU membership based on essentializing arguments of cultural and religious difference is misleading and counterproductive, as it fails to address the shifting boundaries of Europe and of Islam.

Abstract:
Currently, the prospects for Turkey's EU membership do not look very bright. With key chapters for negotiation already suspended, the government is likely to resume a loose Europeanization agenda. The counterpart of this in the foreign-policy realm is an approach based on 'soft Euro-asianism'. An attempt is also being made to develop friendly relationships with all neighboring countries, coupled with a mediating role in regional conflicts, but without the EU providing the main axis for foreign policy. The present report investigates the continuities and ruptures in Turkish foreign policy during the post-2002 AKP era. It attempts to identify the underlying reasons for the decline in enthusiasm for EU membership following the golden age of Europeanization and reforms during the early years of the AKP government. The report also points to internal and external political developments which may help to reverse the current drift away from Europeanization.

84. The Story of an Alien(ation): Real Estate Ownership Problems of Non-Muslim Foundations and Communities in Turkey

Abstract:
The purpose of this report is to tell the story of the real estate ownership problem experienced by non-Muslim foundations since the Ottoman period, and to discuss to what extent laws enacted during the EU accession process have been effective in solving this problem. The second section of this report, following this introduction, explains the historical background of the ownership problems of non-Muslim foundations. Following brief information about the foundation system of the Ottoman Empire and the establishment of non-Muslim foundations, which constituted a part of this system, the minority regime created under the Treaty of Lausanne in 1923 are discussed, and rights and freedoms of non-Muslim foundations arising from this Treaty are evaluated. In the third section, the impact of minority policies adopted by Turkey since the Treaty of Lausanne regarding the property rights of non-Muslim foundations are considered, and various laws and practices such as the 1926 Civil Code, the 1930 Municipalities Law, the 1935 Law on Foundations, the 1936 Declaration, and the inclusion of non-Muslim foundations among seized foundations are analyzed. Policies of taking over the immovables of non-Muslim foundations implemented since the 1960s pursuant to the so-called the 1936 Declaration and the ‘seized foundation’ practice are discussed, by giving concrete examples. The legislation developed to solve the problems of non-Muslim foundations during Turkey’s accession to the EU is evaluated in the fourth section, and lawsuits referred to the ECtHR because of the inadequacy of these reforms are reviewed in the fifth section. After discussing, in the sixth section, the reasons of the inadequacy of the reforms made within the context of harmonization with the EU in solving problems of non-Muslim foundations, concrete proposals are made for solving continuing real estate ownership problems of non-Muslim foundations in the seventh and last section. The Constitutional Court ruled not to close down the AK Party, relieving Turkey from an unprecedented level of political uncertainty, social and economic turmoil, and potential chaos. Instead, the court chose to keep the ruling party under close scrutiny by declaring it “a focal point of anti-secular activities,” and imposing financial measures.

Abstract:
On March 14, Turkey's chief prosecutor, Abdurrahman Yalcinkaya, filed a case with the country's Constitutional Court asking it to shut down the ruling Justice and Development Party (AKP) and ban seventy-one of its members from seeking elected office for five years. He accused the party of spearheading "anti-secular activities" in violation of the Turkish constitution. Although the court's disposition is uncertain, the case is likely to strengthen the AKP regardless of the outcome.

Abstract:
This article aims to show how exchanges between religion and secularism, Islam and democracy and cross-cultural relations over many years have shaped Turks' perception of Islam and their position towards freedom of religion and co-existence of different faith communities. Muslims are generally attributed a monolithic identity marked by intolerance despite the fact that they have considerable diversity in their understanding of Islam and its practice. The Turkish case challenges such essentialist views by demonstrating that despite some isolated events, Turkey succeeds in managing religious diversity because the perception of Islam has developed in connection with a variety of current and historical events. The perception that emerged in the course of Turkish cultural and political history provides strong grounds for peaceful co-existence within the shared social order. Turkey's achievement in establishing a political culture and a perception of Islam that facilitates religious pluralism can be attributed to factors as such democracy and secularism and Turkey's efforts to join the European Union.

Abstract:
Despite its unique geographical and cultural position between East and the West, Turkey, throughout its modern history, has followed a Western-oriented foreign policy. This essay argues that Turkey's Western orientation is closely linked to Turkey's official Western identity created as a result of Turkey's modernization project in the years following the Independence War. The Islamist challenge to this new identity occasionally created a tension between the secular/Kemalist elite and the Islamists in Turkey, which from time to time impinged upon Turkey's foreign policy. The debate on Turkish foreign policy has been an extension of the debate on national identity in the past and still continues to be so. Therefore, in order to better understand the main determinants of Turkey's foreign policy preferences and behaviors, an analysis of Turkish identity is needed.

This paper challenges the view that the AKP is "an Islamist party" and "hardly a democratic opening". It puts forward the argument that the AKP's recent election victory represents a triumph over (1) inward-looking, anti-EU, ultra-Turkish nationalism, (2) unwarranted military interference in politics, (3) selfish Kemalist desires to protect their own privileged position, and 4) misguided secular fears of a secret Islamic agenda.
