Abstract:
In this policy briefing, our fifth in our series on prevention at the UN, we draw on examples from Côte d’Ivoire and Timor-Leste to illustrate how countries have developed integrated actions on prevention that cut across sectors, including security, development, and human rights. We then highlight options for the UN to better support these strategies through cross-pillar approaches and identify practical ways forward for governments implementing prevention approaches.

Abstract:
Over the past fifteen years, Timor Leste has made noteworthy gains in national development in general but continues to experience significant exposure during natural disasters like prolonged droughts and flooding in particular. Yet there is little documented evidence of these disasters and their impact on human security in Timor Leste. The challenges facing the country are considerable, and low institutional capacity makes it difficult for the government to increase resilience to slow onset disasters. This report explores how current structures, mechanisms and institutions in the country have been organised for emergencies and how disaster response operations have been conducted thus far. Data was collected by conducting in-depth interviews with relevant personnel from government agencies, international aid agencies and local non-state actors. This was supplemented by document analyses of major reports and literature surrounding disaster preparedness in the country. The findings reveal that there are three key strategies that need further development: enhancing institutional capacity, strengthening coordination mechanisms and evaluating current emergency response plans. Further research should include conducting a comprehensive needs assessment, mapping the localised response structures, and the contextualising of human insecurities in the country.

3. Security sector reconstruction in a post-conflict country: Lessons from Timor-Leste

Post-conflict missions by the United Nations are increasingly mandated to reform the security sector and to establish viable security governance organs in, often, collapsed states. UN missions in Timor-Leste, tasked with the build-up of local security institutions and forces from 1999 to 2005, were regarded by some as successful examples of externally-led security sector transformation in so far as they managed to establish a local police force and local security governance institutions. Yet, the breakdown of the Timorese security sector during violent clashes between newly created security forces in 2006 hinted at weaknesses in the externally driven implementation of SSR. The UN mission subsequently mandated to assist in rebuilding the dysfunctional security sector, was however openly challenged by growing local resistance towards external meddling into the highly sensitive domain of security, and simultaneously, by assertive local approaches to security governance. By tracing the UN mission's steps in performing SSR before and after the security breakdown of 2006, the paper explains inherent flaws in the UN's approach and expounds the Timorese' alternative approach. It will be argued that the UN failed to enforce its security governance model in Timor-Leste creating the way for an evolving local approach to security governance.

4. Timor-Leste: Oecusse and the Indonesian Border

Abstract:
Indonesia and Timor-Leste have done much to normalise relations ten years after the end to Indonesian rule in the former province, but the goodwill between capitals is not yet matched by full cooperation on the border. The costs are greatest in Oecusse, Timor-Leste's isolated enclave inside Indonesian West Timor. Negotiators have so far failed to agree on two segments of Oecusse's border, leaving open the risk that minor local disputes could be politicised and escalate into larger conflicts. Without a final demarcation, steps to improve management of the porous border have stalled. Initiatives that would promote exchanges and lessen the enclave's isolation remain unimplemented. As the bonds between the two nations grow, they should prioritise this unfinished business. Leaving it unresolved can only promote crime, corruption and the possibility of conflict.

5. Beyond the Truth: Can Reparations Move Peace and Justice Forward in Timor-Leste?

After hundreds of years as a Portuguese colony and then decades of Indonesian occupation, Timor-Leste (East Timor) finally became independent in 2002. Since then, Timor-Leste has been in the process of building itself as a sovereign nation, fighting to shake off its tumultuous past. Timor-Leste must now decide how best to resolve issues stemming from a brief civil war and Indonesian invasion and occupation (1975–1999), including grave human rights violations on all sides of the conflict. Human rights trials in both Timor-Leste and Indonesia have produced unsatisfying results, but two separate truth commissions recommended reparations—both intrastate and interstate—as a key element of reconciliation and healing. Critical questions remain, however, concerning the value, scope, and implementation of a reparations program within Timor-Leste or between Indonesia and Timor- Leste. Only a sincere, informed, and transparent decision-making process will result in a reparations program that could be a significant and successful part of moving peace and justice forward.

6. How Soon Can Donors Exit From Post-Conflict States?

Abstract:
When can a donor (successfully) exit from an on-the -ground presence in a post-conflict state? The answer, according to the analysis presented here, is in decades: figures well beyond what was originally envisioned when peacekeeping troops were first deployed. In the specific cases of Liberia, Mozambique, Solomon Islands, and Timor-Leste considered here, the best case scenario for successful exit ranges from 15 to 27 years. Successful exit, for the purposes of this paper, entails the creation of the necessary fiscal space to fund the recurrent budget from internally generated revenues. This is a necessary, albeit, not sufficient condition for donor exit. Of essence, however, is the time rather than the dollar value of support provided. An extended donor presence, it is argued, provides the space for the creation, sustenance, and maturation of institutions that are finally able to undergird the state from rolling back into state failure on donor exit.

7. Human Rights and Post-Conflict Transitional Justice in East Timor

Abstract:
The theme of this paper is human rights in East Timor during the United Nations Transitional Administration UNTAET and the first years of the independent Democratic Republic of Timor Leste. Following a brief background on the history of the conflict in East Timor this study focuses on three topics: human rights in institution building, post-conflict environment and human rights, and transitional justice. The term 'human rights' refers here to internationally recognized human rights standards and principles, including the principle of the indivisibility and equal importance of all hum an rights. However, the emphasis is on the rights related to political participation that are often categorized as civil and political rights, whereas economic, social, and cultural rights will not be specifically addressed. This is not to reinforce the ideological divisions concerning human rights left over from the Cold War period, or to suggest that economic, social, and cultural rights are less significant. Indeed, economic, social, and cultural rights are crucial in post-conflict conditions. The focus reflects the definition of human rights used in UN peace operation mandates, where economic, social, and cultural rights have largely been left out, albeit the importance of the promotion of economic and social well-being is recognized in recent UN peacebuilding strategies.
