51. Sri Lanka: Politicised Courts, Compromised Rights

Abstract:
Sri Lanka's judiciary is failing to protect constitutional and human rights. Rather than assuaging conflict, the courts have corroded the rule of law and worsened ethnic tensions. Rather than constraining militarisation and protecting minority rights, a politicised bench under the just-retired chief justice has entrenched favoured allies, punished foes and blocked compromises with the Tamil minority. Its intermittent interventions on important political questions have limited settlement options for the ethnic conflict. Extensive reform of the judicial system – beginning with a change in approach from the newly appointed chief justice – and an overhaul of counterproductive emergency laws are essential if the military defeat of the LTTE is to lead to a lasting peace that has the support of all ethnic communities.

Current approaches of measuring vulnerability to natural hazards generally use a rather static perspective that focuses on a single point in time—often before a hazardous event occurs. In contrast, the paper argues that vulnerability assessment should also take into account the changing dynamics during and after a disaster. This paper provides a comparative analysis of the situation in Sri Lanka and Indonesia within the context of the 2004 Indian Ocean tsunami. The author presents concepts for measuring revealed vulnerabilities and methods of assessing the recovery process, and highlights the differing ways in which the tsunami affected the ongoing civil conflicts in both regions.

53. The Determinants of Child Weight and Height in Sri Lanka: A Quantile Regression Approach

Abstract:
Reducing child malnutrition is a key goal of most developing countries. To combat child malnutrition with the right set of interventions, policymakers need to have a better understanding of its economic, social and policy determinants. While there is a large literature that investigates the determinants of child malnutrition, it focuses almost exclusively on mean effects of these determinants. However, socioeconomic background variables and policy interventions may affect child nutrition differently at different points of the conditional nutritional distribution. Using quantile regressions, this paper explores the effect s of variables such as a child's age, sex and birth order; household expenditure per capita; parental schooling; and infrastructure on child weight and height at different points of the conditional distributions of weight and height using data from Sri Lanka's Demographic and Health Survey. Results indicate that OLS estimates can be misleading in predicting the effects of determinants at the lower end of the distributions of weight and height. For example, even though on average Sri Lankan girls are not nutritionally-disadvantaged relative to boys, among children at the highest risk of malnutrition girls are disadvantaged relative to boys. Likewise, although expenditure per capita is associated with strong nutritional improvement on average, it is not a significant determinant of child height or weight at the lower end of the distribution. Similarly, parental education, electricity access, and the availability of piped water have larger effect son child weight and height at the upper quantiles than at the lower quantiles. The policy implication is that general interventions—parental schooling, infrastructure and income growth—are not as effective for children in the lower tail of the conditional weight and height distributions. These children, who are at the highest risk of malnutrition, are likely to need specialized nutritional interventions.

Abstract:
Almost every recent natural disaster that has occurred within a zone of conflict has been followed by expressions of hope from both diplomats and journalists that the disaster might somehow lead to peace. In order to assess whether the concept of “disaster diplomacy” has any merit, more systematic comparative research is needed, contrasting cases where disaster diplomacy seems to have been present with cases where it has not. As a step in this direction, this article explores the differing outcomes with respect to the separatist conflicts in Indonesia and Sri Lanka that followed the 2004 tsunami. In each of these cases, the tsunami provided an opportunity for separatist groups to supply critical public and private relief goods and thereby send a powerful signal about the functional legitimacy of their respective claims to autonomy. In this way, the tsunami affected the separatists' relative bargaining strength, creating an atmosphere more inclined toward peace in Indonesia and renewed civil war in Sri Lanka. The differing narratives suggest that the world pay more attention to post-disaster conflict zones given their positive and negative dynamic potential.

Abstract:
Sri Lanka's government must address the security needs and land-related grievances of all ethnic communities in its Eastern Province or risk losing a unique opportunity for development and peace. Muslims, Tamils and Sinhalese all feel weak and under threat, and recent ethnic violence could easily worsen. The government must devolve real power to the newly elected provincial council, end impunity for ongoing human rights violations and work to develop a consensus on issues of land, security and power sharing with independent representatives of all communities, including those from opposition parties.

Abstract:
Sri Lanka is in civil war again, and there are no prospects of a peace process resuming soon. On 2 January 2008, the government announced its withdrawal from a ceasefire agreement with the Liberation Tigers of Tamil Eelam (LTTE). This formalised a return to conflict that has been underway since 2006 but also presaged worse to come. The humanitarian crisis is deepening, abuses of human rights by both sides are increasing, and those calling for peace are being silenced. There is no present chance of a new ceasefire or negotiations since the government, despite pro forma statements in favour of a political solution, is dependent on hardliners and appears intent on a military decision. International actors must concentrate for now on damage limitation: protecting civilians from the war's worst effects and supporting those working to preserve Sri Lanka's democratic institutions.

In recent years, the traditional tendency to treat non state actors that resort to terrorist violence as a domestic issue has given way to an increasing focus on international—and multilateral—responses Nationalist/ separatist terrorist groups such as the Kurdistan Peoples Party (PKK) in Turkey, the Tamil Tigers (LTTE) in Sri Lanka, or the Revolutionary Armed Forces of Colombia (FARC) generated only limited responses at the multilateral level. The emergence of transnational terrorism in the 1970s led to a spate of international law-making to facilitate inter-state cooperation in response to hijacking, hostage-taking and other forms of terrorism. But only with the emergence of Al Qaeda, with its extraordinary global reach, has the transnational threat moved to the top of the agenda of international for a such as the United Nations and G8.

Abstract:
In any survey of present-day regional cooperation, South Asia is liable to be cited as one of the problem cases. The dominant strategic feature of the region is the tension and rivalry between India and Pakistan, two powers that have more than once gone to war or to the verge of war and that now have nuclear weapons. Unlike the East–West confrontation of cold war times, this confrontation has not (yet) led to more than a few fragmentary elements of a larger structure of confidence building and conflict avoidance. Even this major challenge is only one of the difficulties in the way of a non-zero-sum multilateral security order for the region. The discrepancy of size and power between India, a nation of over 1 billion people, and all its neighbours leads to natural concerns among the latter about India's dominance in the region and potential interference in their affairs. At different times this has been a significant strand in the policy thinking of states such as Bangladesh, Nepal and Sri Lanka and has led them to seek security assistance first and foremost from outside South Asia when they need it.

Abstract:
Throughout much of the 25-year Sri Lankan conflict, attention has focused on the confrontation between the majority Sinhalese and the minority Tamils. The views of the country's Muslims, who are 8 per cent of the population and see themselves as a separate ethnic group, have largely been ignored. Understanding their role in the conflict and addressing their political aspirations are vital if there is to be a lasting peace settlement. Muslims need to be part of any renewed peace process but with both the government and LTTE intent on continuing the conflict, more immediate steps should be taken to ensure their security and political involvement. These include control of the Karuna faction, more responsive local and national government, improved human rights mechanisms and a serious political strategy that recognises minority concerns in the east.
