21. Indonesia: Defying the State

Abstract:
Local institutions in Indonesia, empowered by decentralisation, are defying the country's highest courts with impunity, undermining judicial authority and allowing local conflicts to fester. District councils, mayors and regional election commissions have learned that there is little cost to ignoring court rulings on electoral or religious disputes, pandering instead to local constituencies and pressure groups. Decisive leadership from the president could make a difference; instead, slow and ineffective responses from Jakarta brew more insubordination. If the regions become overconfident in their new powers and the central state continues to respond weakly, this lack of commitment to rule of law could encourage more conflict as the national political temperature rises ahead of the 2014 presidential election.

22. Executive Accountability in Southeast Asia: The Role of Legislatures in New Democracies and Under Electoral Authoritarianism

Abstract:
In an influential study, Steven Fish and Matthew Kroenig argue that “overarching institutional designs” (i.e., presidential, parliamentary, and dual systems) tell us less about the prospects of a new democracy than does the particular strength of the legislature. Specifically, executive abuses are best checked where legislatures are powerful, generating horizontal accountability. Indeed, Fish and Kroenig suggest that with judiciaries and watchdog agencies weak in most new democracies, the legislature is the only institution by which accountability can be imposed. What is more, ordinary citizens are better informed by the robust party systems that strong legislatures support, fostering vertical accountability. In comparing Freedom House scores with their Parliamentary Powers Index (PPI), Fish and Kroenig show clear correlations, leading them to conclude that democracies are made strong by legislatures that are empowered.

23. Security Sector Governance and Conflict Management in Southeast Asia

Abstract:
Security sector governance (SSG) poses a huge challenge to states transitioning to democracy, particularly in cases where the military and other components of the security sector had been very influential in the conduct of government affairs. SSG is even more of a challenge in conflict-ridden societies where the state's capacity to ensure internal security has been undermined. Democratic norms suggest that effective SSG involves not only the management of core security forces, but also competent civilian oversight. In addition, SSG programmes in Southeast Asia will have to recognise and address the specific realities and experiences of a particular country. This policy brief is based on the proceedings of the Second Study Group Meeting on 'Security Sector Governance and Conflict Management in Southeast Asia' organised by the Institute for Strategic and Development Studies, Inc. (ISDS, Philippines) in collaboration with the RSIS Centre for Non-Traditional Security (NTS) Studies on 11 February 2011.

24. It's Not Only Rents: Explaining the Persistence and Change of Neopatrimonialism in Indonesia

Indonesia has long been associated with neopatrimonialism, corruption, collusion, and nepotism as the main modi operandi of politics, economics and public administration. Despite various measures and initiatives to fight these practises, little evidence for a significant decline can be found over the years. Rather, longitudinal analysis points to changes in the character of neopatrimonialism. Based on more than 60 in-depth interviews, focus-group discussions, and the analysis of both primary and secondary data, the aim of this article is, first, to describe the changes that have taken place, and, second, to investigate what accounts for these changes. Political economy concepts posit the amount and development of economic rents as the explanatory factor for the persistence and change of neopatrimonialism. This study's findings, however, indicate that rents alone cannot explain what has taken place in Indonesia. Democratisation and decentralisation exert a stronger impact.

Abstract:
Indonesia's position as a regional champion of democracy and human rights has become prominent in international forums since the resignation of President Suharto in 1998 and the subsequent period of internal democratic reform. Its proactive foreign policy culminated in the establishment of the Bali Democracy Forum in 2008 to promote and strengthen democracy and the rule of law in Asia through a process of learning and sharing. While Indonesia's proactive foreign policy continues, significant internal challenges remain. This policy brief offers an insight into one of Indonesia's longest running internal challenges, Papua, and suggests the use of the human security lens as an alternative to the dominant traditional security lens used by many policymakers, in an effort to promote conflict resolution and match developments at home with its proactive strategies abroad.

Abstract:
The Indonesian military remains one of the most crucial institutions in a democratising Indonesia and continues to be a key factor in any discussion regarding the future of the country. Forced to withdraw from formal politics at the end of the New Order regime, the military leadership has been embarking on a series of reforms to "professionalise" the armed forces, while maintaining their standing within Indonesian society. This paper attempts to provide an assessment of the military reform process during the last 12 years in Indonesia. To this end, it will provide an overview regarding the role of the Indonesian military during the Suharto era; analyse to what extent the process of democratisation has shaped the role and mission of the military; explore the perceptions and motivations of the actors involved in the reform process; review what has been achieved; and highlight the outstanding issues that remain unaddressed. With regard to the final point, this paper discerns three major strategic gaps that undermine the processes of military reform in Indonesia, namely: the "regulation loophole", the "defence-economic gap" and the "shortcomings of democratic civilian control". Considering these problems, this paper concludes that while the military officers' interest in day-to-day politics will gradually diminish, the military professionalism will ebb and flow depending more on the behaviour of political elites and their attempts to address the major strategic gaps in the next stage of the country's military reform.

Abstract:
As of 1 January 2011, Indonesia assumed the chairmanship of the Association of South East Asian Nations (ASEAN). With the growing importance of Southeast Asia in the global arena, hopes are high that Indonesia will seize the opportunity to push for concrete improvements toward the establishment of the ASEAN Community in 2015, as well as to promote democratic values and respect for human rights in the region. At the start of its chairmanship, Indonesia has proposed three main agendas, namely: to ensure progress in the implementation of ASEAN Community Blueprints; to enhance ASEAN's roles in regional architecture; and to develop an ASEAN community vision in a global community of nations.

28. Myanmar: Major Reform Underway

Abstract:
Six months after the transition to a new, semi-civilian government, major changes are taking place in Myanmar. In the last two months, President Thein Sein has moved rapidly to begin implementing an ambitious reform agenda first set out in his March 2011 inaugural address. He is reaching out to long-time critics of the former regime, proposing that differences be put aside in order to work together for the good of the country. Aung San Suu Kyi has seized the opportunity, meeting the new leader in Naypyitaw and emerging with the conviction that he wants to achieve positive change. The Association of Southeast Asian Nations (ASEAN) seems convinced that Myanmar is heading in the right direction and may soon confer upon it the leadership of the organisation for 2014. This would energise reformers inside the country with real deadlines to work toward as they push for economic and political restructuring. Western policymakers should react to the improved situation and be ready to respond to major steps forward, such as a significant release of political prisoners.

A controversial bill defining the role and functions of Indonesian intelligence agencies has top priority in the Indonesian parliament. It was originally scheduled for enactment in July 2011 but will now be delayed until September or October. It would be better to put the bill on hold even longer until there is a more comprehensive assessment of security needs and how to address them.

30. Timor-Leste's Veterans: An Unfinished Struggle?

Abstract:
More than ten years after the formation of Timor-Leste's army and the demobilisation of the guerrilla force that fought for independence, the struggle continues about how to pay tribute to the veterans. The increasingly wealthy state has bought off the threat once posed by most dissidents with an expensive cash benefits scheme and succeeded in engaging most veterans' voices in mainstream politics. This approach has created a heavy financial burden and a complicated process of determining who is eligible that will create new tensions even as it resolves others. A greater challenge lies in containing pressures to give them disproportionate political influence and a formal security role. A careful balance will need to be struck between paying homage to heroes while allowing a younger generation of leaders to grow up to replace them. Failure could block the generational transfer of power necessary for the state's long-term stability.
