11. Implications of Kosovo, Abkhazia and South Ossetia for International Law: The Conduct of the Community of States in Current Secession Conflicts

Abstract:
The objective of this article is to examine whether the current conduct of the community of states in the cases of Kosovo, Abkhazia and South Ossetia has any implications on international law. This question arises particularly in the case of Kosovo, since many states have recognised its separation from Serbia. Can the conduct of the community of states be used as a legal precedent by other groups seeking separation, e.g. in Azerbaijan, China, Georgia, Moldova, Spain or Ukraine? What if more states were to recognise Kosovo in the future? The focus of this paper will be to consider the implications of the conduct of the community of states on the interpretation of international treaties and customary international law. In this respect, the conduct of states in the cases of Abkhazia and South Ossetia in August 2008 will also be taken into account.

12. Georgia-Russia: Still Insecure and Dangerous

Abstract:
Ten months after the “August war” between Georgia and Russia, violent incidents and the lack of an effective security regime in and around the conflict zones of South Ossetia and Abkhazia create a dangerous atmosphere in which extensive fighting could again erupt. Russia has not complied with key aspects of the cease-fire agreements that President Medvedev reached in August/September 2008 with French President Sarkozy in his then EU presidency role. Its 15 June Security Council veto of an extension of the sixteen-year-old UN observer mission mandate in Georgia and Abkhazia and its apparent intention to require the removal of the mission of the Organisation for Security and Co-operation in Europe (OSCE) by the end of the month are blows to regional security that will further fuel tensions. Most of the on-the-ground conflict resolution machinery is thus being dismantled. Moscow should review its counterproductive position and work for a reasonable compromise allowing the UN and OSCE monitors to continue their important work.

13. Ossetians in Georgia in the Wake of the 2008 War

Abstract:
As a result of the August war of 2008, the demographic situation in South Ossetia has been entirely altered. After the Georgian authorities lost administrative-territorial control over the Didi and Patara Liakhvi gorges and Akhalgori district, the majority of the population of these territories, including the entire population of Didi and Patara Liakhvi, were forced to leave their homes. The demographic structure of districts adjoining the conflict zones was also affected. As of September 2008, internally displaced persons (IDPs) from the conflict zone (including districts of Shida Kartli) numbered more than 127,000 in total. After the ceasefire agreement between Russia and Georgia was signed and Russian troops removed from the region, a large number of those forcibly displaced outside the administrative borders of the former autonomous region of South Ossetia returned home. However, the entire ethnic Georgian population of Didi and Patara Liakhvi, as well as several thousand Georgians from Akhalgori districts, remain displaced. The Ministry of Refugees and Accommodation of Georgia has granted them the status of IDPs and housed them in 38 specially constructed cottage settlements. According to official figures from the Ministry of Refugees and Accommodation, the number of IDPs from the August war (excluding those displaced from Upper Abkhazia) currently stands at 24,729.

14. What's in a Line? Is Partition a Solution to Civil War?

Abstract:
The debate over territorial partition as a solution to civil war is highly politically relevant. At the height of the Iraqi civil war in 2006 and 2007, faced with intensifying violence against civilians, mistrust among the main Sunni, Shiite, and Kurdish groups, and bleak prospects for state building, policymakers and analysts turned to ideas about partitioning the country. War-induced partitions and partition-induced wars continue to be prominent features in international security—two recent examples being the de facto partition of Kosovo from Serbia in 1999 followed by international recognition of Kosovo's independence in 2008, and the August 2008 war between Russia and Georgia following the latter's invasion of the separatist region of South Ossetia.

Abstract:
On 7 August 2008, Georgia attacked Tskhinvali, the capital city of South Ossetia, with heavy artillery, rocket launchers, and ground troops in an attempt to take control of the breakaway republic, which contained bases of both Russian and OSCE peacekeepers. Russia, claiming to be acting under the mandate of peace enforcement, pushed Georgia out of both South Ossetia and another breakaway Georgian republic, Abkhazia, and deep into Georgian territory. This created the potential for regime change, as the Russian Army appeared to be moving on Tbilisi with the intent of overthrowing Georgia's democratically elected government. On 8 August 2008, Russian military forces crossed the Georgian border into South Ossetia and Abkhazia in a successful effort to repulse Georgian troops. The immediate casus belli for Russia was genocide, with claims that “over two thousand” South Ossetians had been killed by Georgian troops, along with the shooting of ten Russian peacekeepers in South Ossetia, which necessitated a humanitarian and peace enforcement operation. The Russian advance included ground troops, tanks and armored personnel carriers, and air and sea operations, combined with coordinated kinetic and cyber attacks. Russian forces also crossed into Abkhazia in defense of their compatriots – 70 percent of the Abkhaz population of 220,000 are Russian passport holders, and 90 percent of the South Ossetian population of 70,000 are also Russian citizens.

Abstract:
In contrast to the hectic third quarter of the Beijing Olympics and South Ossetia, the last quarter of 2008 was calmer for Russia and China. Their bilateral relations, nonetheless, seemed to become more substantive. The 13th annual Prime Ministerial Meeting in Moscow in late October and the 13th session of the Russian-Chinese Intergovernmental Commission on Military-Technical Cooperation in Moscow in early December provided some fresh impetus for the impasse in two important areas of bilateral relations: the long-awaited oil pipeline to China and military relations. Separately, the quarter also witnessed the final, albeit low-key, ceremony for settling the last territorial issue when Russia officially transferred to China control of one and a half islands of the disputed territory near Khabarovsk. However, the world around Russia and China was in turmoil not only because of the financial tsunami that was leaving no nation behind, but also because of regional crises between India and Pakistan as well as Israel and Palestine, and the stagnation in the Korea denuclearization process.

The Russia-Georgia conflict has transformed the contemporary geopolitical world, with large consequences for peace and security in Europe and beyond. Moscow's initial moves into South Ossetia as large-scale violence broke out there on 7-8 August were in part a response to a disastrous miscalculation by a Georgian leadership that was impatient with gradual confidence building and a Russian-dominated negotiations process. But Russia's disproportionate counter-attack, with movement of large forces into Abkhazia and deep into Georgia, accompanied by the widespread destruction of economic infrastructure, damage to the economy and disruption of communications and movement between different regions of the country, constitutes a dramatic shift in Russian-Western relations. It has undermined regional stability and security; threatened energy corridors that are vital for Europe; made claims with respect to ethnic Russians and other minorities that could be used to destabilise other parts of the former Soviet Union, with Ukraine a potential target; and shown disregard for international law.

Here in Washington, the “silly season” is well and truly upon us. Observing the frenetic campaign cycle, with its endless media appearances, speeches and jostling for political position, it's easy to understand why conventional wisdom has it that no serious policy gets done in an election year. And yet, foreign policy remains front and center on the national agenda. As of this writing, at least one crisis, the conflict between Russia and Georgia over South Ossetia, has broken into the open, while another—that of Iran's nuclear ambitions—waits in the wings.

Throughout the spring and early summer it seemed that U.S.-Russia relations could sink no further. Ill will beset the relationship. Heated discussions were carried out almost weekly on issues such as missile defense, Iran's nuclear program, Iraq, energy nationalism, and perhaps most significantly, NATO expansion. At one point, Vladimir Putin compared the U.S. to a “frightening monster,” while Senator (and Republican presidential nominee) John McCain called for Russia's eviction from the G8. In August, the worsening situation came to a head when Russian troops invaded and occupied South Ossetia (a Georgian Province), and launched attacks on other Georgian cities. The U.S. reaction was swift: condemnation, followed by the transport home of Georgian combat troops deployed in Iraq, the ferrying of supplies to Georgian ports by U.S. warships, the extension of $1 billion in aid, and the deployment of a small contingent of U.S. troops for “humanitarian” missions in Georgia. But some feel the response was not enough. The reaction did nothing to cow Moscow. By the end of August, Russia had asserted de facto control of both South Ossetia and Abkhazia and had recognized both as independent nations. Meanwhile the U.S. turned inward to deal with its financial crisis, leaving relations with Moscow on the backburner – at least temporarily.
