1. Defending the Maritime Rules-Based Order: Regional Responses to the South China Sea Disputes

Abstract:
The seas are an increasingly important domain for understanding the balance-of-power dynamics between a rising People’s Republic of China and the United States. Specifically, disputes in the South China Sea have intensified over the past decade. Multifaceted disputes concern overlapping claims to territory and maritime jurisdiction, strategic control over maritime domain, and differences in legal interpretations of freedom of navigation. These disputes have become a highly visible microcosm of a broader contest between a maritime order underpinned by the United Nations Convention on the Law of the Sea (UNCLOS) and challenger conceptions of order that see a bigger role for rising powers in generating new rules and alternative interpretations of existing international law. This issue examines the responses of non-claimant regional states—India, Australia, South Korea, and Japan—to the South China Sea disputes.

Abstract:
President Macron talks of France’s ‘Indo-Pacific strategy’ (une stratégie indo-pacifique). This article analyzes French strategic discourse and strategy adopted for the Indo-Pacific by France. It finds that French strategy has three main elements. Firstly it has seeks legitimacy, politically seeking to move from a colonial possessions position to democratic integration with France, and has sought to achieve regional integration and legitimacy of this. Secondly, geographically France has moved up northwards from its possessions in the Southern Indian Ocean and Southern Pacific to active maritime involvement in the northern Indian Ocean, South China Sea and Western Pacific. Thirdly, French strategy is to actively secure security partnerships with other countries in the region. Naval projection is a prominent feature of French strategy, which is a strategy which is significantly driven by China’s maritime expansion across the Indo-Pacific. The article thus seeks to analyze, explain and evaluate the effectiveness of France’s Indo-Pacific strategy.

3. Securing Energy Supply and Maritime Interests: Seeking Convergence

Abstract:
As ASEAN’s energy demand is likely to increase by almost two-thirds in the period up to 2040, the regional oil and gas resources in the offshore zones of the ASEAN member states will become even more important for enhancing the energy supply security of both the individual member states as well as for ASEAN as a whole. Accordingly, access to and political as well as physical control and security of these offshore energy resources will receive even more governmental attention. In context of China’s Belt and Road Initiative as well as South China Sea policies and its energy dimensions, they can fuel already existing maritime competition and conflicts in the South China Sea, the Bay of Bengal, the Indian Ocean and the interconnecting sea lanes and regional choke points. This paper analyses the question to what extent are energy security concepts and challenges are interlinked with maritime policies, particularly in regard to the unresolved overlapping claims in the South China Sea and the perceived intensifying naval competition in the Indian Ocean. It also highlights the strategic implications of ASEAN's rising energy demand and growing exploitation of its offshore maritime energy resources for future regional cooperation, enhanced competition and potential strategic rivalries as well as conflicts.

Abstract:
This article analyzes the fundamental challenges perceived by the People’s Republic of China: food security and energy security. They become evident through the higher demand over the domestic production. This relation compels the Chinese Communist Party to establish agreements with other countries to balance the supply and demand. The People’s Republic of China’s tools put in use to secure the agreements are institutional and military. Military tools are necessary to exercise the Chinese sovereignty over the South China Sea, and to keep safe the sea-lanes of communication. Consequently, the PRC-Brazil relations are examined, especially the latest.

5. Troubled Waters? Seeking a New Maritime Order in East Asia

Abstract:
Without a doubt, the most heated and persistent maritime disputes in the world are in the East Asia region. The vast bodies of water included in this region are the Northwest Pacific, the East Sea, the West Sea, the East China Sea, and the South China Sea. The diplomatic spat in the fall of 2010 between China and Japan over the Senkaku/Diaoyu Islands in the East China Sea was a strong indication that any mishandling of maritime issues can disrupt the subtle balance of power and interests in the region. Equally problematic are the disputes in the South China Sea, where China’s growing assertiveness has provoked concern among not only its Southeast Asian neighbors but also with the United States. Since the end of the Cold War, the United States has been the main provider of maritime security in the East Asia region but now faces the challenge of a rising China. In May 2011, a Chinese patrol boat cut the cable of a Vietnamese petroleum and gas probe vessel in the South China Sea. From this incident, tensions escalated to the brink of armed conflict. As countries in the region participate in tit-for-tat military exercises, the atmosphere has become worse. Under such conditions, many considered that the South China Sea issue, tangled with conflicts between China and ASEAN and the United States could flare up significantly. However at the 18th ASEAN Regional Forum (ARF) held from July 22-23 2011 a new perspective developed as China stated that “the importance of the freedom of navigation in the South China Sea is clear and all countries should be beneficiaries of such freedom.” Furthermore, during the China-ASEAN ministerial of the 2011 ARF Beijing stepped back by adopting the guidelines for the implementation of the Declaration on the Conduct of Parties in the South China Sea, which was agreed upon in 2002. Washington welcomed this move as it suggested an effort to decrease tensions with respect to the South China Sea. This is in stark contrast to the 2010 ARF meeting where confrontations arose between the United States and China with U.S. Secretary of State Hillary Clinton stating “a peaceful resolution of the South China Sea conflict directly relates to U.S. national interest.” From such developments, one can assess that the ARF has made important progress with respect to the South China Sea issue. However, the 2002 Declaration of Conduct that establishes the principle for peaceful resolution of maritime disputes in line with the United Nations Convention on the Law of the Sea (UNCLOS) lacks binding capacities and the newly adopted guidelines are mostly declaratory and lack specific details. Thus it would be too soon to consider the 2011 ARF meeting as a success with respect to the South China Sea dispute. Considering that China tends to use such multilateral channels as a ground for making peace but then is more forceful in its bilateral relations, the outcome of the recent ARF meeting could come to have less significance than expected.
